Meeting of September 6, 2011

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, September 6, 2011 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Norman.

Be It Resolved, by the County Board of Wabasha County, Minnesota, that the recommendation by the Chair of the County Board of Wabasha, Wabasha County, Minnesota, of Laura Mielke to serve as the Commissioner representing the County of Wabasha, Minnesota of the Southeastern Minnesota Multi-County Housing and Redevelopment Authority for a period of five (5) years, the Recommendation of Appointment dated September 6, 2011 be and the same is approved and said Commissioner is hereby appointed.

Whereas, the Wabasha County Board of Commissioners per Minnesota Statute 275.065 is required to adopt a proposed property tax levy for taxes payable year 2012 and certify that amount to the county auditor on or before September 15; and

Whereas, based upon the proposed budget the following amounts have been determined to be needed for the 2012 proposed property tax levy.

Resolution No.: 2011-187

Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority was created by action of the Boards of Commissioners of Dodge, Goodhue, Wabasha and Winona Counties pursuant to Minnesota Statutes, Section 469.004; and

Whereas, Minnesota Statute Section 469.033, subs. 6, permits the Authority to levy and collect a special benefits tax not to exceed 0.0185 percent of taxable market value; and

Whereas, the Wabasha County Board of Commissioners has considered the Authority's request to approve a special benefit tax to be levied upon all taxable market value of taxable property within the Authority's area of operation within Wabasha County.

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County Auditor-Treasurer to certify a 2012 proposed special benefit property tax levy in the amount of $60,288 for Southeastern Minnesota Multi-County Housing Redevelopment to the Minnesota Department of Revenue.

Resolution No.: 2011-188

Whereas, The Wabasha County Board of Commissioners approved a Special Benefit Tax agreement dated July 1, 2005 with Southeastern Minnesota Multi-County Housing and Redevelopment Authority for the purpose of paying, in part the debt service on the Authority's Tax Increment Revenue notes, Series 2005; and

Whereas, pursuant to this agreement, the Wabasha County Board of Commissioners does hereby certify the proposed special benefit property tax levy in the amount of $50,000.00 for the Southeastern Minnesota Multi-County Housing Redevelopment Authority, a Special Taxing district.

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County Auditor-Treasurer to certify the above 2012 proposed special benefit property tax levy for Southeastern Minnesota Multi-County Housing Redevelopment Authority to the Minnesota Department of Revenue.

Whereas, the Wabasha County Board of Commissioners has considered the duties of each and every office, department and agency and the experience, qualifications and performance of employees, elected officials and appointed employees in the development of this budget; and

Whereas, capital expenditures included in the 2012 budget shall be made only after approval of the Board of Commissioners per the County Purchasing Policy.

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the 2012 Wabasha County Proposed Budget is adopted as presented.

Resolution No.: 2011-190

Whereas, the Wabasha County Veteran Service Office is issued a $2800.00 grant through the State of MN Department of Veteran Affairs every three years

Whereas, the County needs to accept the grant and the conditions of the contract

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that

Wabasha County accepts the MNDVA Operational grant for the Veteran Service Office.

Resolution No: 2011-191

Contract #30-1597; CFDA #97.012 and authorization for Auditor's Warrant

Whereas, the Wabasha County Sheriff's Office has been authorized to participate in the 2011 Federal Boating Safety Sub Grant for Equipment and Supplies; and

Whereas, the Sheriff's Office has received the 2011 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and

Whereas, the Sheriff requests the approval and signing of the 2011 Minnesota Department of Natural Resources Federal Boating Safety Sub Grant for Equipment and Supplies by the County Administrator, Chairman of the County Board, and Sheriff.

Whereas, this grant expires December 15, 2011 and all requirements (Exhibit A) must be met on or before this date in order to receive reimbursement.

Whereas, the Sheriff also requests approval for the Auditor's Office to cut an Auditor's Warrant not to exceed the award amount of $4,650.00 once the invoices are received to ensure reimbursement timelines are met.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2011 Minnesota Department of Natural Resources Federal Boating Safety Sub Grant for Equipment and Supplies is hereby approved and authorizes it's signing by the County Administrator, Chairman of the County Board, and Sheriff.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor's Office is hereby authorized to cut an Auditor's Warrant not to exceed the award amount of $4,650.00 once invoices are received.

Whereas, it is necessary to publish the advertisements for bids for the following project: SAP 079-607-021

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for the above referenced projects.

Resolution No.: 2011-193

Whereas, Project CP 79-11-8000 – Furnish and Apply Chloride with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Univar USA, Inc. in the amount of $4,133.13.

Resolution No.: 2011 -194

Whereas, Wabasha County has interest over the following described properties:

That part of the South half of the Northeast Quarter of Section 27, Township 111 North, Range 12 West shown as Parcel 1TB on Wabasha County Highway Right of Way Plat No. 35 on file and of record in the office of the County Recorder in and for Wabasha County, Minnesota; containing 0.23 acres more or less.

That part of the South half of the Southwest Quarter of Section 23, Township 111 North, Range 12 West shown as Parcel 4TB on Wabasha County Highway Right of Way Plat No. 35 on file and of record in the office of the County Recorder in and for Wabasha County, Minnesota; containing 0.10 acres more or less.

Whereas, Wabasha County does not require the above described properties for highway purposes.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby quitclaim and release any and all rights or interest it may have in the above described property to the following current owner of record for each parcel:

Richard J. and Lesa A. Funke, Parcel 1TB

And hereby authorizes the Chair of the Board and County Administrator to execute a Quit Claim Deed for each Parcel.

Whereas, the Planning Commission held a public hearing on August 22, 2011 and reviewed the Conditional Use Permit Application submitted by WILLIAM FITZGERALD, 16489 SOUTH COUNTY ROAD 24, WABASHA MN 55981. An Application to Subdivide with a Final Plat is to be considered as per the Wabasha county Subdivision Ordinance. The request involves the following described property:

Resolution No.: 2011-197

Whereas, the Planning Commission held a public hearing on August 22, 2011 and reviewed the Conditional Use Permit Application by KENNETH O. COLLIER, 1085 Lincoln Avenue, St Paul MN 55105 The request is for an addition on an existing dwelling below minimum flood elevation as per Article 14, Section 7 Subd. 3A. The request involves the following described property:

Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions.

Resolution No.: 2011-198

Whereas, the Wabasha County Human Services Board has recommended that the county discontinue providing a Home Care Program through the Public Health Services, and

Whereas, the Human Services Board also recommended that this be done by a phasing out process, where no new recipients would be admitted but current recipients would be continued until such time as they left their home for hospitalization, nursing home, or other setting,

Now; Therefore be it Resolved by the Wabasha County Board of Commissioners that: Public Health begin the phase out of the Home Care Program as indicated above in this resolution.

Resolution No.: 2011-173

Whereas, the County is seeking a new service agreement for the Criminal Justice Center, and;

Whereas, quotes for this service were received from three vendors, and;

Whereas, Honeywell is the best alternative fiscally for the County with their additional services of a geothermal water treatment program, and discount for electrical and plumbing work both related to the HVAC and unrelated to the HVAC system, and serving as a one-stop call center for all HVAC, plumbing, and electrical work at the CJC.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the quote from Honeywell in the amount of $34,445 plus parts be accepted and a new service agreement be signed for a period of three years.

Whereas, the Wabasha County Sheriff's Office is requesting authorization to purchase Motorola Portable and Mobile radios per county purchase policy #19 (over $5,000.00); and,

Whereas, Motorola provided a bid thru state contract pricing; and,

Whereas, the cost incurred in this purchase is quoted at $29,758.18, plus extended warranty, shipping and handling; and,

Whereas, the monies for this purchase will come from the 911 (291 account) and reimbursed by 2010 SHSP-00775 Grant (no match) monies;

Whereas, this grant expires December 31st, 2012 and all requirements must be met on or before this date in order to receive reimbursement (no exceptions!).

Whereas, the Sheriff requests approval for the purchase in the amount of $30,018.42 plus extended warrant, shipping and handling regarding Motorola invoice quote to meet Wabasha Counties Transition to ARMER.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Sheriff's Office is hereby authorized to purchase Motorola Portable and Mobile Radios with accessories.

Be it further Resolved by the Wabasha County Board of Commissioners that: The funding will come from the 911 (01-291) account and reimbursed by 2010 SHSP-00775 Grant (no match) monies.
