Wabasha County Board of Commissioners Meeting of January 19, 2016 The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, January 19, 2016 at 9:00 a.m. The meeting was called to order by Board Chairman Hall. The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe SPRINGER -- KEY Motion to approve the agenda after removing Item 10.0 L and moving Item B before Item A. Adopted Unanimously SPRINGER - GOIHL Motion to approve the consent agenda including the following: Minutes: January 5, 2016 Claims Meal Vouchers Donation of $1,843 from the Wabasha Combined Drive to Public Health Special Needs fund. Resolution No.: 2016-013 Whereas, the Wabasha County Sheriff’s Department requests an increase of staffing hours for the Jail Clerk; and Whereas, the increase of staffing hours from 24 to 29 hours per week is necessary for the Sheriff’s Department and Jail to adequately function in the daily operations of the department Whereas, the budget for the Sheriff’s Department and Jail allows the increase of staffing hours to 29 hours per week Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the change of Jail Clerk staffing hours from 24 to 29 hours per week. Resolution No.: 2016-014 Whereas, the County has purchased a copier to replace once considered to be obsolete; and Whereas, the copier being replaced has no market or book value, and Whereas, Metro Sales Inc. has agreed to dispose of the copier at no cost to the County. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Ricoh Copier 3035 (s/n #K9365602437) assigned tag #010480 is declared obsolete and authorizes the Finance Director to have Metro Sales Inc. dispose of the copier after removing all data from said copier. Resolution No: 2016-015 Whereas, a vacancy for a Full-Time Deputy Sheriff had been created per previous Resolution #2015-299; Whereas, the hiring process is complete and an applicant has been selected; Whereas, the Wabasha County Sheriff is requesting authorization to hire Ryan Speedling as a Full-Time Deputy Sheriff, effective January 24, 2016, at the Start pay rate per current Teamsters Union Contract. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Wabasha County Sheriff’s Office is hereby authorized to hire Ryan Speedling as a Full-Time Deputy Sheriff to fill the current vacancy, effective January 24, 2016. Be it further Resolved by the Wabasha County Board of Commissioners that: Ryan Speedling be hired at the Start pay rate per current Teamsters Union Contract. Resolution No.: 2016-016 Whereas, the current Administrative Specialist is currently working as the Human Resource Generalist since January 4, 2016, and Whereas, the County Administrator has identified the need for additional administrative support and services in the County, and Now Therefore be it Resolved by the Wabasha County Board of Commissioners to authorize the recruitment and hiring of an Administrative Specialist. Resolution No.: 2016-017 Whereas, at the December 28, 2015, meeting, the Wabasha County Board approved entering into a 3 year services agreement with Emergency Communications Network, LLC (ECN) for CodeRED; and Whereas, at the same meeting, the Wabasha County Board approved adding Weather Warning to the CodeRED system. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County agrees to sign the 3 year agreement and Weather Warning Addendum with Emergency Communications Network, LLC. Resolution No.: 2016-018 Whereas, there is currently a social worker vacancy in the Adult Services & Chemical Dependency Unit of the Social Services Department; and Whereas, the Social Services Director has recommended hiring a social worker to fill this vacancy in order to maintain normal operations for the department; and Whereas, the Wabasha County Personnel Committee has reviewed the Social Services Director's request to hire a social worker and supports his recommendation; Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Social Services Director is hereby authorized to hire a social worker to fill the vacancy created in the Adult Services & Chemical Dependency Unit of the Social Services Department. Resolution No.: 2016-019 Whereas, there is currently a social worker vacancy in the Home and Community Based Services Unit of the Social Services Department; and Whereas, the Social Services Director has recommended hiring a social worker to fill this vacancy in order to maintain normal operations for the department; and Whereas, the Wabasha County Personnel Committee has reviewed the Social Services Director's request to hire a social worker and supports his recommendation; Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Social Services Director is hereby authorized to hire a social worker to fill the vacancy created in the Home and Community Based Services Unit of the Social Services Department. Resolution No.: 2016-020 Whereas, there is currently a fiscal supervisor vacancy in the Social Services Department; and Whereas, the Social Services Director has recommended hiring a fiscal supervisor to fill this vacancy in order to maintain normal operations for the department; and Whereas, the Wabasha County Personnel Committee has reviewed the Social Services Director's request to hire a fiscal supervisor and supports his recommendation; Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Social Services Director is hereby authorized to hire a fiscal supervisor to fill the vacancy created in the Social Services Department. Resolution No.: 2016-021 Whereas, Public Health will have a vacancy effective February 26, 2016 due to the retirement of Kathy Brehmer, PHN, and Whereas, the Personnel Committee has approved recommending to the county board that this position be refilled by either an RN or PHN at 40 hours per week, with position to start at a step no higher than step 3 of the appropriate pay scale Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Public Health Director is authorized to advertise, interview, and offer employment to an RN or PHN for this position at a pay step no higher than step 3 of the appropriate pay grade. Human Resources will determine where a position starts on the prospective pay scale within that range. Start of employment will be after February 26, 2016. Resolution No.: 2016-022 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Plainview News is designated as its official newspaper for the year. Be it Further Resolved by the Wabasha County Board of Commissioners that, Wabasha County designates its Website as the official publication for advertisements for bids of transportation projects. Adopted Unanimously GOIHL - SPRINGER Resolution No.: 2016-023 Whereas, Connie A. Vaplon started working for Wabasha County on January 1st, 1966 as a Secretary at Wabasha County for Wabasha County Extension. Whereas, on December 30, 2015 Ms. Vaplon notified the County that she would retire from Wabasha County on February 26, 2016. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they accept Ms. Vaplon’s resignation with gratitude for her 50 years and two months of employment to Wabasha County. Adopted Unanimously Discussion – Springsted Bond Refunding. By consensus, the Board agreed to pursue potential bond refunding options. GOIHL - KEY Resolution No.: 2016-024 Be It Resolved, that the Wabasha County Board of Commissioners, hereby authorize the establishment of an Absentee Ballot Board, Mail Ballot Board and UOCAVA (Uniformed and Overseas Citizens Absentee Voting Act) Ballot Board under Chapter 203B.121, Subd 1 and 203B.23 of2011 Minnesota Statutes, pertaining to Ballot Boards, and Be It Resolved , that these Boards will meet on an as needed basis when called by a Wabasha County Auditor/Treasurer during the 45 calendar days prior to each election, and Be It Resolved, that a minimum of any two people from different major parties can constitute a quorum for a meeting and Be It Resolved, that this board will Accept or Reject absentee ballots and process ballots throughout the Absentee voting period, and Be It Resolved that this board will follow all statutory requirements enacted by the Minnesota Legislature and count the absentee ballots after the polls close rather than deliver absentee ballots to the polling sites. Therefore, the Wabasha County Board of Commissioners approves the establishment of an Absentee Ballot Board, Mail Ballot Board and UOCAVA Ballot Board and appoints the following election officials on that board for 2016: Denise M Anderson, Francie Warren, Audry Plote, Christine Getschmann, Jane Roemer. Adopted Unanimously WOBBE - SPRINGER Resolution No.: 2016-025 Whereas, the County purchases motor vehicles to support it operations and for the use of employees to transact County business, and Whereas, the vehicles are titled in the name of Wabasha County, and Whereas, at times vehicles are sold upon the approval of the Wabasha County Board of Commissioners per County Policy and in compliance with State Statute and regulations, and Whereas, a authorized County employee signature is required on the Certificate of Title to a Motor Vehicle at the time of sale, and Whereas, it is necessary to provide certain employees with the authority to sign the Certificate to a Motor Vehicle at time of sale. Now Therefore be it Resolved by the Wabasha County Board of Commissioners the following employees are authorized to sign the Certificate of Title to a Motor Vehicle for the transfer of title:
Adopted Unanimously KEY - SPRINGER Resolution No: 2016–026 Whereas, the County Board of Commissioners of the County of Wabasha, State of Minnesota, desires to offer for sale to the public, parcels of land that has forfeited to the State of Minnesota for non-payment of property taxes and listed on attached Tax Forfeited Land List 2015a; and Whereas, the County Board of Commissioners must determine the appraised value of the forfeited property to be sold. The sale price cannot be less than the appraised value. Now, therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the appraised value on the Tax Forfeited Land List 2015a. Adopted Unanimously SPRINGER - WOBBE Resolution No: 2016-027 Whereas, a parcel of land have forfeited to the State of Minnesota for non-payment of taxes; and Whereas, the Wabasha County Board of Commissioners desires to sell these parcels at a public auction. Be it Resolved by the Wabasha County Board of Commissioners that: the parcel of tax forfeited land listed on Tax Forfeited Land List 2015a be classified as non-conservation land; that the basic sale price of each parcel on the Tax Forfeited Land List 2015a be approved and authorization for a public sale be granted; pursuant to M.S. 282.01; that the sale will be held at 9:00 a.m., Wednesday, February 24, 2016 by the Wabasha County Auditor/Treasurer in the Commissioner’s Room of the Wabasha County Courthouse, for not less than the basic sale price; and that the sale be cash/money order/check only; that the County Auditor/Treasurer is hereby directed to publish a notice of sale as provided by law. Be it Further Resolved that the conditions and terms of the public sale shall be as described in the list contained here-in and approved by the Wabasha County Board of Commissioners. Adopted Unanimously GOIHL – SPRINGER Resolution No.: 2016-028 Whereas, Wabasha County uses Agency Collection System, a software package supported by Trimin Systems, Inc., Whereas, that software is covered by a written support agreement, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the support agreement is hereby accepted for the ACS software only, and annual billing. Adopted Unanimously GOIHL - KEY Resolution No.: 2016-029 Whereas, Wabasha County uses cryptographic (SSL) certificates to authenticate and secure some electronic communications, Whereas, Wabasha County needs to name a delegate who is authorized to act as agent to obtain and use these certificates, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Kyle Jerviss, Wabasha County IT Director, is hereby authorized to represent Wabasha county in matters concerning cryptographic certificates, to sign documents and act on behalf of Wabasha County relating to the application for, use of and revocation of cryptographic certificates, Further, be it Resolved, this authorization is effective immediately, and will continue until January 31st, 2018. Adopted Unanimously GOIHL – KEY Resolution No.: 2016-030 Whereas, PCi Roads LLC. is the lowest responsible bidder for SAP 079-601-029, SAP 079-607-023, and CP 079-086-006. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to PCi Roads LLC. for SAP 079-601-029, SAP 079-607-023, and CP 079-086-006 in the amount of $545,413.68 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with PCi Roads LLC. for this work. Adopted Unanimously SPRINGER - Resolution No.: 2016-031 Whereas, Wabasha County previously constructed SAP 079-663-001 under Minnesota Rules for State Aid Operation 8820.9936 traffic lane and parking lane width requirements; and Whereas, parking was banned in designated areas by City of Minneiska resolution at the time of plan approval consideration; and Whereas, the reason for this variance request is constructed traffic and parking lane widths do not allow for parking under 8820.9936, and the City of Minneiska has now determined the necessity for parking in a segment of the area previously designated with a parking ban; and Whereas, this Resolution is valid only after the attached Indemnification and Hold Harmless Agreement is fully executed by the City of Minneiska and shall otherwise be void. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County does hereby request a variance from the Minnesota Department of Transportation State Aid Operations Rules Chapter 8820.9936 Minimum Design Standards, Urban; New or Reconstruction Projects to allow for a reduced traffic lane width in lieu of 11’ traffic lanes. Be It Further Resolved by the Wabasha County Board of Commissioners that, Wabasha County hereby indemnifies, saves and hold harmless the State of Minnesota, and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of reducing traffic lane widths from those in Minnesota Rules 8820.9936 and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting this variance. Be It Further Resolved by the Wabasha County Board of Commissioners that, upon execution of the attached Indemnification and Hold Harmless Agreement by the City of Minneiska, the Chair of Board and County Administrator are hereby authorized to execute the attached Indemnification and Hold Harmless Agreement. Be It Further Resolved by the Wabasha County Board of Commissioners that, the proposed parking lane be on the northeast side of County State Aid Highway 63. Failed for Lack of Second SPRINGER - GOIHL Resolution No.: 2016-032 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one Towmaster T50T Tilt Trailer from Ziegler Inc. Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 044 – Trail Eze trailer as Excess Equipment and authorizes the County Engineer to dispose as a trade-in allowance. Adopted Unanimously Resolution No.: 2016-033 Whereas, Chapter 18 Minn. Stats. has been adopted for the purpose of protecting the residents of the state from the injurious effects of noxious weeds on public health, the environment, public roads, crops, livestock, and other property; and Whereas, A county must either appoint at least one county agricultural inspector or a county-designated employee to carry out the duties specified under Chapter 18 Minn. Stats.; and Whereas, The Wabasha SWCD implements a noxious weed removal program for the residents of Wabasha County and currently has staff proficient in the identification and removal of noxious weeds. Now Therefore Be It Resolved, the Wabasha County Board of Commissioners appoints Jennifer Wahls of the Wabasha SWCD as the county-designated employee to carry out the duties specified under Chapter 18.81 Minn. Stats. Be It Further Resolved, Any funds allocated by Wabasha County for the Noxious Weed Program will be provided to the Wabasha SWCD Office for the administration of the program and if either party wishes to terminate this agreement that they shall provide notice to the other party at least thirty days in advance. Removed from the Agenda Discussion – Honeywell Facilities Study. The Board directed staff to work with Honeywell to develop a letter of intent. Commissioners reported on meetings they attended.
