Meeting of December 2, 2008
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, December 2, 2008 at 9:00 a.m.
The meeting was called to order by Board Chairman Riester.
The following Commissioners were present: Windhorst, McNallan, Riester and Springer.
Commissioner Dwelle was absent.
McNALLAN - SPRINGER
Motion to approve the agenda.

Commissioners reported on meetings they had attended. There was no public comment during the public forum. Recessed for the Regional Rail Authority meeting.

Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: November 25, 2008 Accept Donations: $100 from Burkhardt-Roemer VFW to Substance Abuse Court

Resolution No.: 2008-249
Whereas, Project S.A.P. 079-659-007 – Bituminous Reclamation, Bituminous Surfacing, and Concrete Curb and Gutter on CSAH No. 59, from the Jct. of TH 61 and CSAH 59 to the Jct. of TH 60 and CSAH 59 - with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Dunn Blacktop Company in the amount of $34,565.08.

Resolution Number: 2008-250
Whereas, the new SELCO/Wabasha County contract outlines that the Wabasha County Commissioners are responsible for appointing a Director who may be selected from among the county’s locally designated directors, or may appoint a director representing the County.
Whereas, the Wabasha County Board of Commissioners has chosen County Administrator David Johnson to be the SELCO representative for the County.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they appoint a SELCO director to represent Wabasha County.

Resolution No: 2008-251
Whereas, The Wabasha County Sheriff Office previously contracted with Elert & Associates to conduct an Interoperability Study regarding communications needs in Wabasha County, pursuant to Resolution 2008-020, and
Whereas, the cost of said study was $40,0000, and
Whereas, funds exist to offset this cost through the Olmsted County Sheriff’s Office, Department of Homeland Security office, via a federal grant, and
Whereas, in order to receive those funds, in the amount of $25,000, Wabasha County must enter into and abide by an agreement with the Olmsted County Sheriff’s Office Department of Homeland Security Office,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Radio Interoperability Study Service Agreement between the County of Olmsted, through its Sheriff’s Office, Department of Homeland Security (OSCO) and the County of Wabasha (Contractor) is hereby approved and the Chairman of the County Board is hereby authorized to sign it.

Consideration of changing all remaining non-bargaining unit positions from 37.5 to 40 hours per week and adopting a pay grid system based upon comparative worth points.
Whereas, the Wabasha County Board of Commissioners recognizes the importance of providing effective services to the residents of Wabasha County; and
Whereas, the County presently has some non-bargaining unit positions that work 37.5 hours per week and others that work 40 hours per week; and
Whereas, on 10/7/2003 the Board approved adoption of the current Wabasha County Comparable Worth Job Points without adopting a corresponding pay grid system; and
Whereas, in the past, it is recognized that pay grids have not been established systematically; and
Whereas, it is recognized that some existing pay grids have not kept pace with comparable counties, while others have surpassed the majority of comparable counties.
Now, Therefore, Be It Resolved, that the Wabasha County Board of Commissioners hereby approves changing all remaining non-bargaining positions from 37.5 hours per week to 40 hours per week, and approves adoption of the proposed pay grid system based upon comparative worth points.

Resolution 2008-252
Whereas, the Highway Department, Court House and Social Services union employees will be receiving a 2.75% Cost of Living Adjustment for 2009; and
Whereas, the Wabasha County Board of Commissioners recognizes the value of consistent Cost of Living Adjustments for all employees to maintain pay equity; and
Whereas, the County Administrator recommends the same 2.75% COLA for all non-union employees; and
Whereas, Wabasha County has budgeted 2.75% for the 2009 COLA
Now, Therefore, Be It Resolved, that the Wabasha County Board of Commissioners hereby approves a 2.75% Cost of Living Adjustment for all non-union employees of Wabasha County.

Resolution 2008-253 moved to the next Board meeting.
Resolution 2008-253
Whereas, Minnesota State Statute 375.055 sets the procedure for setting the salary of County Commissioners;
Whereas, Wabasha County employees received a 2.75% cost of living adjustment in 2008, while the Commissioners received a 1.17% cost of living adjustment for 2008; and
Whereas, the County has budgeted 2.75% for cost of living adjustments for non-bargaining and bargaining unit employees in 2009; and
Whereas, the Wabasha County Board of Commissioners desires to keep the wage at a level that would continue to attract qualified candidates for the position of Commissioner; and
Now, Therefore, Be It Resolved by the Wabasha County Board of Commissioners that for 2009, based upon the recommendation of the County Administrator, the salary of the Commissioners be increased by the same percentage as County employees. The salary of Commissioners to be adjusted as follows:
  • 2008 Commissioner Salary: $17,324.68
  • Adjustment: $476.42
  • 2009 Commissioner Salary: $17,801.10
The Board Chairperson shall continue to receive an additional $500 per year while holding that position.

Resolution Number: 2008-254
Sign and Approve Amended Joint Powers Agreement- Lake Zumbro/Olmsted County
Whereas, a Joint Powers Agreement currently exists between Wabasha and Olmsted Counties. And
Whereas, there is a need to amend this agreement to facilitate dredging operations within the Lake to retain Lake quality.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they approve the amended Joint Powers Agreement.

Resolution No.: 2008-255
Whereas, The Minnesota Pollution Control Agency is required by Minn. Stat. 115A.96 to establish a statewide program to manage Household Hazardous Wastes (HHW). The term “State” is used to identify the entity responsible for managing the statewide HHW program throughout the contract. And
Whereas, Minn. Stat. 115A.96, subdivision 3, provides that the statewide program may be provided directly by the State or by contract with public or private entities. And
Whereas, The Sponsoring Organization has established a contract with the State. The Co-Sponsoring Organization wishes to participate in the statewide HHW program in order to further the goals of protecting the environment and the public health as articulated in the Waste Management Act and the Co-Sponsoring Organization’s Solid Waste Management Plan. And
Whereas, A management Facility will accept HHW and may also accept Very Small Quantity Generator wastes and Other Program Wastes in accordance with the terms set forth in this Contract. And
Whereas, The parties wish to allocate the duties, risks and responsibilities resulting from the operation of the Local and Regional Programs. And
Whereas, Staff from Olmsted County and Wabasha County has reviewed this HHW Contract and do not foresee any problems in its content. Also, the County Attorney’s for both Counties have reviewed this Agreement, and have approved it as to form and content.
Now, Therefore, Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the contract for operation of a Household Hazardous Waste Management Program. And further direct the Wabasha County Board of Commissioners hereby direct the Chair of the Wabasha County Board of Commissioners to sign two copies of said contract on behalf of the County of Wabasha.
