Meeting of May 5, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, May 5, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Commissioners reported on meetings they had attended. Adminstrator’s Update: Meeting with CAM and KKE – completion and moving discussion. There was no public comment during the public forum. Recessed to Regional Rail Authority meeting at 9:04 a.m. Reconvened at 9:06 a.m.

Chairman Windhorst called a Public Hearing to order for Increasing County Alcohol Licensing Fees. There was no public comment during the public hearing. Commissioner Dwelle made a motion to close the public hearing, seconded by Commissioner Norman.

Whereas, The Wabasha County Board of Commissioners desires to increase the County’s Alcohol Licenses, and
Whereas, The Wabasha County Board of Commissioners held a Public Hearing per M.S. 340A.408, subd. 3a on May 5, 2009 at 9:15 a.m. at its regular Board of Commissioners Meeting to discuss a proposed increase to the County Alcohol Licenses
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the increases to the County Alcohol Licenses as shown; On-Sale Liquor from $1,200 to $1,500, On-Sale Sunday Liquor from $50 to $150, Off-Sale 3.2 Malt Liquor from $20 to $50, On-Sale Wine form $24 to $200 and set the Temporary 3.2 Malt Liquor at $20.

Bob Goede from MCIT came before the Board to give his annual report. Wabasha County joined MCIT in 1980.

Resolution No.: 2009-086
Whereas, the County Board of Commissioners of the County of Wabasha, State of Minnesota, desires to offer for sale to the public, a parcel of land that has forfeited to the State of Minnesota for non-payment of property taxes listed below; and
Whereas, the County Board of Commissions must determine the appraised value of the forfeited property to be sold. The sale price cannot be less than the appraised value.
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the appraised value of the forfeited property, parcel number 06.00324.00, Lot 1 Block 1 Huckleberry Subdivision, be set at $60,000.00

Resolution No.: 2009-087
Whereas, the County Board of Commissioners of the County of Wabasha, State of Minnesota, desires to offer for sale to the public, a parcel of land that has forfeited to the State of Minnesota for non-payment of property taxes listed below; and Sec. Twn. Range Appraised Value or Lot or Block 06.00324.00 Highland Township 1 1 $60,000.00 Huckleberry Hill subdivision
Whereas, Said parcel of land has been viewed by one of the County Board of Commissioners of Wabasha County and the County Assessor, and has been classified as non-conservation land as provided for in Minnesota Statutes 282.01. Now, Therefore Be It Resolved That the Wabasha County Board of Commissioners hereby certify that this parcel of land on the attached list has been viewed and comply with the provisions of Minnesota Statutes 85.012, 92.461, 282.01 Subd. 08 and 282.018 and other statutes that require the withholding of tax forfeited lands from sale.
Be It Further Resolved, That the Wabasha County Board of Commissioners here by requests the approval of the Minnesota Department of Natural Resources for the sale of said land.

Whereas, the Zumbrowatha Trails Snowmobile Clubs of Wabasha County request that Wabasha County be their local sponsoring unit of government for pass-through of MN DNR snowmobile trail system funding,
Now therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County act as the sponsor for an application for funding to the State of Minnesota Department of Natural Resources for development of maintenance of snowmobile trails managed by the clubs of Zumbrowatha Trails-Wabasha County for the 2009-2010 snow season,
Be it further resolved: that upon approval of its application by the state, that Wabasha County may enter into an agreement with the State of Minnesota for the above referenced project and that it will act as the pass-thru for funds to the clubs as outlined in the Assistance Program manual,
Be it further Resolved: that the County Auditor and/or Deputy Auditor is hereby authorized to serve as the fiscal agent for the above referenced project,
Be it further resolved: that Marvin Howatt is appointed to be a County Trail coordinator to work with the county clubs and assist the county in administering this program.

Resolution No.: 2009-089
Whereas the State of Minnesota DNR along with Wabasha County has approved the Zumbrowatha Trails Association of Wabasha County’s request for the County to act as the sponsoring unit of government for pass-through of funds to the snowmobile clubs for the 2009-2010-snow year as outlined in the Assistance Program Manual. Therefore, be it resolved that the Wabasha County Commissioners enter into a County-Club contract with each of the five snowmobile clubs within the Zumbrowatha Trails Association to administer their club’s portion of the trail system for the 2009-2010 snow year according to the regulations outlined in the attached contract. The five snowmobile clubs consist of the Zumbro Valley, Wabasha Driftskippers, Cliff & Coulee Climbers, Elba Snowbirds and the Four Seasons.

Whereas, the Wabasha County Highway Department finds it beneficial to purchase one 2009 Sterling Tandem Truck and snow removal equipment, and
Whereas, with the purchase of one 2009 Sterling Tandem Truck and snow removal equipment, Unit 951 – Ford Tandem Truck and associated snow removal equipment is considered excess.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one 2009 Sterling Tandem Truck from Boyer Trucks, Inc in an amount of $52,900 which includes trade-in of Unit 951 – Ford Tandem Truck, and snow removal equipment from Towmaster, Inc. in an amount of $77,426.57, and hereby authorizes the County Auditor/Treasurer to issue warrants for applicable sales tax and license fees of the truck.
Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 951 – Ford Tandem Truck and associated snow removal equipment as Excess Equipment and authorizes the County Engineer to dispose as a trade-in allowance.

Resolution No.: 2009-091
Whereas, AAA Striping Service Company had the lowest bid for Project C.P. 79-09-7060 – Furnish and Apply Traffic Paint to Roads in Wabasha County.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of AAA Striping Service Company on Contract No. 09006 for Project C.P. 79-09-7060 – Furnish and Apply Traffic Paint to Roads in Wabasha County - in the amount of $55,269.40 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with AAA Striping Service Company for this work.

Whereas, Roberson Lime & Rock, Inc. had the lowest bid for the 2009 Crushed Rock Project.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Roberson Lime & Rock, Inc. on Contract No. 09007 for the 2009 Crushed Rock Project – CP 79-09-7050 in the amount of $145,081.44 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Roberson Lime & Rock, Inc. for this work.

Resolution Number: 2009-093
Whereas, the Planning Commission held a public hearing on April 27, 2009 and reviewed the Conditional Use Permit Application for Dave and Dawn Finley, 69095 County Road 32, Lake City MN 55041 to allow the placement of a commercial business (Hair Salon) in their home as regulated under Article 9, Sect. 3, Subd. 17, of the Wabasha County Zoning Ordinance. The conditional use involves the following property. 3.34 AC LYING SWLY C/L CO RD 32 IN SW COR SE1/4SW1/4 DOC # 270743 (S) Parcel # 08.00157.03 Section 25 T111N R12E (Lake)
Whereas, the Planning Commission approve the request 5-0 and recommends approval from the County Board.
Now therefore be it Resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions: Applicant must work with Public Health to insure proper holding tank for a Salon.

Resolution Number: 2009-094
Whereas, the Planning Commission held a public hearing on April 27, 2009 and reviewed the Conditional Use Permit Application for Joe Fredrickson (Oak Center Properties LLC), 36026 660 Street, Lake City MN 55041, to allow a conditional use permit to expand a commercial storage area as regulated under Article 9, Section 3, Subd. 17 of the Wabasha County Zoning Ordinance. The conditional use involves the following property. 13.07-acre parcel in SW corner of E1/2SE1/4 as desc in B166, P19 Parcel # 03.00079.03 Sec 8 T110N R13W (Gillford)
Whereas, the Planning Commission approve the request 5-0 and recommends approval from the County Board.
Now therefore be it Resolved that the Wabasha County Board of Commissioners approves the Conditional Use request.

Resolution Number: 2009-095
Whereas, the Planning Commission held a public hearing on April 27, 2009 and reviewed the Conditional Use Permit Application for Matthew Jay Gordon, 19770 699 Street, Wabasha MN 55981, is for a Conditional Use Permit to allow the placement of a commercial business in his home as regulated under Article 11, Sect. 3, Subd. 18, of the Wabasha County Zoning Ordinance. The conditional use involves the following property. Reads Landing-Morse Lot –001 Block 004 and lots 2,3,4,5,6,7,8,9 and 10 ex hwy Parcel # 13.00351.00 Section 30 T111N R11E (Pepin)
Whereas, the Planning Commission approve the request 5-0 and recommends approval from the County Board.
Now therefore be it Resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions: Signage approved for two 4x4 signs (24 square feet) and setbacks as regulated by State DOT.

Resolution Number: 2009-096
Whereas, the Planning Commission held a public hearing on April 27, 2009 and reviewed the Conditional Use Application by Zumbro Properties LLC (Grampa Ed’s), 5020 Highway 52 N, Rochester MN 55901, to allow a Community Retail business on property located at 40240 County Road 90, Mazeppa MN 55956, as regulated under Article 20, Sec. 1, Subd. 4, and Article 12, Sect. 3, Subd. 6, and Article 13, regarding the reestablishment of an expired grandfathered business in the shoreland district as addressed in the Wabasha County Zoning Ordinance. The conditional use involves the following property. Lot 8 Block 1 & LOTS 9, 10, 11, 12, & 13 BLK 1 ST GEORGE'S 2ND Parcel # 09.00435.00 Sec 34 T109N R14W (Mazeppa)
Whereas, the Planning Commission approve the request 5-0 and recommends approval from the County Board.
Now therefore be it Resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions: Applicant must work with the DNR directive to manage shoreland to mitigate erosion and sedimentation into the lake.

Resolution No.: 2009-097
Whereas, the Wabasha County Board of Commissioners has approved an appropriation in the amount of $1,500 in the 2009 Budget to be paid to the Semcac Senior Nutrition Program, and
Whereas, Semcac is requesting this amount be paid to the Senior Nutrition Program. Now, therefore, be it resolved, that the Wabasha County Board of Commissioners authorizes the payment of $1,500.00 to the Semcac Senior Nutrition Program.

Resolution No.: 2009-098
Whereas, the Wabasha County Board of Commissioners has approved an appropriation in the amount of $2,500.00 in the 2009 Budget to be paid to the to the Southern Minnesota Initiative Foundation, and
Whereas, the Southern Minnesota Initiative Foundation is requesting this amount be paid to the organization. Now, therefore, be it resolved, that the Wabasha County Board of Commissioners authorizes the payment of $2,500.00 to the Southern Minnesota Initiative Foundation.

Whereas, the Wabasha County Board of Commissioners has approved an appropriation in the amount of $21,012.00 in the 2009 Budget to be paid to the Wabasha County Agricultural Fair Association, and
Whereas, the Wabasha County Agricultural Fair Association is requesting this amount be paid to the organization. Now, therefore, be it resolved, that the Wabasha County Board of Commissioners authorizes the payment of $21,012.00 to the Wabasha County Agricultural Fair Association.

Resolution Number: 2009-100
Whereas, the Board of Commissioners approved advertising and interviewing for the vacant custodian position, and
Whereas, forty-one (41) applications were received for this position, four (4) individuals were interviewed, and one applicant was chosen to fill the position. Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the County Administrator is authorized to offer the position to the chosen applicant at step 1 of the appropriate pay scale with a starting date at a mutually agreeable time.

Whereas, a study of the feasibility of a High Speed Rail System between St. Paul and La Crescent is being undertaken, And
Whereas, this high speed rail route is planned to pass through a portion of Wabasha County, And
Whereas, it is in the best interest of Wabasha County to be a part of the planning process for this project,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they join the Joint Planning Board as a financial voting member. Tabled to May 19 meeting
RIESTER - DWELLE
Resolution Number: 2009-102
Whereas, The City of Wabasha provides water for its residence, And
Whereas, The City of Wabasha wished to extend the number of wells available to provide that water supply, And
Whereas, The County’s Criminal Justice Center Property appears to offer a favorable location for such a well,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they allow drilling of a test well in the North East Corner of the Criminal Justice Center Property.

The 52nd Annual County Days was held on Tuesday, May 5th. Students from Wabasha-Kellogg High School attended part of the Board Meeting. Each Commissioner introduced themselves and answered questions from the students. County Administrator Dave Johnson came before the Board with the idea to reorganize the environmental services department. He would like these services consolidated for “one stop shopping” for county citizens. The departments effected would be Solid Waste, Planning & Zoning, Feedlot, Septic/Water and Environmental Services. All of these offices would answer to Floyd Riester, the Zoning Administrator. It was the consensus of the Board to move Feedlot and Solid Waste under Mr. Riester. It was the consensus of the Board to open negotiations to extend the Solid Waste Hauler’s contract.
