Meeting of March 17, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, March 17, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
RIESTER - NORMAN
Motion to approve the agenda.

Commissioners reported on meetings they had attended. There was no public comment during the public forum.
HALL – DWELLE
Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: February 24, 2009 and March 3, 2009 Accept Donations to Restorative Justice: $900 from Pass It On and $100 from Beverly Poncelet in memory of Jim. Accept Donation from the City of Plainview, $100, for Victim Interview Room renovation.

DWELLE - HALL
Resolution No: 2009-042
Whereas, the Wabasha County Board of Commissioners has supported the Great River Ridge Trail since its inception, and;
Whereas, the Great River Ridge Trail is eligible to gain state trail status;
Now, Therefore, be it Resolved that the Wabasha County Board of Commissioners supports designation of state trail status for the Great River Ridge Trail.

Resolution No.: 2009-043
Be it resolved by the Wabasha County Board of Commissioners that Wabasha County enter into the attached Agreement between Wabasha County and the City of Plainview and authorizes the Chairman of the Board and County Administrator to execute the Agreement. Nay: Windhorst

Resolution No: 2009-044
Whereas, the Board of County Commissions has always supported recognition of our Nation’s veterans and the Millville American Legion Post desires to designate the new Millville bridge as the Veterans’ Memorial Bridge;
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the Board endorses and supports designating the new Millville bridge as the Veterans’ Memorial Bridge.

Resolution No.: 2009-045
Whereas, the following applicant wishes to have its “1 to 4 Day Temporary On-Sale Liquor License” approved: Theilman Sportsman Club, 62643 261st AVE, Theilman, West Albany Township, and
Whereas, the liquor license will be in effect for July 3rd and 4th, 2009.
Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the “1 to 4 Day Temporary On Sale Liquor License” to the Club listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.

The Board set a Public Hearing date regarding Liquor License Fees for May 5, 2009 at 9:15am. The Auditor/Treasurer recommends raising the fees.
DWELLE - RIESTER
Resolution No.: 2009-046
Whereas, Anna Mae Knicely, has submitted an application as provided in M.S. 282.241 to the Wabasha County Board of Commissioners requesting to repurchase a parcel of land, which forfeited due to delinquent taxes, in 2008 and described as the Ely 160’ of WLY 664’ of NLY 80’ of SW1/4SE1/4 in Greenfield Township, and
Whereas, The Wabasha County Auditor/Treasurer has determined that Anna Mae Knicely does have sufficient ownership in the above described property as an owner, heir, assignee or mortgagee, and
Whereas, The Wabasha County Commissioners has determined that this repurchase will best serve the interest of the Public by placing it back onto the tax roll.
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the application of Anna Mae Knicely for the repurchase of the above-mentioned tax forfeited land.
Be it further resolved, that upon approval of the Wabasha County Commissioners, said applicant is to pay the sum of $514.19 for the delinquent taxes, penalties, interest, cost, fees and the current 2009 real estate taxes on or before March 17, 2009.

Resolution No: 2009-047
Whereas, each Minnesota County is to have a designated HIPAA Officer and that officer is presently Assistant County Attorney Karrie Kelly; and
Whereas, the HIPAA Officer is responsible for disciplinary action arising out of violation of the HIPAA rules and the Assistant County Attorney has no standing to mete out disciplinary action; and
Whereas, the County Administrator is the only County officer able to cross department lines for this purpose,
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that County Administrator David Johnson be designated as the County’s HIPAA Officer and Judy Barton as the HIPPA trainer.

Resolution No: 2009-048
Whereas, the Wabasha County Extension Committee has nominated Margaret Haase of Lake City to serve as a member of the Extension Committee for a period of three (3) years,
Now, Therefore Be It Resolved that the Wabasha County Board of Commissioners appoint Margaret Haase to the Wabasha County Extension Committee.

Resolution No: 2009-049
Whereas, Wabasha and Olmsted Counties have created the Lake Zumbro Joint Powers Board; and
Whereas, Wabasha County needs to appoint two Commissioners to serve as Wabasha County’s representatives on this board.
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that Commissioner Merl Norman and Commissioner Dave Windhorst be appointed to the Lake Zumbro Joint Powers Board.

RIESTER - DWELLE
Resolution No: 2009-050
Whereas, the Criminal Justice Center is currently under construction and scheduled to be completed September 30, 2009, and
Whereas, maintenance staff has been budgeted for the facility and needs to be in place prior to completion of the facility in order to become familiar with the facility systems, and existing Maintenance position will be transferred to the Criminal Justice Center and replaced by a Custodial Position.
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the County Administrator be authorized to advertise and interview for this Custodial position.

Jail Administrator Charlene Rickard and Sheriff Rodney Bartsh came before the Board to discuss training schedules for Jail Staff. Charlene recommends 561 hours of training for new jail staff. Surrounding counties have around 6 months of training for their jail staff. There are 130 items that need specific training. There was discussion on advertising dates and hiring dates. This topic will be continued at the next board meeting.

RIESTER - DWELLE
Resolution No.: 2009-051
Whereas, the Wabasha County Department of Social Services has a vacancy for the position of Account Technician; and
Whereas, the filling of this position is necessary for the continued, normal operation of the Department; and
Whereas, the Account Technician position is included under the AFSCME Union contract at a starting salary of $12.35 per hour ($24,083 annually); and
Whereas, the Director of Social Services has recommended the position be filled;
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby accepts the recommendation to fill the position of Account Technician in the Department of Social Services.

Resolution No: 2009-052
Whereas, the Wabasha County Board of Commissioners authorized the County Administrator to negotiate a contract for food services for the Wabasha County Jail with Consolidated Correctional Food Services of Des Moines, Iowa; and
Whereas, the County Administrator and Assistant County Attorney have worked out terms agreeable to Wabasha County and to Consolidated Correctional Food Services;
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that they approve and award the contract for Jail food services to Consolidated Correctional Food Services.
