Meeting of February 7, 2012

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, February 7, 2012 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Harms.

The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,

Motion to approve the agenda with removal of 'County Feedlot Position' discussion item.

Whereas, the Wabasha County Sheriff's Office is requesting to purchase a 2013 Ford Sedan Police Interceptor at a cost not to exceed $24,000.00; and

Whereas, this purchase is to replace squad #93 which was involved in a traffic crash on January 7, 2012; and

Whereas, $12,000 will be paid from insurance proceeds and the remaining $12,000 will come from the Safe Driving Class fund.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized to purchase a 2013 Ford Sedan Police Interceptor locally from Tom Heffernan Ford-Mercury at a cost not to exceed $24,000.00.

Be it Further Resolved by the Wabasha County Board of Commissioners that $12,000 of the funding for the purchase of the 2013 Ford Sedan Police Interceptor will come from insurance proceeds and the remaining $12,000 will come from the Safe Driving Class fund.

Whereas, the Planning Commission held a public hearing on January l3, 2012 and reviewed the Conditional UseApplication submitted by Milestone Materials, a Division of Mathy Construction Company on behalf of JOSEPH MILLER, 24552 570th St, Plainview MN 55964 for a Conditional Use Permit to extend an existing pit onto neighboring property. The request involves the following property:

Whereas, the Planning Commission approved the request 5-0 and recommends approval from the County Board with the following conditions:

A bond in the amount of $25,000 designed to address the potential reclamation costs if abandoned and this amount to be reviewed and adjusted with pit updates every 5 years by the Planning Commission and County Board.

Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Rezone Request.

Resolution No.: 2012-022

Whereas, Wabasha County is the local liquor licensing authority,

Whereas, on January 17,2012, the Minnesota Department of Revenue provided notice to Wabasha County that the Piper Hills Golf Course Inc.' s liquor license must be revoked within 30 days of the receipt of said notice,

Whereas, as Minnesota Statutes 270c.n Subd. 3 requires that a "license shall be revoked by the licensing authority within 30 days after receiving" said notice,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the liquor license for the Piper Hills Golf Course Inc. be revoked until a clearance certificate is received from the Minnesota Department of Revenue.

Resolution No.: 2012-023

Whereas, the Wabasha County Board has abolished the administrator position; and

Whereas, the abolition ofthe county administrator position will provide for a real and significant reduction in actual annual spending by Wabasha County; and

Whereas, the savings realized from the reduction in salary and benefits will allow for the county to continue to experience significantly reduced levels of administrative spending after a part-time county coordinator is hired; and

Whereas, hiring a county coordinator has no effect upon the government structure in Wabasha County; and

Whereas, the Wabasha County Board recognizes the necessity for a county coordinator to perform regular coordinating functions amongst department heads in order to maintain consistency and stability and assist the board with performance evaluations within the management team; and

Whereas, the department heads have identified the need for additional human resource support; and

Whereas, the hiring of a county coordinator will help ensure the continued provision of timely and high quality services to the residents of Wabasha County; and

Now therefore be it resolved, that the Wabasha County Board of Commissioners hereby authorizes the hiring of a part-time county coordinator; and

Be it further resolved, that in order to avoid any financial liabilities associated with insurance benefits, the position will be part-time at no more than 24 hours per week; and

Be it fmally resolved, that the efforts to organize the hiring of said county coordinator and to bring the final selection of applicants for interview and hiring by the Wabasha County Board, be led by a committee of three, to be appointed by the Wabasha County Board Chair.

Resolution No.: 2012-024

Whereas, the Wabasha County Highway Department proposes to acquire land along the existing right of way of County State Aid Highway 25 for the purpose of improving this road under S.A.P. 079~625-0 17; and

Whereas, S.A.P. 079-625-017 is necessary in order to improve this segment of County State Aid Highway 25 to meet Minnesota State Aid standards and provide for public health, welfare, safety and convenience; and

Whereas, the lands necessary to be acquired for S.A.P. 079-625-017 are described as follows:

l. That part of the Southwest Quarter of the Southwest Quarter (SW1I4 SWI/4) of Section 20, Township 108, Range 12, Wabasha County, Minnesota described as follows: Commencing at the Southwest comer of the Southwest Quarter, thence on a bearing ofS 89° 35' 50" E distant 165.40 feet; thence N 0° 24' lO"E distant 75.00 feet; thence N 89° 35' 50" W distant 166.95; thence S 0° 46' 57" E distant 75.02 to the point of beginning and there terminating. Containing 0.29 acres more or less of which 0.21 acres more or less is existing right-of-way previously acquired by written instrument or by prescription and 0.08 acres of new Highway Right of Way.

2. That part of the North Half of the Northwest Quarter (N1I2 NW1I4) of Section Twenty-nine (29), Township One Hundred Eight (108), Range Twelve (12), Wabasha County, Mirmesota, Commencing at the Northwest comer of the Northwest quarter, thence on a bearing ofS 89°35'50"E distant 240.55 feet; thence S 00024'10"W distant l37.35 feet; thence S 79°02'14"W distant 243.52 feet; thence N 00006'32"W distant 185.34 feet to the point of beginning and there terminating, Containing 0.89 acres more or less of which 0.38 acres more or less is existing right-of-way previously acquired by written instrument or by prescription and 0.51 acres of new Highway right of way.

Now therefore be it resolved that the Wabasha County Board of Commissioners that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to proceed to acquire the necessary lands as described above in accordance with applicable laws and statutes.

Whereas, the following described equipment no longer serves a useful purpose for the Wabasha County Highway Department:

Item 5309 - Pressure Washer, Item 5316 - Wood Stove, Item 5203 - Sears Lawnmower, and Wood Stove (no item number, previously removed from Office and installed and removed from Millville Shop)

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby declares the above listed equipment as Excess Equipment and authorizes the County Engineer to dispose at a consignment auction, or if not accepted to auction, dispose as junk.

Whereas, Envirotech Services Inc. is the lowest responsible bidder for C.P. 079-12-8030.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Envirotech Services Inc. for Project C.P. 079-12-8030 in the amount of $92,956.25 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Envirotech Services Inc. for this work.

Resolution No.: 2012-027

Whereas, Roberson Lime and Rock Inc. is the lowest responsible bidder for C.P. 79-12-8040.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Roberson Lime and Rock Inc. for C.P. 79-12-8040 - Supply and Haul of Crushed Rock - in the amount of $48,492 and that the Chairman ofthe County Board and the Clerk of the Board are hereby authorized to execute a Contract with Roberson Lime and Rock Inc. for this work.

Resolution No.: 2012-028

Whereas, AAA Striping Service Company had the lowest bid for Proj ect C.P. 79-12-8050 - Furnish and Apply Traffic Paint to Roads in Wabasha County.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of AAA Striping Service Company for Project C.P. 79-12-8050 - Furnish and Apply Traffic Paint to Roads in Wabasha County - in the amount of$41,866.38 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with AAA Striping Service Company for this work.

Resolution No.: 2012-029

Be it resolved by the Wabasha County Board of Commissioners that pursuant to Minnesota Statute 161.36, the Commissioner of Transportation be appointed as Agent of Wabasha County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects.

Be it further resolved by the Wabasha County Board of Commissioners that the County Board Chair and the Clerk of the Board are hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in "Minnesota Department of Transportation Agency Agreement No. 00553", a copy of which said agreement was before the County Board and which is made a part hereof by reference.
