The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, October 4, 2016 at 9:00 a.m.The meeting was called to order by Board Chairman Hall.

Resolution No.: 2016-227

Whereas, the calendar year 2015 Flexible Spending Plans have a positive balance in the amount of $156.09; and

Whereas, the General Revenue Fund absorbs all overages, shortages and administrative costs for the Flexible Spending Plans,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

the overage be credited to the General Revenue Fund for the calendar year 2015 Flexible Spending Plans.

Resolution Authorizing Execution of the

2016 Wabasha County All-Hazard Emergency Operations Plan

Whereas, Wabasha County Emergency Management develops and maintains a county-wide All-Hazard Emergency Operations Plan (EOP) that must and does contain at least 18 Superfund Amendments and Reauthorization Act of 1986 (SARA) Title III items listed in the Local Emergency Operations Plan Crosswalk;

Whereas, said EOP is updated then reviewed yearly by a 4-year-cycle review process developed by the Minnesota Division of Homeland Security & Emergency Management;

Whereas, by executing the EOP, the Wabasha County Board of Commissioners approves of its use as a tool with which to refer to when officials respond to all types of hazards within Wabasha County;

Be It Resolved, which the Wabasha County Board of Commissioners hereby authorizes implementation of the 2016 Wabasha County All-Hazard Emergency Operations Plan (EOP) with its revisions and updates by signing the EOP Certification of Plan Approval page.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for improvements on County Highway 73 under CP 079-073-002 and 079-073-003.

Resolution No.: 2016-230

Whereas, SAP 079-609-012 and 079-615-009 with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed. 

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Mattison ContractorsInc. for completion of Project SAP 079-609-012 and 079-615-009 in the amount of $5251.90

Highway: Highway Projects Proposed Prioritization

CJC Generator Repair

Whereas, Recently it was discovered that the “Panelview Touchscreen” on the emergency generator at the CJC was damaged and no longer operable; and

Whereas, Without the referenced screen the generator is only able to be turned on manually and does not kick in immediately upon a loss of power; and

Whereas, Due to the immediate energy needs of the jail should the power go out it is recommended to fix the repair immediately and seek potential reimbursement through insurance

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the County Administrator or his designee is authorized to make any repairs necessary to bring the Criminal Justice Center generator up to a fully functioning status.  The cost of the repair is estimated to be $20,150 but additional costs are authorized if necessary.

Resolution No.: 2016-232

Fair Labor Standards Act Compliance Changes

Whereas, in May of 2016, the Department of Labor (DOL) announced a rule update to the Fair Labor Standard’s Act (FLSA) exemption of executive, administrative, and professional employees from the minimum wage and overtime pay requirements; and

Whereas, the referenced rule impacts the following positions: Social Service Fiscal Supervisor, Assistant Veteran’s Service Officer, Finance Assistant, and Emergency Management Director. ; and

Whereas, based on an independent review, those positions, with the exception of the Social Services Fiscal Supervisor, should be considered nonexempt.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the County Administrator or his designee is authorized to make any changes they deem necessary to ensure compliance with the FLSA rule change(s).

Labor Negotiation Strategy

Whereas, Minn. Stat. §13D.01 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult with its attorney regarding the best course of action to take during the upcoming labor negotiations;

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the opposing party;

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel;

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that a closed meeting of the County Board addressing the labor negotiation strategy will be held with the County Attorney and other County staff. No subject matter other than the foregoing shall be discussed at said meeting.
