Meeting of April 7, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, April 7, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Norman, Hall. Absent: Dwelle, Riester
HALL - NORMAN
Motion to approve the agenda.

Commissioners reported on meetings they had attended. Administrator’s Update A. PSC: a. Winona--not suitable, no room, technology behind ours, too costly. b. Rochester--remodeling required, proprietary mobile data system, controlled by City, conversion complexity would be highest of the three; c. Goodhue--space exists, buy into new console, dispatchers plus supervisor; d. New Facility--designed for dispatch to man front desk. B. Put off opening jail until November 1, 2009. C. Forty-one applications for Custodian position; 30 manufacturing layoffs. There was no public comment during the public forum. Recessed to the Regional Rail Authority meeting at 9:12 a.m. Reconvened at 9:20 a.m.

Jim Straskowski from the Soil and Water Conservation District presented information about Wabasha County Soil and Water to the Board.

Resolution No.: 2009-059
Whereas, The Wabasha County Highway Department has received Proposals for the 2009 Corrugated Metal Culvert Materials, and,
Whereas, All Steel Products Company of Chaska, Minnesota had the lowest amount.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the Proposal of All Steel Products Company of Chaska, Minnesota for the 2009 Corrugated Metal Culvert Materials in the amount of $28,126.65 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with All Steel Products Company for these materials.

Whereas, Highway Technologies had the lowest bid for Project S.P. 079-070-001, Minn. Proj. No. HSIP 7909(181).
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Highway Technologies on Contract No. 09004 for Project S.P. 079-070-001 – Traffic Barrier on Wabasha C.S.A.H. No. 10, from 14685 feet Northwest of T.H. 61 to 2866 feet West of T.H. 61 – in the amount of $145,075.00 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Highway Technologies for this work.

Whereas, Wabasha County is dedicated to being responsive to the needs and values of the citizens of Wabasha County, and;
Whereas, snow and ice control is necessary to meet the needs and values of the citizens of Wabasha County, and;
Whereas, the attached Snow and Ice Control Policy provides for snow and ice control in a reasonable, safe and cost effective manner.
Be it resolved by the Wabasha County Board of Commissioners that the attached Snow and Ice Control Policy is hereby adopted.

Be it resolved by the Wabasha County Board of Commissioners that Wabasha County designates its Website as an alternative means to disseminate solicitations of bids, requests for information, and requests for proposals

Whereas, the Wabasha County Highway Department finds it beneficial for the County to order road salt through the State of Minnesota as a Cooperative Purchasing Venture Member.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to order Regular Road Salt through the State of Minnesota as a Cooperative Purchasing Venture Member.

Resolution No.: 2009-064
Be it resolved by the Wabasha County Board of Commissioners that Wabasha County will not utilize “Watch for Children” and “Slow, Children at Play” signs for the following reasons:
These signs are not recognized in the Minnesota Manual on Uniform Traffic Control Devices.
There is no evidence that these signs effectively change driver behavior.
These signs are not enforceable.
Motorists should be aware that children might be playing near all highways.
These signs may give parents and children a false sense of security. Children should be encouraged not to play on highways. Tabled to Next Agenda

Resolution No.: 2009-065
Whereas, the Wabasha County Department of Social Services has a vacancy for the position of Financial Worker; and
Whereas, the filling of this position is necessary for the continued, normal operation of the Department; and
Whereas, the Financial Worker position is included under the AFSCME Union contract at a starting salary of $15.04 per hour ($29,333 annually); and
Whereas, the Director of Social Services has recommended the position be filled;
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby accepts the recommendation to fill the position of Financial Worker in the Department of Social Services.

*It is to be noted that the board is approving advertising for the vacant position. Commissioner Norman would like it noted that the only reason the motion was seconded was under the condition that a case worker position be eliminated in Social Services.

Resolution No.: 2009-066
Whereas, the Wabasha County Board of Commissioners has the authority to designate certain positions and/or employees to open credit cards and charge accounts to be issued for and used by Wabasha County, and
Whereas, the Wabasha County Board of Commissioners has approved a policy allowing the County Administrator to approve the issuance of credit cards or charge accounts to departments demonstrating a need for their own account.
Now, therefore, be it resolved, that the Wabasha County Board of Commissioners authorizes Debbie Koenig, Finance Director to apply for credit cards or open charge accounts for departments once approved by the County Administrator.

Whereas, the Wabasha County Board of Commissioners anticipates reductions to State aids and credits for the 2009 Budget year; and
Whereas, the Wabasha County Board of Commissioners has considered the duties of each and every office, department and agency and the experience, qualifications and performance of employees, elected officials and appointed employees in the development of the amended budget; and
Whereas, a detailed listing of budget changes has been attached.
Now, therefore, be it resolved by the Wabasha County Board of Commissioners that the 2009 Amended Budget be approved as follows:

Resolution No: 2009-068 Contract #B25848
Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2009 Federal Boat and Water Safety Grant; and
Whereas, the Sheriff’s Office has received the 2009 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and
Whereas, the Sheriff requests the approval and signing of the 2009 Minnesota Department of Natural Resources Federal Boat and Water Safety Grant by the County Administrator and Chairman of the County Board.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2009 Minnesota Department of Natural Resources Federal Boat and Water Safety Grant is hereby approved and authorizes it’s signing by the County Administrator and Chairman of the County Board.

Chief Deputy Modjeski and Investigator LaVigne came before the Board to express the importance for a county owned impound lot.
Resolution No: 2009-069
Whereas, the Wabasha County Sheriff’s Office is requesting to set up a fund for an Impound Lot at the Criminal Justice Center; and,
Whereas, the fund would help offset costs for upkeep and maintenance; and,
Whereas, any remaining funds would be used toward a future storage building on this same lot.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby: approves the Wabasha County Finance Department to set up a separate fund for the Sheriff’s Office Impound Lot at the Criminal Justice Center; and.
Whereas, be it further resolved that the Wabasha County Board of Commissioners hereby: authorizes this fund to be used to offset costs for upkeep and maintenance and any remaining amount to be used toward a future storage building on the lot. Tabled to Next Agenda

Resolution Number 2009-070
Whereas, a 2004 Dodge Intrepid squad car (#53) is considered a surplus as it has been replaced with a 2009 Ford Crown Victoria (authorized by Resolution 2009-013); and
Whereas, the Wabasha County Sheriff’s Office is requesting that this vehicle be sold on Ebay; and
Whereas, the Wabasha County Sheriff Office is requesting that the proceeds from the sale of this vehicle be deposited back into the general fund of Wabasha County.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized and directed to sell the 2004 Dodge Intrepid bearing VIN #2B3HD46V24H702227on Ebay as noted above. Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the general fund of Wabasha County.

Resolution No: 2009-072
Whereas, The Wabasha County Jail is requesting to enter into an Inmate Commissary and Banking Software contract with Stellar Services, LLC.
Whereas, the Jail Administrator requests the approval and signing of the Inmate Commissary Services Agreement with Stellar Services, LLC.
Whereas, the term of this agreement will be for three (3) years and will commence at the time the new jail opens. Exact date is unknown at this time.
Whereas, there is no cost to the County for this service.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Jail to enter into the Inmate Commissary and Banking Software contract with Stellar Services, LLC. Be it further Resolved that: the Wabasha County Board of Commissioners authorizes the Wabasha County Sheriff to execute and sign this agreement.

Resolution Number: 2009-073
Whereas, the Planning Commission held a public hearing on March 23, 200 and reviewed the Conditional Use Permit Application for RICHARD & JANET HALL, 22540 595th St, Kellogg MN 55945. The request is for a Conditional Use Permits to allow the placement of a Recreational Residence as regulated under Article 9, Sect. 3, Subd. 4, of the Wabasha County Zoning Ordinance. The conditional use involves the following property. NW1/4 & W1/2SW1/4 Parcel # 06.00149.00 Section 15 T109N R11E (Highland)
Whereas, the Planning Commission approve the request 4-0 and recommends approval from the County Board.
Now therefore be it Resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions. Tabled to Next Agenda Chairman Windhorst and Commissioner Hall have volunteered to be on a committee for a potential wind tower ordinance. Lisa McNally- Social Services, informed the Board on what the Wellness Committee has been working on. Students from Winona State were present to give the Commissioners a PowerPoint presentation regarding the survey some Wabasha County Employees took in reference to wellness and exercise. Assistant County Attorney Lisa Bayley informed the Board that she met with the County Engineer and Tom Mosher and cut a lot from the proposed ordinance. She took out any redundancy. Ms. Bayley explained that the reason this Solid Waste Ordinance was brought back to the Board was because the Contract with the Solid Waste Haulers expired last summer. The County could face large fines if they do not haul the majority of their solid waste to La Crosse.
