Meeting of November 3, 2015 


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, November 3, 2015 at 9:00 a.m.

The meeting was called to order by Board Chairman Wobbe.

The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe

Motion to approve the agenda after moving Item F after Item D, and moving Item G to the November 17 Board meeting.

Resolution No.: 2015-256

Whereas, Wabasha County has accepted the resignation of Nicole Moline, Fiscal Supervisor for Social Services, with regrets and well wishes in future endeavors, and;

Whereas, the Wabasha County Human Services Board has recognized the importance of keeping the Fiscal Supervisor position staffed in order to maintain normal operations for the Social Services Department, and;

Whereas, the Wabasha County Human Services Board has further recommended that the County arrange for the temporary appointment of an internal staff person to cover the primary duties of this position for the interim while a permanent replacement is sought;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the County Administrator is hereby authorized to make and arrange for a temporary appointment to cover the duties of the vacant Fiscal Supervisor position in the Social Services Department. The compensation, duration and nature of the temporary appointment shall be made at the discretion of the County Administrator in accordance with relevant county policy and agreements and in consultation with the Social Services Director.

Resolution No.: 2015-257

Whereas, the Laws of Minnesota for 2015, 1st Special Session, in Chapter 4, Article 3, Section 4, appropriated Local Water Management (LWM), Wetland Conservation Act (WCA), and Department of Natural Resources (DNR) Shoreland FY 2016 Natural Resources Block Grant (NRBG) funds to the Board of Water and Soil Resources (BWSR).

Whereas, the Minnesota Pollution Control Agency (MPCA) transferred to BWSR funds for their 2016 SSTS Programs to be allocated with the FY 2016 NRBG;

Whereas, Minnesota Statutes 103B.101, subd. 9 (1), and 103B.3369, subd. 5 authorize BWSR to award grants.

Whereas, Wabasha County, the Grantee, has met the criteria established by statute, BWSR, the DNR, and the MPCA and is eligible to receive NRBG grant funds.

Whereas, the Grantee has agreed to appropriate the required local match.

Whereas, the Grantee represents that it is duly qualified and agrees to perform all services described in this grant contract to the satisfaction of the State.

Whereas, as a condition of the grant, Grantee agrees to minimize administration costs.

Whereas, the (BWSR) has allocated funding for Fiscal Year 2016 & 2017 Natural Resources Block Grant (NRBG) allocation to Wabasha County with stipulations contained within the "Settlement Agreement" between BWSR signed in April of 2015.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that sign, signifying acceptance, of the FY 2016 & 2017 State of Minnesota Board Of Water and Soil Resources Natural Resources Block Grant.

Resolution No.: 2015-258

Whereas, Wabasha County has reviewed the pertinent data on bridges requiring replacement, rehabilitation, or removal; and

Whereas, Wabasha County has identified those bridges that are high priority and has previously established a list of those bridges that require replacement, rehabilitation, or removal; and

Whereas, the following additional bridge has been since identified as also requiring replacement, rehabilitation, or removal.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the following bridge is a high priority and Wabasha County intends to replace, rehabilitate, or remove this bridge as necessary when funds are available.

Be It Further Resolved that Wabasha County does hereby request authorization to replace, rehabilitate, or remove such bridge and authorizes the Wabasha County Engineer to request funds.

Resolution No.: 2015-259

Whereas, Wabasha County is dedicated to the maintenance and construction of a safe and efficient county road system while being responsive to the needs and values of the citizens of Wabasha County.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the attached Wabasha County Highway Department 2016 – 2025 Road and Bridge Improvement Plan is hereby approved.

SPRINGER - KEY

Resolution No.: 2015-260

Whereas, the Wabasha County Highway Department proposes to acquire property in addition to the existing right of way of County State Aid Highway 15 for the purpose of improvements under project SAP 079-615-007; and

Whereas, improvements under project SAP 079-615-007 are necessary in order to improve this segment of County State Aid Highway 15 to provide for public health, welfare, safety and convenience; and

Whereas, the property necessary to be acquired for improvements and existing right of way for project SAP 079-615-007 are described in the attached document "County Highway 15 Right of Way Descriptions" labeled as Description 1 and 2.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the County Highway Engineer is hereby authorized to proceed to acquire the property as described above in accordance with applicable laws and statutes.

Resolution No.: 2015–262

Whereas, Wabasha County has the desire to offer electronic collection options for tax payments, fees, services and miscellaneous collections.

Whereas, Value Payment Systems, LLC offers a service to allow for collections on line and at the counter.

Whereas, Wabasha County Auditor/Treasurer, Denise M Anderson has reviewed the corresponding contracts and would like to offer this service to the taxpayers/customers/clients of Wabasha County. There will be no charge to the County for this service.

Whereas, Wabasha County Attorney, Karrie Kelly has reviewed the corresponding contracts and finds no issues.

Whereas, Wabasha County Finance Officer, Deb Koenig has reviewed the corresponding contracts and recommends approval.

Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby authorizes Wabasha County Auditor/Treasurer, Denise M Anderson to sign the contract between Value Payment Systems, LLC, T-Tech Transaction Technologies, Worldpay US, Inc., The Schneider Corporation and Wabasha County. These contracts will be kept in Auditor/Treasurer's office.

SPRINGER - KEY

Resolution No.: 2015-261

Whereas, John Conlon requested a Conditional Use Permit for a short-term rental on property described as parcel R13.00369.00 located in Sec. 17& 20, T 111 North, R 11 West, Town of Pepin (70992 246th Ave., Lake City); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on October 26, 2015 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 3-0 recommends to the Wabasha County Board of Commissioners that the request be approved with four conditions.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for John Conlon with the conditions as follows:

1. A septic compliance inspection shall be completed for the property.

2. Renters shall be limited to a maximum of three vehicles.

3. The rental unit shall maintain compliance with Minnesota Department of Health regulations.

4. This conditional use permit is only valid for John Conlon and shall terminate upon the sale of the property to another individual.

Discussion of the Facilities Study was moved to the November 17 Board meeting.
