Meeting of March 3, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, March 3, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
DWELLE - RIESTER
Motion to approve the agenda.

There was no public comment during the public forum.
Recessed to Regional Rail Authority meeting at 9:12 a.m.

Assistant County Attorney Lisa Bayley brought the Solid Waste Ordinance before the Board. She answered commissioner questions regarding the Ordinance. Ms. Bayley would like a written Policy on the topic of Solid Waste in Wabasha County. She would like to continue discussing this topic at the next board meeting.

Resolution No.: 2009-036
Whereas, the advertisements for bids for Combined Projects S.A.P. 079-997-001 and 079-997-002 need to be published.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for Combined Projects S.A.P. 079-997-001 and 079-997-002.

Resolution No.: 2009-037
Whereas, the advertisement for bids for Project S.A.P. 079-602-034 needs to be published.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for Project S.A.P. 079-602-034.

NORMAN - DWELLE
Resolution No.: 2009-038
Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of guardrail along County State Aid Highway 23 under S.A.P. 79-623-05, and
Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and
Whereas, the amount of the grant has been determined to be $54,682 by reason of the lowest responsible bid, and
Whereas, the State of Minnesota requires the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant for S.A.P. 79-623-05 be executed by Wabasha County in order to receive the necessary funds for this Project.
Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant and attached agreement consistent with Minnesota Statutes; 174.52 subdivision 5 and 174.50, subdivision 5, clause (3), and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for this Project but not required.
Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and County Administrator are hereby authorized to execute the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant on behalf of Wabasha County.

Resolution No: 2009-039
Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2009 State Boat and Water Safety Grant; and
Whereas, the Sheriff’s Office has received the 2009 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and
Whereas, the Sheriff requests the approval and signing of the 2009 Minnesota Department of Natural Resources State Boat and Water Safety Grant (Contract #B24450) by the County Administrator and Chairman of the County Board.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2009 Minnesota Department of Natural Resources State Boat and Water Safety Grant is hereby approved and authorizes it’s signing by the County Administrator and Chairman of the County Board.

DWELLE - RIESTER
Resolution Number: 2009-040
Whereas, the County of Wabasha is in the process of constructing a new Criminal Justice Center, which includes a new jail, and
Whereas, food services are required for the inmates of the jail and an RFP for these food services was prepared and sent to qualified vendors, and
Whereas, three proposals were received, with one deemed to be non-responsive to the specifications, and
Whereas, the responses were evaluated by means of a point system, and the points awarded to the remaining two responders were very close, with the main difference being pricing of the individual meals,
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the County Administrator is authorized to negotiate and enter into a contract with Consolidated Correctional Food Service of Des Moines, Iowa, as the successful responder to the RFP.
