Wabasha County Board of Commissioners Meeting of March 6, 2012
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, March 6, 2012 at 9:00 a.m.
The meeting was called to order by Board Chairman Harms.
The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,
HALL - ROSCHEN Motion to approve the agenda. Res. 051 moved to first action item; Res. 045 to last; Res. 047 removed. Adopted Unanimously

ROSCHEN - HALL Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: February 28, 2012 Donation of $500 from Mary Burrichter and Robert Kierlin to the Wabasha County Substance Abuse Court Adopted Unanimously Resolution No.: 2012-051 Whereas, Richard Bremer (29393 714th Street, Lake City, MN) has applied for a Conditional Use Permit to operate a gravel pit on property described as parcel 08.00074.00 located in the SW ¼ SW ¼, Section 16, Township 111 North, Range 12 West, Town of Lake; and Whereas, The Wabasha County Planning Commission has conducted a public hearing on the request on February 27, 2012; and Whereas, the Planning Commission approved the request with a vote of 5-0 and recommends approval from the County Board with conditions as follows: 1. Applicant shall have a complete reclamation plan approved by the Wabasha County Soil and Water Conservation District. 2. The reclamation plan shall adhere to the International Building Code regulations pertaining to step reclamation of a quarry face. 3. Reclamation plan provisions for vegetation to be used for site stabilization and erosion control of the quarry shall be approved by a professional landscape architect. 4. An easement shall be obtained prior to any erosion control structure being constructed on property not owned by the landowner of the quarry. 5. The lowest elevation of the quarry floor shall be 980 ft. (AMSL). 6. General hours of operation shall be limited to 7:00 a.m. to 7:00 p.m. Monday through Friday excluding state and/or federal holidays. 7. Hours for drilling of blasting holes and overburden stripping shall be limited to 8:00 a.m. to 5:30 p.m. Monday through Friday excluding state and/or federal holidays. 8. Hours for crushing shall be limited to 7:00 a.m. to 7:00 p.m. Monday through Friday excluding state and/or federal holidays. 9. Hours for blasting shall be limited to 10:00 a.m. to 4:00 p.m. Monday through Friday excluding state and/or federal holidays. 10. Blasting shall adhere to U.S. Bureau of Reclamation-Recommendation RI8507 regarding ground vibration on adjacent properties and shall limit air overpressure to 133 decibels. 11. Notice shall be provided at least twenty-four (24) hours in advance to residents within 1500 feet of the quarry for all blasting. 12. Notice of blasting signs shall be placed on the public highway on the day of blasting. 13. Seismographs shall be placed on the Weber property, the Brinkman Property, and at one location in the Wyndcliff Subdivision to record ground vibration at the respective properties from blasting activity in the quarry. 14. Blasting logs for all seismographs shall be sent to the Wabasha County Planning and Zoning Department. 15. Bonding for reclamation shall be set at $25,000 with proof of annual renewal delivered to the Wabasha County Planning and Zoning Department. Bonding requirements will be reviewed every five (5) years until quarry is reclaimed according to the reclamation plan. 16. White Pine six (6) feet in height shall be planted every ten (10) feet along the southern end of the pit to provide a visual screen to the Brinkmans from the area to be stripped of overburden in the first two (2) years. The berm on the southern end of the pit that is to be part of the berm constructed around the pit as per the proposal shall be planted with a combination of evergreen seedlings at an interval of 10 feet. The trees shall be maintained to have a 75% success rate for survival. Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit with the conditions listed above. Tabled to March 20 Board Meeting ROSCHEN - WOBBE Resolution No.: 2012-046 Whereas, the Wabasha County Highway Department finds it beneficial to purchase one 2012 Ford F550 Truck and Sign Body, and Whereas, with the purchase of one 2012 Ford F550 Truck and Sign Body, Unit 961 – F477 and existing sign body is considered excess. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one 2012 Ford F550 from Heffernan Ford in an amount of $27,353, and Sign Body from Truck Utilities Inc. in an amount of $27,959, and hereby authorizes the County Auditor/Treasurer to issue warrants for applicable sales tax and license fees of the truck. Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 961 – Ford F477 and existing Sign Body as Excess Equipment and authorizes the County Engineer to decide between a trade-in to Heffernan Ford or selling on EBay through Sheriff's Department. Adopted Unanimously Resolution No.: 2012-047 Whereas, Wabasha County has a policy that allows unpaid leave upon Board approval, and Whereas, Greg Mason, a Wabasha County employee, has requested unpaid leave of absence of up to 60 days, and Whereas, the employee has had a positive work history with Wabasha County during his employment. Now therefore be it resolved by the Wabasha County Board of Commissioners that up to a 60 days unpaid leave is granted, employee may return to work before then pending a physicians determination, and after 60 days the employee will return to work or request further leave. Removed from the Agenda NORMAN - HALL Resolution No.: 2012-048 Now therefore be it resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for S.A.P. 079-605-013 and S.A.P. 079-625-016. Adopted Unanimously HALL - ROSCHEN Resolution No.: 2012-049 Whereas, the Wabasha County Extension Committee has nominated Cyndie Kahn and David Pierson to serve as members of the Extension Committee for a period of three (3) years, Now, Therefore Be It Resolved that the Wabasha County Board of Commissioners appoint Cyndie Kahn and David Pierson to the Wabasha County Extension Committee. Adopted Unanimously NO MOTION Resolution No.: 2012-019 Whereas, Policy Number 104 of the Wabasha County Comprehensive Policies and Procedures Manual states that "annual step increases will not be processed until the evaluations have been complete, discussed with the employee and filed with Human Resources", and Whereas, effective January 1, 2012 structure of the County government was changed, and Whereas, certain positions evaluated under the previous administration currently would not receive an annual performance evaluation by their immediate supervisor. Now therefore, be it resolved, that the Wabasha County Board of Commissioners approves step increases without the evaluation for positions directly evaluated by the prior administration for 2012 or until further notice, whichever occurs first
ROSCHEN - NORMAN Resolution No.: 2012-050 Whereas, the County Recorder wishes to purchase the Land records software module (LandScan) for the Land Records System, and Whereas, this module will reduce staff data entry time and make the department more efficient, and Whereas, it was approved during the 2012 budget process to use $45,250 from the Compliance Fund for this purpose, and Whereas, the purchase of this module will complete the Land Records System. Now therefore be it resolved by the Wabasha County Board of Commissioners that the Recorder is authorized to purchase the LandScan module at a cost not to exceed $45,250 plus travel expenses from the Compliance Fund. ROSCHEN - HALL Resolution No.: 2012-045 Whereas, the following applicant wishes to have its "1 to 4 Day Temporary On-Sale Liquor License" approved: Theilman Sportsman Club, 62643 261 Ave., Theilman, West Albany Township, and Whereas, the liquor license will be in effect for July 3rd and 4th, 2012. Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the "1 to 4 Day Temporary On Sale Liquor License" to the Club listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.
