Meeting of April 21, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, April 21, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
DWELLE - HALL
Motion to approve the agenda.

Commissioners reported on meetings they had attended. Andru Peters from Lake City spoke to the Board. He spoke in regards to the High Speed Passenger Rail and the Regional Rail Authority/Great River Ridge Trail. Al Schacht, from Hyde Park Township spoke to the Board. He spoke about hiring & joint dispatching. He suggested that all county offices go out to the criminal justice center. He suggested there is enough room out at the Criminal Justice Center to do this. Mr. Schacht also brought up the Solid Waste Ordinance.

Resolution No.: 2009-064
Be it resolved by the Wabasha County Board of Commissioners that Wabasha County will not utilize “Watch for Children” and “Slow, Children at Play” signs for the following reasons:
1. These signs are not recognized in the Minnesota Manual on Uniform Traffic Control Devices.
2. There is no evidence that these signs effectively change driver behavior.
3. These signs are not enforceable.
4. Motorists should be aware that children might be playing near all highways.
5. These signs may give parents and children a false sense of security. Children should be encouraged not to play on highways.

Resolution No.: 2009-074
Whereas, Schumacher Excavating, Inc. had the lowest bid for Combined Projects S.A.P. 079-997-001 and S.A.P. 079-997-002.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Schumacher Excavating, Inc. on Contract No. 09005 for Combined Projects S.A.P. 079-997-001 and S.A.P. 079-997-002 – Stream Bank Protection along Zumbro River at various locations along C.A.H. No. 68 between Zumbro Falls and Hammond and along C.S.A.H. No. 11 between Hammond and 3.5 miles east of Millville, – in the amount of $564,026.50 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Schumacher Excavating, Inc. for this work.

Resolution No.: 2009-075
Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of guardrail along County State Aid Highway 23 under S.A.P. 079-623-005, and
Whereas, the Commissioner of Transportation has given notice that funding for this project is available, and
Whereas, the amount of the grant has been determined to be $54,682 by reason of the lowest responsible bid, and
Whereas, the Wabasha County Board of Commissioners has approved the General Obligation Bond Proceeds Grant Agreement – Construction Grant for S.A.P. 079-623-005, and
Whereas, the State of Minnesota requires the attached “Attachment I to Grant Agreement Declaration” be executed by Wabasha County in order to receive the necessary funds for this project.
Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby make the Declaration as attached in “Attachment I to Grant Agreement Declaration”. Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and County Administrator are hereby authorized to execute the attached Declaration.

Resolution No.: 2009-076
Whereas, the following applicant wishes to have his County On Sale and Sunday Liquor License approved: On Sale & Sunday Liquor: Mark Kuehn, Grampa Ed’s, Mazeppa Township
Whereas, the applicant does have current food & beverage license issued by Wabasha County Public Health, and
Whereas, the applicant is in the process for applying for a Conditional Use Permit from Wabasha County Zoning Department and should be issued to him on April 28, 2009.
Whereas, the application has been approved by the County Attorney and County Sheriff. The Wabasha County Auditor/Treasurer has received a certificate of insurance and the appropriate license fee. The liquor license will run from May 1, 2009 to July 31, 2009.
Now therefore be it resolved that Wabasha County Board of Commissioners hereby approves the Liquor License to the individual listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner and also subject to the approval of the Conditional Use Permit.

Resolution No.: 2009-077
Whereas, the Wabasha County Restorative Justice Program has a vacancy in the full-time position of Restorative Justice Coordinator since 4/3/2009, and
Whereas, the Probation Director and the County Attorney recommend advertising the vacancy in order to solicit applications to fill the position,
Now Therefore be it Resolved, that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Administrator to advertise the vacant full time position of Restorative Justice Coordinator. Motion failed for lack of a Second This item will be brought back to the next Board meeting with more information.

Resolution No: 2009-069
Whereas, the Wabasha County Sheriff’s Office is requesting to set up a fund for an Impound Lot at the Criminal Justice Center; and,
Whereas, the fund would help offset costs for upkeep and maintenance; and,
Whereas, any remaining funds would be used toward a future storage building on this same lot.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby: approves the Wabasha County Finance Department to set up a separate fund for the Sheriff’s Office Impound Lot at the Criminal Justice Center; and.
Whereas, be it further resolved that the Wabasha County Board of Commissioners hereby: authorizes this fund to be used to offset costs for upkeep and maintenance and any remaining amount to be used toward a future storage building on the lot.

Resolution No: 2009-072
Whereas, The Wabasha County Jail is requesting to enter into an Inmate Commissary and Banking Software contract with Stellar Services, LLC.
Whereas, the Jail Administrator requests the approval and signing of the Inmate Commissary Services Agreement with Stellar Services, LLC.
Whereas, the term of this agreement will be for three (3) years and will commence at the time the new jail opens. Exact date is unknown at this time.
Whereas, there is no cost to the County for this service.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Jail to enter into the Inmate Commissary and Banking Software contract with Stellar Services, LLC. Be it further Resolved that: the Wabasha County Board of Commissioners authorizes the Wabasha County Sheriff to execute and sign this agreement.

Resolution Number: 2009-073
Whereas, the Planning Commission held a public hearing on March 23, 200 and reviewed the Conditional Use Permit Application for Richard and Janet Hall, 22540 595th St, Kellogg MN 55945. The request is for a Conditional Use Permits to allow the placement of a Recreational Residence as regulated under Article 9, Sect. 3, Subd. 4, of the Wabasha County Zoning Ordinance. The conditional use involves the following property. NW1/4 & W1/2SW1/4 Parcel # 06.00149.00 Section 15 T109N R11E (Highland)
Whereas, the Planning Commission approve the request 4-0 and recommends approval from the County Board.
Now therefore be it Resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions.
Commissioner Hall abstained.

Resolution Number: 2009-078
Whereas, the Criminal Justice Center is being constructed on a 40 acre tract with unused acreage available for lease,
Whereas, leasing the land will produce revenue for the county rather than the land sitting unused,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the excess acreage, approximately 15 acres, be offered for lease for crops on a per acre basis.

There was discussion from the Board about being an ex officio member of the High Speed Passenger Rail Joint Powers Agreement. This topic will be brought back for a vote on May 5th, 2009. Assistant County Attorney Lisa Bayley asked for input from the Board on what to do with the Solid Waste Ordinance. She suggested there be some sort of a public meeting so the public has some input. There were questions about what is mandated by the state and what is enforced.
