The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, January 22, 2013 at 1:00 p.m.

 

The meeting was called to order by Board Chairman Hall.

 

The following Commissioners were present: Hall, Wobbe, Springer, Harms, Roschen

Resolution No.: 2013-018

Whereas, Michael E. Morath and other Wabasha County registered voters filed a petition to establish the Wabasha County Government Study Commission pursuant to Minnesota Statutes Chapter 375A.12 and 375A.13; and

Whereas, the Wabasha County District Court, the Honorable Terrence M. Walters, Judge, issued an Order dated January 27, 2012, establishing the Wabasha County Government Study Commission; and

Whereas, the Wabasha County Government Study Commission met regularly from March of 2012 through December of 2012; and

Whereas, the Wabasha County Government Study Commission filed its Government Study Report with the District Court on December 21, 2012, recommending, in part, that Wabasha County adopt the County Administrator form of government as described in Minnesota Statutes Chapter 375A.01 to 375A.13; and

Whereas, the Wabasha County Board has reviewed the Wabasha County Government Study Commission's report which was presented to the Wabasha County Board on January 8, 2013; and

Whereas, the Wabasha County Board finds that the County Administrator form of government is a form of government best suited for Wabasha County to fulfill its responsibilities in providing government services to the citizen of Wabasha County; and

Now, Therefore, be it resolved, pursuant to Minnesota Statutes Chapter 375A.01 and 375A.06:

1. That the Wabasha County Board hereby adopts the Administrator form of government and establishes the office of County Administrator, effective immediately; and

2. That the Wabasha County Board shall develop a process to identify a qualified, experienced individual to fill the position of Wabasha County Administrator.

Resolution No.: 2013- 019

Whereas, David A. Johnson's four year appointment as the county surveyor expires on January 31, 2013, and

Whereas, David A. Johnson currently meets the qualifications and requirements as outlined in MN Statute section 389.011 subd. 1.

Now, therefore be it resolved, by the Wabasha County Board of Commissioners that David A. Johnson is reappointed as the Wabasha County Surveyor for an additional four year term to expire on January 31, 2017 provided a current Minnesota surveyor's license is maintained as required in the above referenced statute.

Be it further resolved, that the required bond, together with the surveyor's oath, and certified evidence of a license as a land surveyor will be recorded with the county recorder as required per MN Statute section 389.011 subd. 3.

Resolution No.: 2013-020

Whereas, the Wabasha County Extension Committee has invited the County Board of Commissioners to join 4-Hers and citizens at the Wabasha County Fair,

Now, Therefore Be It Resolved that the Wabasha County Board of Commissioners approve moving the July 16, 2013 County Board meeting to Wednesday, July 17, 2013 and meet at the Wabasha County fairgrounds, Wabasha.

It was the consensus of the Board to hold one July meeting of the Board of Commissioners at the fairgrounds during the Wabasha County Fair.

 

SPRINGER - HALL

Resolution No.: 2013-021

Whereas, Article 16, Section 4 of the Wabasha County Zoning Ordinance establishes a County Planning Commission; and

Whereas, Each Wabasha County Board Commissioner is granted the authority to select a member of the Wabasha County Planning Commission; and

Whereas, The Wabasha County Board of Commissioners appoints the members of the Planning Commission.

Now Therefore Be It Resolved, The Wabasha County Board of Commissioners appoints to the Wabasha County Planning Commission the following individuals to serve a term of two years:

John Mortenson (Harms), Lyle Wright (Roschen), Kent Zarling (Hall), Pat Gustafson (Wobbe), Jeanne Pietig (Springer).

Resolution No.: 2013-022

Whereas, Article 16, Section 5 of the Wabasha County Zoning Ordinances establishes a Board of Adjustment vested with the authority as provided by Chapter 394.21 through 394.37 of the Minnesota Statues; and

Whereas, The Wabasha County Planning Commission shall consist of seven (7) members; and

Whereas, The Wabasha County Board of Commissioners appoints the members of the Board of Adjustment.

Now Therefore Be It Resolved, The Wabasha County Board of Commissioners appoints to the Wabasha County Board of Adjustment the following individuals to serve a term of two years:

Ralph Breuer, Pat Gustafson (Planning Commission Member), Jon Beckman, Robert Walkes, Ron Meincke, Mike Wallerich, Dean Flugstad.

Resolution No: 2013-023

Whereas, the Wabasha County Sheriff is requesting to terminate the current food services contract with Consolidated Correctional Food Service (the "Consolidated Contract") and enter into a new contract with A'Viands, LLC; and

Whereas, the A'Viands contract would take effect on March 1, 2013; and

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that: the "Addendum" to the Consolidated Contract be signed thereby terminating the food service contract and modifying the current Equipment lease with Consolidated Correctional Food Services effective March 1, 2013; and

Now, Therefore, be it further Resolved that: the proposed food services contract between Wabasha County and A'Viands, LLC be approved and entered into with an effective starting date of March 1, 2013.

Resolution No. 2013-024

Whereas, the Wabasha County Board of Commissioners are entitled to receive a daily per diem in addition to their annual salary; and

Whereas, the per diems may be collected when performing duties of the office such as service on boards, committees or commissions as directed by the board or individual service as required by law; and

Whereas, the Wabasha County Board of Commissioners wishes to maintain a policy about which board duties are acceptable to receive such payments;

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners adopts the attached "Per Diem Policy" to be followed for the payment of requested Commissioner per diems.

Resolution No.: 2013-025

Whereas, in December of 2012 the Minnesota Board of Water and Soil Resources (BWSR) delivered its fiscal year 2011 Clean Water Fund Feedlot Quality Management Grant compliance report to Wabasha County; and

Whereas, in that report Wabasha County was notified that it would not be eligible to receive any future grants until it commits in writing to develop a Corrective Action Plan (CAP); and

Whereas, the Wabasha County Board of Commissioners desires to continue to receive grant funding from BWSR to support various programs that the County offers;

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners adopts the attached Corrective Action Plan to be implemented and followed immediately. Additionally, a copy of the CAP is to be provided to the Board of Water and Soil Resources in a timely fashion.

Resolution No.: 2013-026

Whereas, the Board of Commissioners exercised its statutory powers to create the position of County Coordinator pursuant to Minnesota Statute 375.48 in May of 2012; and

Whereas, on August 14, 2012, the Wabasha County Board of Commissioners appointed Bridget Hoffman to serve as the County Coordinator in accordance to Minnesota Statute 375.48 with a one (1) year probationary period; and

Whereas, the Board of Commissioners desires to follow the recommendations of the Wabasha County Government Study Committee and Springsted Consulting which recommends adopting the County Administrator form of government; and

Whereas; Minnesota Statute 375.48 states that a "county coordinator serves at the pleasure of the board and employment may be terminated by the board without notice;" and

Whereas; Minnesota Statute 375.50 states that the "board at any time may rescind the resolution establishing the office of county coordinator;" and

Whereas; Bridget Hoffman, the Wabasha County coordinator, is currently in her probationary period and is considered to be an at-will employee; and

Now, Therefore, Be it Resolved that the Wabasha Board of Commissioners immediately terminates the position of County Coordinator; and

Be It Further Resolved, that the Wabasha County Board of Commissioners rescinds any prior resolution which created or modified the office or duties of county coordinator;

Be It Further Resolved that any duties and responsibilities previously assigned to the county coordinator shall be vested in the officer or department which had responsibility for the function before the transfer of the function to the county coordinator.

Resolution No.: 2013-027

Whereas, the Wabasha County Board of Commissioners has determined, with the recommendation of the Government Study Committee and Springsted Inc., that the County Administrator form of governance found under Minnesota Statute 375A.06 is the most appropriate form of government for the County; and

Whereas, the goal of Wabasha County whenever it looks to hire an employee is to find the most qualified person for the position based on job related factors; and

Whereas, the Wabasha County Board has determined that it is necessary to create a committee to help find and recommend to the Board a qualified candidate(s) to become the County's next County Administrator; and

Now, Therefore, Be it Resolved that the Wabasha Board of Commissioners hereby appoints Commissioners _______________ and _________________ to head a seven (7) member committee to determine the appropriate process the County will utilize to hire a County Administrator. Those responsibilities will include, but are not limited to, recruiting, interviewing, and recommending to the County Board a suitable candidate for County Administrator; and

Be it Further Resolved, that the committee members will be selected by the two appointed commissioners but shall include at least two (2) department heads, one (1) member of the Wabasha County Government Study Commission, and two (2) other members that the commissioners' deem appropriate.

Resolution No.: 2013-028

Whereas, Minnesota Statutes 375.055 provides for the establishment of compensation for services rendered by County Commissioners in Minnesota; and

Whereas, Minnesota Statutes 375.055 provides that a change in County Commissioner's salary or per diems shall not be effective until January 1st of the next year; and

Whereas, Minnesota Statutes 375.055 provides that a change in County Commissioner's salary or per diems shall not change except in accordance with Minnesota Statutes 375.055; and

Now, Therefore, Be It Resolved that for the year of 2014 the salary and per diems for the Wabasha County Board of Commissioners be established at:

The same as 2012 salary. (Annual Salary (plus $500 for the Board Chair)

Be It Further Resolved, that publication of this action and resolution be printed in the official newspaper of the County as part of the proceedings of the meetings of the County Board, and in one other newspaper of the County, in a different municipality than the official newspaper.

SPRINGER - WOBBE

Resolution No.: 2013-029

Whereas, the Federal Highway Administration (FHWA) requires that states agree to design, construct, operate and maintain facilities constructed with federal transportation funds for the useful life of the improvement and not change the use of right of way acquired without prior approval from the FHWA: and

Whereas, Transportation enhancement projects receive federal funding and the Minnesota Department of Transportation has determined that for projects implemented with Safe Routes to School funds, the above requirement should be applied to the project sponsor, and

Therefore be it resolved by the Wabasha County Board of Commissioners that Wabasha County act as sponsoring agency for a Safe Routes to School Project within the City of Elgin and acknowledges herewith that it is willing to be the project sponsor knowing full well that such sponsorship includes a willingness to secure and guarantee the local share of costs associated with this project and responsibility for seeing this project through to its completion, with compliance of all applicable laws, rules and regulations.

Be it further resolved, that Wabasha County as the Project Sponsor hereby agrees to assume full responsibility for the design, construction, operation and maintenance of property and facilities related to the aforementioned transportation enhancement Safe Routes to School project
