The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, April 21, 2015 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Wobbe.

The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe

Resolution No.: 2015-079

Whereas, Wabasha County has advertised, taken and reviewed applications and conducted interviews for one Highway Maintenance Supervisor position,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Mr. James Webster is hereby authorized to be hired as a Highway Maintenance Supervisor at the start step of $23.0143 per hour.

Whereas, Wabasha County has advertised, taken and reviewed applications and conducted interviews for one vacant Highway Maintenance Worker position,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Mr. Eric Passe is hereby authorized to be hired as a Highway Maintenance Worker at the Grade 7 start step of $17.15 per hour as stated in the AFSCME Local 3533 (Highway Department) Labor Agreement.

Whereas, Wabasha County will have a vacancy in its Public Health Department for a Public Health Nurse due to the retirement of Kathleen Evers; and

Whereas, the Personnel Committee and the Public Health Director have identified the need to keep the position filled; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners authorizes the hire of a Public Health Nurse or Registered Nurse with the start date and salary to be determined by Human Resources.

Whereas, the Sheriff's Department recently purchased a vehicle for departmental use leaving a 2005 Chevrolet Silverado as excess vehicle in their department; and

Whereas, the maintenance and highway department share a 1999 GMC pickup truck that has over 240,000 miles; and

Whereas; the maintenance and highway department have indicated that the 2005 Chevrolet Silverado is in good working condition; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners transfers the 2005 Chevrolet Silverado (VIN 2GCEK13T151268711) to the Highway Department and that the 1999 GMC 4X4 Truck (VIN 1GTEK19V8X2534485) be disposed of by auction with the proceeds going toward the Squad Replacement Fund.

Whereas, the Wabasha County Board has previously approved the filling of the Eligibility Worker vacancy created by Tiffany Nelson's resignation as a permanent position; and

Whereas, April Schones is currently employed as an Eligibility Worker in a temporary position and has performed her job duties satisfactorily; and

Whereas, after completing the internal bidding process and in consultation with the Human Resources Department, the Social Service Director is recommending that April Schones be appointed to fill this permanent vacancy;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, it hereby authorizes the Social Services Director to appoint April Schones as an Eligibility Worker in a permanent position effective this date.

Whereas, there is a vacancy for the position of one Highway Maintenance Worker at the Wabasha County Highway Department.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Board of Commissioners hereby authorizes Wabasha County Highway Department to advertise and hire one Highway Maintenance Worker.

Resolution No.: 2015-084

Whereas, Fahrner Asphalt Sealers LLC is the lowest responsible bidder for C.P. 79-15-8180.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Fahrner Asphalt Sealers LLC. for C.P. 79-15-8180 – Sealcoat - in the amount of $472,647.19 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Fahrner Asphalt Sealers LLC for this work.

Resolution No.: 2015-086

Whereas, Parcel R22.02723.00 Eaglewood Estates 5th Addition OutLot E City of Lake City – Forfeited to the State of MN for nonpayment of property taxes.

Tax Description: Lake City Section 05 Township 111 Range 012 Eaglewood Estates 5th Addition Out-Lot E

Full Legal: Out Lot E of Eaglewood Estates 5th Addition, according to the plat thereof on file and of record in the office of the County Recorder for the County of Wabasha and State of Minnesota.

Whereas, The parcel was platted on March 15, 2007 and a Developer's Agreement dated February 16, 2007 was recorded on March 15, 2007 as document number 281885. The Developer's Agreement states parcel listed above should be conveyed to the City of Lake City for use by the City. The Developer never conveyed the parcel to the City.

Whereas, On 01/12/15 City of Lake City passed resolution # 15-004 stating they would like to use the parcel as a bike trail easement as it is currently being used that way.

Whereas, On 03/04/15 City of Lake City sent the fees and the Application for State Deed for Tax-Forfeited Land – Failure to Convey to the Wabasha County Auditor/Treasurer. Auditor/Treasurer recommends approving the City of Lake City's request for conveyance of the parcel.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Board of Commissioners hereby approve the City of Lake City's request for conveyance of parcel R22.02723.00 (legal listed above) for Public Use pursuant to MS 282.01, Subd 1a; and that such use will be for a bike trail easement.

Resolution No.: 2015-087

Whereas, Wabasha County administers a solid waste program as authorized under Chapter 115A and Chapter 400 of the Minnesota Statues; and

Whereas, A Solid Waste Management Plan is required to be adopted by Wabasha County to administer a solid waste management program and receive grant dollars from the State of Minnesota for such a program; and

Whereas, The Wabasha County Board of Commissioners must provide preliminary approval of the Solid Waste Management Plan as a first step towards adopting a new plan.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners by a majority vote grants preliminary approval of the Wabasha County 2015-2025 Solid Waste Management Plan and authorizes the MPCA to place it on public notice.

Motion to close the open meeting and open BWSR closed session.

Resolution No.: 2015-088

Whereas, Minn. Stat. §13D.05 subd. 3(b) permits closing a County Board meeting if such closure is permitted by the attorney-client privilege;

Whereas, the County Board desires to consult with its attorney regarding a settlement discussions that have been had with the Board of Water and Soil Resources; and

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting; and

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel; and

Whereas, certain phases of the litigation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Now, Therefore, Be It Resolved, a closed meeting of the County Board addressing the above referenced concerns will be held with the County's counsel. No subject matter other than the foregoing shall be discussed at said meeting.

Resolution No.: 2015-089

Whereas, In 2011 Wabasha County entered into a Feedlot Water Quality Management Grant Agreement with the Minnesota Board of Water and Soil Resources, and

Whereas, Upon review of the grant administration by Wabasha County it was alleged that there were multiple violations of the Grant Agreement and Fiscal Year 2011 Competitive Grants Policies, and

Whereas, Based upon those violations the Board of Water and Soil Resources requested that Wabasha County repay $115,579 plus costs to investigate and document the grant violations; and

Whereas, Since that time the County and the Board of Water and Soil Resources have engaged in settlement discussions to resolve the matter; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners hereby approves the attached Settlement Agreement pursuant to all of the terms and conditions therein
