Meeting of August 4, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, August 4, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
Motion to approve the agenda as amended. Item M (Removal of Hammond Tower) was removed, to be brought back at the next meeting.

Commissioners reported on meetings they had attended. Administrator’s Update: MCIT Dividend $Property/Casualty-$53,908; Worker’s Comp-$36,891 Township Officers Meeting – Millville American Legion, August 11, 7:30 p.m. Schedule for Dispatch/Jail Hiring Regional Rail - Lisa Brent McNallan came before the Board concerning County Roads.
Recessed for Regional Rail Authority meeting at 9:20 a.m.

Resolution No.: 2009-143
Whereas, the Wabasha County Board of Commissioners deems it in the best interest of the safety and welfare of its citizens to adopt an ordinance regulating placement of structures adjacent to the right-of-way of highways.
Be it resolved by the Wabasha County Board of Commissioners that the proposed Setback Distance of Structures from the Right-of-Way of Highways Ordinance is hereby adopted and enacted.
Tabled to August 18 Board Meeting
The County Road tour is set for August 18.
University of Minnesota Extension came before the Board. LuAnn Hiniker thanked the Board for their continued support. She explained to the Board why Extension is important to Wabasha County.
Resolution No.: 2009-145
Whereas, Wabasha County Board of Commissioners must appoint a representative to tourism for the County, and
Whereas, Chris Fancher has the appropriate experience to represent Wabasha County, and
Whereas, he has agreed to serve in the position of Tourism Representative for Southern Minnesota Tourism,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Board appoints Chris Fancher as the Wabasha County Representative to Southern Minnesota Tourism.

Resolution No.: 2009-146
Whereas, the calendar year 2008 Flexible Spending Plan has a positive balance in the amount of $1875.38; and
Whereas, the General Revenue fund absorbs all overages, shortages and administrative costs for the Flexible Spending Plans,
Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves the overage to be credited to the General Revenue Fund for the calendar year 2008 Flexible Spending Plan.

Resolution No. 2009-147
Whereas, the Planning Commission held a public hearing on July 27, 2009 and reviewed the Conditional Use Permit Application by Robert Nihart, 8082 Garfield, Spring Lake Park MN 55432. The permit is for an after the fact Conditional Use for a Lodging Establishment under Article 12, Section 3, Subd. 3 and Article 13, Sec 11. The request involves the following described property: 70555 202nd Avenue, Reads Landing, MN 55968 Lot 009, Block 028 and Lot 10 BLK 28 and in the (RLWS) (Reads Landing) Section 24, T.111 N. – R.11W (Pepin Township)
Whereas, the Planning Commission approve the request 4-0 and recommends approval from the County Board with the following conditions. None
Now therefore be it Resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions.

Resolution No.: 2009-149
Whereas, with the completion of the Criminal Justice Center the County will reorganize office space to more efficiently and effectively serve the Citizens of Wabasha County, and,
Whereas, Wabasha County will move its Public Health Department from its current location to the County Services Building and divest itself of the Public Health Property,
Whereas, Wabasha County is subject to all provisions of the Americans With Disabilities Act
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County proceed with planning, design and bidding to bring the Courthouse/Annex into compliance with the ADA, including installation of an elevator and handicapped accessible restrooms in the Courthouse.

Resolution No.: 2009-150
Whereas, the County of Wabasha and Local 320 are parties to a collective bargaining agreement negotiated pursuant to the Public Employment Labor Relations Act; and
Whereas, it is necessary to set a wage for the new positions of shift sergeant and program coordinator in the jail and the County and Union have agreed to a preliminary wage, pending Board approval, with the shift sergeant being paid 10 percent more than a jailer and the program coordinator the same wage as a jailer; and
Whereas, no language presently exists to address the promotion of jailers to shift sergeants or the demotion of shift sergeant to jailer, the County and Union have agreed to the following language, pending Board approval: 1. When a jailer is promoted to Shift Sergeant their pay shall be at the same step as received at the time of promotion. Thus, a jailer at the 5th step would remain at the 5th step in the Shift Sergeant pay scale. 2. Conversely, a Shift Sergeant demoted to jailer shall remain at their same pay step in the jailer pay scale.
Whereas, the dispatch and jail employees are desirous of retaining 12-hour shifts and have agreed that anyone hired into the jailer, shift sergeant and program coordinator after approval of this MOU shall not have the ability to place compensatory hours in a comp bank but must be paid out for those hours. Jailers shall be compensated for built-in overtime due to scheduling at straight time.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the agreed upon language be approved through Memorandums of Understanding for the duration of the existing labor contract.
