Meeting of January 7, 2014

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, January 7, 2014 at 9:00 a.m.

 

Election of Board Chairperson and Vice Chairperson was held.

Motion by Harms to elect Wobbe as Chairperson, seconded by Roschen.

Motion by Wobbe to elect Springer as Chairperson, seconded by Hall.

Two votes for Wobbe.  Failed.  Three votes for Springer.  Adopted

 

Motion by Hall to elect Wobbe as Vice Chairperson, seconded by Springer.  Adopted Unanimously.

Whereas, the Wabasha County Board had previously authorized the Social Services Director to fill the Social Services Supervisor position, and

Whereas, the Social Services Director, the Public Health Director, and Assistant County Attorney  reviewed applications, interviewed applicants, and recommended Suzanne Kleindl as the applicant to offer this position to, and

Whereas, the Wabasha County Human Service Board authorized the Social Services Director to offer this position to Suzanne Kleindl;

Now Therefore be it Resolved by the Wabasha County Board that Suzanne Kleindl be hired as Social Services Supervisor at pay grade 7, step 3.  The work week for this position shall be 40 hours per week.

Resolution No.:  2014-003

Whereas, the historical workload for the Financial Assistance Supervisor and Child Support Supervisor has demonstrated that more than 37.5 hours per work week is needed to accomplish the necessary duties of these positions, and

Whereas, the general public would benefit from having access to these supervisors for an additional 2.5 hours per work week, and

Whereas, the Wabasha County Human Services Board has approved increasing the work week for these positions to 40 hours per week;

Now Therefore be it Resolved by the Wabasha County Board that the work week for the Financial Assistance Supervisor and Child Support Supervisor be increased from 37.5 to 40 hours per work week effective the Pay Period starting January 12, 2014.

Resolution No.:  2014-004

Whereas, the State of Minnesota Pollution Control agency has changed and added new rules and regulations to Individual Septic Treatment Systems; and

Whereas, counties in Minnesota are mandated to update their Individual Septic Treatment Systems ordinance to incorporate these changes and additions; and

Whereas, a Public Hearing is required to change any ordinance in Wabasha County;

Now Therefore be it Resolved, by the Wabasha County Board of Commissioners that; a Public Hearing be set for January 21, 2014 at 9:15 AM for the purpose of review of the changes to the Individual Septic Treatment Systems ordinance and to gather public input.

Resolution No.: 2014-005

Whereas, Paul and Monica Anderson, owners of parcel # R17.00266.03 located at 58343 Highway 63, Zumbro Falls, MN 55991-5089 has provided a written request to the Wabasha County Board of Commissioners regarding the local option abatement for property not qualifying for disaster credit as defined in MS 273.1233.

Whereas, the Wabasha County Assessor has determined that fifty percent or more of the home was destroyed by fire on October 4, 2013, and the home was not livable.

Now therefore be it resolved by the Wabasha County Board of Commissioners that, a reduction in the 2013 property tax is granted on parcel # R17.00266.03 based on the number of complete months the home is uninhabitable or unlivable.

Resolution No: 2014-006

Whereas, the Wabasha County Sheriff is requesting the appointment of Dr. Kent Jeffery as Medical Examiner for the calendar year of 2014 at a rate of $8,341.27 per year and Dr. Thomas Peyla as Deputy Medical Examiner at the rate of $666.86 per year.

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that:  Dr. Kent Jeffery be appointed as Medical Examiner and Dr. Thomas Peyla be appointed as Deputy Medical Examiner at the above indicated salary.

Resolution No: 2014-007

Whereas, the Wabasha County Sheriff's Office is requesting to purchase two (2) 2014 Dodge Durango's at a cost of $51,515.00 per attached quote #35446 from Dodge of Burnsville; and

Whereas, the money for the purchase of these vehicles will come out of Squad Replacement Funds and Capital Funds.

Whereas, the Sheriff also requests approval for the Auditor's Office to cut an Auditor's Warrant not to exceed the amount of $52,000.00 once the invoices are received.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized to purchase two (2) 2014 Dodge Durango's from Dodge of Burnsville of Burnsville, MN at a cost not to exceed $52,000.00.

Be it Further Resolved by the Wabasha County Board of Commissioners that funding of the purchase for these two (2) 2014 Dodge Durango's will come out of Squad Replacement Funds and Capital Funds.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor's Office is hereby authorized to cut an Auditor's Warrant not to exceed the amount of $52,000.00 to the respective vendor once invoices are received.

Whereas, the Wabasha County Sheriff's Office is requesting authorization to participate in the purchase of a Regional ARMER Shared Voice Logging System with 5 other Southeast Minnesota counties; and

Whereas, the total cost is estimated at $77,393.58 of which $45,000.00 is included in the 2014 E911 budget.  Therefore, the Sheriff's Office is requesting that the remaining balance of $32,393.58 come from capital funds.

Whereas, the Sheriff also requests approval for the Auditor's Office to cut an Auditor's Warrant not to exceed the amount of $77,500.00 once the invoices are received.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff's Office is authorized to participate in the purchase of a Regional ARMER Shared Voice Logging System.

Be it further Resolved by the Wabasha County Board of Commissioners that: the $45,000 amount be paid by 911 funds and the remaining $32,393.58 be paid from capital funds.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor's Office is hereby authorized to cut an Auditor's Warrant not to exceed the amount of $77,500.00 to the respective vendor(s) once invoices are received.

Resolution No.: 2014-009

Whereas, The Commissioner of Natural Resources of the State of Minnesota has made application under authority of M.S.A.Section 282.01, subd. 1 on behalf of the Department of Natural Resources, a state agency, for release of the following described land from the trust in favor of the taxing district:

Parcel Number:  R22.00144.00

Tax Description:  Section 09, Township 111, Range 012, 7.90 Acres, Ex Peter's Addition,  About 7.90 Ac     in SW1/4NW1/4

Whereas, it appears that there is need for such lands and the applicant desires to obtain such land for conservation purposes.

Whereas, Wabasha County is willing to transfer the land to the DNR for the fees associated with the transfer.  DNR has agreed to pay the fees for the deed and transfer costs.

Now, Therefore, Be It Resolved, that the Wabasha County Board of Commissioner's hereby approve the transfer of the above state land to the Commissioner of Natural Resources of the State of Minnesota, be granted and that the above described lands be and hereby are released from the trust in favor of the taxing district to the State of Minnesota, Department of Natural Resources.

Resolution No.:  2014-010

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2014 the payment for necessary express, freight, telephone, water, light, e-bay, expenses related to an emergency, justice center debt service payments and other utility charges to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.16.

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2014 the payment for necessary charges to be paid on the Warrant of the County Auditor/Treasurer to avoid finance charges, upon receipt of itemized bills.

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2014 the payment due to other governments and payroll deductions, to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.15.

Be It Resolved, that the Wabasha County Board of Commissioners hereby sets the mileage reimbursement rate for 2014 at the same level as the 2014 IRS mileage rate; and (Effective January 1, 2014 the rate at $.56 per mile.)

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the establishment and/or continuance of a Petty Cash Fund, pursuant to MS 375.162; and

Be It Further Resolved, That Sheriff Rodney Bartsh shall be custodian of said fund.  The amount of the fund shall not exceed $100.00.

Whereas, the County Auditor/Treasurer's Office currently maintains a checking account for the sole purpose of refunding over-payment of taxes,

Be It Resolved, the County Auditor/Treasurer is authorized to maintain a checking account for overpayment of taxes and also for refunds of miscellaneous over-payments or payments made in error as required by all Wabasha County Departments.

Whereas, it is in the best interest of Wabasha County to reduce administrative costs and increase departmental efficiency, and

Whereas, costs are increasing to mail refunds of overpayments and return documents not processed because of underpayments,

Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to retain overpayments in amounts not exceeding $2.00 for services of any kind.  Revenue from such overpayments shall be deposited in the General Revenue fund in a timely manner, and

Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to accept, at their discretion, underpayments of any kind with the deficit amount not exceeding $2.00 and to process the document or transaction regardless of the deficiency.

Be It Resolved, that the Wabasha County Board of Commissioners hereby sets the maximum reimbursable meal allowance, for 2014, at $8.00 for breakfast, $10.00 for lunch and $15.00 for dinner.

Be It Resolved, that any employee of Wabasha County who has funds to be deposited in a designated financial depository of Wabasha County, shall take said funds to the Office of the County Auditor/Treasurer for transfer to said depository.  No employee shall personally transfer or transport funds, except for the County Auditor/Treasurer or designee thereof.

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the County Auditor/Treasurer to cash checks not to exceed $2,000 to replenish the change fund.

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves payment of per diems for any Commissioner attending committees and board meetings assigned by the Board of Commissioners on the Committee and Board Assignment List, and other meetings assigned by the Board on a per meeting basis.

Whereas, the County Board  under Minnesota Statute may authorize the treasurer or chief financial officer to perform deposit and investment functions relating to public funds.

Now therefore be it resolved by the Wabasha County Board of Commissioners that the following appointments and actions are hereby directed and approved:

That the Wabasha County Board of Commissioners hereby grants to Debbie Koenig, Finance Director, the authority to designate depositories for the County of Wabasha as provided for in Minnesota Statute 118A.02 subd. 1.

That the Wabasha County Board of Commissioners hereby authorizes Denise Anderson, Auditor-Treasurer, or Debbie Koenig, Finance Director, to make investments of funds under sections 118A.01 to 118A.06 of Minnesota Statutes or other applicable law.

Resolution No.:  2014-011

Whereas, the Wabasha County Board of Commissioners has advertised to accept sealed bids for the Wabasha County legal newspaper for 2014; and

Whereas, the Wabasha County Board of Commissioners desires to open the sealed bids on Tuesday, January 7, 2014; and

Whereas, three bids were received; The Lake City Graphic, The Plainview News and The Wabasha County Herald;

and

Whereas, the Lake City Graphic is the apparent low bidder of $9.65 per standard advertising unit (SAU).

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby accepts the bid of the Lake City Graphic as the "legal County newspaper," to include publications of the Commissioners Proceedings, the Delinquent Tax List and other notices ordered by the County Board of Commissioners as required by law for the year 2014.

Now therefore be it further resolved by the Wabasha County Board of Commissioners hereby gives                                until January 31st, 2014 to issue the Wabasha County a $1,000 printers bond.

Resolution No.: 2014-013

Whereas, the Wabasha County Attorney position is currently classified as a part-time position, and;

Whereas, the present County Attorney already works as though the position were a full-time position, and;

Whereas, the possibility exists for the election of a County Attorney who will actually work just part-time while maintaining a private practice, necessitating the use and associated cost of an outside law firm when the inevitable conflict of interest occurs, and;

Whereas, the possibility exists for the election of a County Attorney who will actually work just part-time while maintaining a private practice, possibly requiring the hiring of another Assistant Attorney to carry the case load left by the part-time County Attorney, and;

Whereas, it is best business practice to have a Full-Time County Attorney to preclude these possible detrimental impacts on the County.

Whereas, Minnesota Statutes Section 388.21 states that the county board of any county in Minnesota by resolution may provide that the office of the county attorney shall be a full-time position and require that one elected to the office not engage in the private practice of law; and

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that effective January 1, 2015, the position of County Attorney become a full-time position prohibiting the attorney from engaging in the private practice of law.

Whereas, the Wabasha County Auditor and Treasurer positions is currently classified as 37.5 hour per week position; and

Whereas, it is in the best interests of the County to have the position classified as a 40 hour a week position as it could alleviate future staffing needs; and

Whereas, the current County Auditor/Treasurer already works as if the position were classified as a 40 hour a week position, and;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that effective January 1, 2015, the position of Wabasha County Auditor/Treasurer be considered by the County to be a 40 hour a week position

Resolution No.: 2014-015

Whereas, the Wabasha County Board of Commissioners is required by statute to set minimum salaries for elected officials up for election in that calendar year, and;

Whereas, the minimum salary set in 2010 were:

Commissioner: $17,324.68 plus $500 for Board Chair

Attorney: $55,000

Auditor/Treasurer: $38,500

Recorder: $38,500

Sheriff: $55,000

And Whereas, it is appropriate for these amount s to stay the same,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the minimum salaries for elected positions in 2014 are as follows:

Commissioner: $17,324.68 plus $500 for Board Chair

Attorney:  $55,000

Auditor/Treasurer:  $38,500

Resolution No.:  2014-016

Whereas,  On August 27th  the Wabasha County Historical Society requested the County to be a fiscal partner in a  Legacy Grant  for exterior rehabilitation of the Reads Landing School through the Minnesota Historical Society, and

Whereas, the County Board by consensus agreed to the request by the Wabasha County Historical Society, and

Whereas, the County has been notified that the Wabasha County Historical Society has been awarded the funding.

Now Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves the attached Fiscal Partnership Agreement with the Wabasha County Historical Society.

Resolution No.:  2014-018

Whereas, the County of Wabasha has designated First State Bank of Wabasha as a depository of its public funds pursuant to Minnesota Statues, Chapter 118A, and

Whereas, Commissioner Springer has been appointed board chair for 2014, and

Whereas, John Dahlstrom was appointed as the Social Services Director on November 5, 2013.

Now, therefore, be it resolved by the Wabasha County Board of Commissioners the following changes are approved to be made to the First State Bank authorizations:

Commissioner Springer is approved as an authorized signer on certain accounts at First State Bank of Wabasha per the attached list.

Richard H. Hall is removed as an authorized signer on the County accounts at First State Bank of Wabasha per the list approved January 8, 2013.

John Dahlstrom is approved as an authorized signer on the Social Welfare Fund account.

Be it further resolved, by the Wabasha County Board of Commissioners that the following employees and Board Chairman are given specific authority at First State Bank of Wabasha per the attached.  (See attachment)

Motion to open Labor Negotiations closed session.

Resolution:  2014-019

Whereas, Minn. Stat. §13D.01 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult with its attorney regarding the best course of action to take during the upcoming labor negotiations.

Whereas, the County Attorney has advised the Board that it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the opposing party

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel.

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session.

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be It Resolved a closed meeting of the County Board addressing the labor negotiation strategy will be held with the County Attorney and other County staff. No subject matter other than the foregoing shall be discussed at said meeting.

It was the consensus of the Board to call a Special Board Meeting for the purpose of hiring an interim county administrator after discussion with the county administrator hiring committee, filling the assistant county attorney position, and labor negotiation strategy.   Special meeting to be held January 14, 2014 at 9:00 a.m. in the Board Room.
