The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, March 3, 2015 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Wobbe.

The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe

Resolution No: 2015-051

Whereas, The County Board of Commissioners of the County of Wabasha, State of Minnesota, desire to offer for sale or condition use deed certain parcels (listed below) of land that have been forfeited to the State of Minnesota for non-payment of taxes; and

• Parcel 22.02720.00

o Tax Description: Lake City Section 05 Township 111 Range012 Eaglewood Estates 5th Addition Out Lot B

o Full Legal: Out Lot B of Eaglewood Estates 5th Addition, according to the plat thereof on file and of record in the office of the County Recorder for the County of Wabasha and State of Minnesota.

Whereas, said parcels of land has been viewed by the Soil & Water Conservation District and has been classified as non-conservation lands as provided for in Minnesota Statutes 282.01.

Now, Therefore, Be It Resolved That the Wabasha County Board of Commissioners hereby certify that the parcel of land listed above be classified as "non-conservation land".

Resolution No.: 2015-052

Whereas, Parcel R22.02720.00 Eaglewood Estates 5th Addition Out Lot B City of Lake City – Forfeited to the State of MN for nonpayment of property taxes.

Tax Description: Lake City Section 05 Township 111 Range 012 Eaglewood Estates 5th Addition Outlot B

Full Legal: Outlot B of Eaglewood Estates 5th Addition, according to the plat thereof on file and of record in the office of the County Recorder for the County of Wabasha and State of Minnesota.

Whereas, When the parcel was platted in 2002 and replatted in 2007, the City and the County believe it was the intent of the developer to deed the parcel to the City for the use of the bike trail easement. The City or the County cannot find any official document to state the transfer was to take place. Since City/County cannot find an official document, the option the City needs to take is to apply for a Conditional Use Deed from the State of MN.

Whereas, On 01/12/15 City of Lake City passed resolution # 15-003 stating they would like to use the parcel as a bike trail easement as it is currently being used that way.

Wheras, On 02/17/15 City of Lake City sent the fees and the Application for a Conditional Use Deed to the Wabasha County Auditor/Treasurer. Auditor/Treasurer recommends approving the City of Lake City's request for conveyance of the parcel.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Board of Commissioners hereby approve the City of Lake City's request for conveyance of parcel R22.02720.00 (legal listed above) for Public Use pursuant to MS 282.01, Subd 1a; and that such use will be for a bike trail easement.

Resolution No.: 2015-053

Whereas, Robert Stafki requested a Conditional Use Permit for a duplex residence on parcel R08.00286.00 located in Sec. 9, T 111 North, R 12 West, Lake Township (29145 720th St., Lake City); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on February 23, 2015 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 4-0 recommends to the Wabasha County Board of Commissioners that the request be approved with one condition.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Robert Stafki with the condition as follows: One dwelling unit shall be occupied by the landowner.

Resolution No.: 2015-054

Whereas, the Minnesota Housing Finance Agency, State of Minnesota, has been authorized to undertake a program to provide funds for Family Homeless Prevention & Assistance Projects; and,

Whereas, the Southeastern Minnesota Housing Network, working through: 1) Three Rivers Community Action, Inc. – Grantee and 2) SEMCAC and Lutheran Social Services, Sub-Grantees, has developed a renewal application for the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program; and

Whereas, the Southeastern Minnesota Housing Network working through: Three Rivers Community Action, Inc, SEMCAC, and LSS-LINK has demonstrated the ability to perform the required activities of the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program;

Now, Therefore, be it resolved that the Southeastern Minnesota Housing Network is hereby authorized as an entity to be charged with the administration of funds made available through the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program in the county of Wabasha, in Minnesota.

Resolution No.: 2015-055

Whereas, Envirotech Services Inc. is the lowest responsible bidder for C.P. 079-15-8150.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Envirotech Services Inc. for Project C.P. 079-15-8150 in the amount of $73,820.50 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Envirotech Services Inc. for this work.

Resolution No.: 2015-056

Whereas, Roberson Lime and Rock Inc. is the lowest responsible bidder for C.P. 79-15-8160.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Roberson Lime and Rock Inc. for C.P. 79-15-8160 – Aggregate Surfacing - in the amount of $76,958.80 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Roberson Lime and Rock Inc. for this work.

Resolution No.: 2015-057

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for CP 79-15-8180 Bituminous Seal Coat.

Resolution No.: 2015-058

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that that pursuant to Minnesota Statute 161.36, the Commissioner of Transportation be appointed as Agent of Wabasha County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects.

Be it Further Resolved by the Wabasha County Board of Commissioners that the County Board Chair and the County Administrator are hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in "Minnesota Department of Transportation Agency Agreement No. 1000217", a copy of which said agreement was before the County Board and which is made a part hereof by reference.

Resolution No.: 2015-059

Whereas, the Wabasha County Policy 102 outlines the process for recruiting and selecting potential applicants for employment with the County; and

Whereas, the proposed changes would provide clarification as to oversight in bringing potential hiring resolutions to the board and where positions should be placed on the appropriate pay scale; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners adopts the revised Policy 102 (Attached).

Board Chairman Wobbe stepped down and Board Vice Chairman Hall conducted the remainder of the meeting.

 

HALL - GOIHL

Resolution No.: 2015-060

Whereas, in the past Wabasha County used to dispose of the majority of its shredded paper materials to a farm in Wisconsin that would use the materials for animal bedding; and

Whereas, In August of 2014 the County was informed that the farming operation no longer wished to receive those materials; and

Whereas, In January of 2015 a Request for Proposals was issued to solicit bids to dispose of the aforementioned materials; and

Whereas, one bid was received which was opened by the Wabasha County Auditor/Treasurer; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that the bid submitted by Mike Wobbe for the price of $1.00 per month be accepted.
