The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 3, 2011 at 9:00 a.m.
The meeting was called to order by Board Chairman Norman. The following Commissioners were present: Norman, Hall, Roschen, Wobbe, Harms

HARMS – HALL Recessed for Regional Rail Authority meeting at 9:34 a.m. Adopted Unanimously WOBBE – HALL Adjourned RRA meeting at 10:00 a.m. Adopted Unanimously ROSCHEN - HALL Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: April 26, 2011 Adopted Unanimously HARMS – ROSCHEN Resolution No.: 2011-091 Whereas, the Zumbrowatha Trails Snowmobile Clubs of Wabasha County request that Wabasha County be their local sponsoring unit of government for pass-through of MN DNR snowmobile trail system funding, Now therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County act as the sponsor for an application for funding to the State of Minnesota Department of Natural Resources for development of maintenance of snowmobile trails managed by the clubs of Zumbrowatha Trails-Wabasha County for the 2011-2012 snow season, Be it further resolved: that upon approval of its application by the state, that Wabasha County may enter into an agreement with the State of Minnesota for the above referenced project and that it will act as the pass-thru for funds to the clubs as outlined in the Assistance Program manual, Be it further Resolved: that the County Auditor/Treasurer and/or Deputy Auditor/Treasurer is hereby authorized to serve as the fiscal agent for the above referenced project, Be it further resolved: that Marvin Howatt is appointed to be a County Trail Coordinator to work with the county clubs and assist the county in administering this program. Adopted Unanimously ROSCHEN - HALL Resolution No.: 2011-092 Whereas the State of Minnesota DNR along with Wabasha County has approved the Zumbrowatha Trails Association of Wabasha County's request for the County to act as the sponsoring unit of government for pass-through of funds to the snowmobile clubs for the 2011-2012 snow year as outlined in the Assistance Program Manual. Therefore, be it resolved that the Wabasha County Commissioners enter into a County-Club contract with each of the five snowmobile clubs within the Zumbrowatha Trails Association to administer their club's portion of the trail system for the 2011-2012 snow year according to the regulations outlined in the attached contract. The five snowmobile clubs consist of the Zumbro Valley, Wabasha Driftskippers, Cliff & Coulee Climbers, Elba Snowbirds and the Four Seasons. Adopted Unanimously HALL - WOBBE Resolution No.: 2011-093 Whereas, the following applicant wishes to have his County On Sale, Off Sale and Sunday Liquor License approved: On Sale, Off Sale & Sunday Liquor: Dave Roberts Ponderosa Bar & Grill Mazeppa Township Whereas, the applicant does have a current food & beverage license issued by Wabasha County Public Health, and Whereas, the application has been approved by the County Attorney and County Sheriff. The Wabasha County Auditor/Treasurer has received the certificate of insurance and the appropriate license fee. The liquor license will run from May 13, 2011 to July 31, 2011. Now therefore be it resolved that Wabasha County Board of Commissioners hereby approves the issuance of Liquor License to the individual listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner. Adopted Unanimously HALL - ROSCHEN Resolution No.: 2011-094 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one John Deere 6430 and Diamond mower attachments in an amount of $61,301 from SEMA Equipment, Inc. considering the trade-in value of Unit 944 and mower attachments. Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 944 – John Deere 6400 and mower attachments as Excess Equipment and authorizes the County Engineer to dispose as a trade-in allowance with SEMA Equipment, Inc. Adopted Unanimously WOBBE – HALL Recessed at 11:40 a.m. Adopted Unanimously WOBBE – HARMS Reconvened at 12:30 p.m. Adopted Unanimously Resolution No.: 2011-095 Whereas, the Wabasha County Highway Department finds it beneficial to purchase one 2011 International Tandem Truck and snow removal equipment, and Whereas, with the purchase of one 2011 International Tandem Truck and snow removal equipment, Unit 982 – Sterling Tandem Truck and associated snow removal equipment is considered excess. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one 2011 International Tandem Truck from Boyer International Trucks in an amount of $51,297 which includes trade-in of Unit 982 – Sterling Tandem Truck, and snow removal equipment from Towmaster, Inc. in an amount of $80,055, and hereby authorizes the County Auditor/Treasurer to issue warrants for applicable sales tax and license fees of the truck. Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 982 – Sterling Tandem Truck and associated snow removal equipment as Excess Equipment and authorizes the County Engineer to dispose as a trade-in allowance. Tabled to May 24 HALL - WOBBE Resolution No.: 2011-096 Whereas, MN Statute requires that Counties employ a County Engineer, and; Whereas, the term of our present County Engineer expires at the end of May, 2011, and; Whereas, our present Engineer has demonstrated his technical competence and professionalism in the engineering field, and has letters of recommendation from other County and State Engineers for his re-appointment, and; Whereas, the County Engineer has demonstrated the ability and willingness to collaborate with other Counties in projects that has resulted in cost savings for the Counties involved, and; Whereas, the County Engineer has demonstrated the willingness and initiative to seek and secure funding for Wabasha County highway and bridge projects that otherwise would not have been funded, and; Whereas, it is in the best interest of Wabasha County to retain our present Engineer with his five years of knowledge and experience with Wabasha County rather than seeking a new Engineer with no knowledge of, or experience in, Wabasha County, and; Whereas, it is recognized that there have been some issues identified in the Highway Department that must be rectified, that pre-date the term of the present Engineer and/or which he has not been allowed to respond due to budgetary constraints. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that County Engineer Dietrich Flesch be appointed to a new four-year term. Nay: Harms, Roschen Adopted Resolution No.: 2011-097 Whereas, the Planning Commission held a public hearing on April 25, 2011 and reviewed the Conditional Use Permit Application by Michael LaVigne, 65 Ashley Lane, Elgin MN 55932 for a commercial business, in accordance with Article 9, Section 3, Subd. 23 of the Wabasha County Zoning Ordinance. The request involves the following described property: Parcel # 12.00340.03 56170 278TH Avenue Plainview MN 55964 The West 470 feet of the North 470 feet of the SE ¼ of the SW ¼, Section 35, T.109 N. – R.12W (Oakwood Township). Whereas, the Planning Commission approved the request 5-0 and recommends approval from the County Board with the following conditions: Mr. LaVigne gets proper building permit and inspection on Ag building. Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions. HARMS - HALL Resolution No.: 2011-098 Whereas, the Wabasha County Social Services Director has received a letter of resignation from Kate Smith, Financial Worker, and Whereas, Ms. Smith is an employee in good standing with 26 years of employment by Wabasha County; and Whereas, Ms. Smith has indicated her last day of County employment will be May 2, 1011; and Whereas, the Agency Director has previously accepted Ms. Smith's letter of resignation on behalf of the Human Services Board and recommends acceptance, with thanks for her years of service, Now therefore be it resolved, the Wabasha County Board of Human Services hereby accepts the resignation of Ms. Kate Smith with regrets, and thanks her for the 26 years of service to the residents of Wabasha County. Adopted Unanimously HARMS - HALL Resolution No.: 2011-099 Whereas, Wabasha County Public Health Services Director has received a letter of retirement from Ms. Mary Arens, effective May 4, 2011; and Whereas, Ms. Arens has been employed with Public Health for approximately 25 years and is an employee in good standing; and Whereas, Ms. Arens has been and energetic employee, an advocate for her patients, and working successfully in a role of case management; and Whereas, the Director of Public Health Services recommends the Board accept the letter of retirement, with regrets and well wishes; Now therefore be it resolved, the Wabasha County Board of Human Services hereby accepts the letter of resignation from Ms. Mary Arens, effective May 4, 2011. This action is taken with regrets, good wishes, and thanks for the 25 years of service to Wabasha County residents. Adopted Unanimously HARMS - ROSCHEN Resolution No: 2011-100 Contract #B55392 Whereas, the Wabasha County Sheriff's Office has been authorized to participate in the 2011 Federal Boating Safety Supplement Grant; and Whereas, the Sheriff's Office has received the 2011 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and Whereas, the Sheriff requests the approval and signing of the 2011 Minnesota Department of Natural Resources Federal Boating Safety Supplemental Grant by the County Administrator and Chairman of the County Board. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2011 Minnesota Department of Natural Resources Federal Boating Safety Supplement Grant is hereby approved and authorizes it's signing by the County Administrator and Chairman of the County Board. Adopted Unanimously HARMS - WOBBE Resolution No.: 2011-101 Whereas, the County's labor contract with Teamsters Local #320 expired on December 31, 2010, and; Whereas, the County has been in negotiations with the Teamsters until a tentative agreement was reached on April 21, 2011, and; Whereas, this agreement mirrors the agreement reached with the jailers and dispatchers. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the contract be approved for a term of three years as negotiated by the County's Negotiating Team.
