Meeting of January 4, 2011?

 

New Commissioners and other elected officials were sworn in at 8:30 a.m. Election of Board Chairperson, Merl Norman, and Vice Chairperson, Rich Hall, followed.

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, January 4, 2011 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Norman.

 

The following Commissioners were present: Norman, Hall, Roschen, Wobbe, Harms

 

HALL - ROSCHEN

 

Motion to approve the agenda, with an item added that would set a Public Hearing date for a land swap.

Resolution No.: 2011-001

 

Whereas, the Wabasha County Board of Commissioners has advertised to accept sealed bids for the Wabasha County legal newspaper for 2011; and

 

Whereas, the Wabasha County Board of Commissioners desires to open the sealed bids on Tuesday, January 4, 2011; and

 

Whereas, three bids were received: The Lake City Graphic, The Plainview News and The Wabasha County Herald; and

 

Whereas, the Lake City Graphic is the apparent low bidder at $9.50 per standard advertising unit (SAU),

 

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby accepts the bid of the Lake City Graphic as the “legal County newspaper,” to include publications of the Commissioners Proceedings, the Delinquent Tax List and other notices ordered by the County Board of Commissioners as required by law for the year 2011.

Resolution No.: 2011-002

 

Whereas, the Wabasha County Board has authorized the County Auditor/Treasurer to advertise a vacancy for the position of Chief Deputy Auditor/Treasurer, and

 

Whereas, the Wabasha County Auditor/Treasurer, County Administrator and the Finance Director have interviewed and selected Frances Warren as the successful applicant,

 

Now Therefore Be It Resolved that the Wabasha County Board of Commissioners hereby authorizes hiring Frances Warren to the full time position of Chief Deputy Auditor/Treasurer at AFSCME Union Grade 9 Step 1 of the 2011 scale, ($18.29/hour). Start date for this position will be discussed with her current department head.

Resolution No.: 2011-003

 

Whereas, the Wabasha County Auditor/Treasurer’s Office has a vacancy of a full-time position of Deputy Auditor/Treasurer-Accounts Payable with the promotion of Francie Warren to Chief Deputy Auditor/Treasurer, and

 

Whereas, the filling of this position is necessary for the continue, normal operation of the Department; and

 

Whereas, the Deputy Auditor/Treasurer – Accounts Payable position is include under 2011 AFSCME Union contact as a starting salary of $14.33 per hour; and  

 

Whereas, the Wabasha County Auditor/Treasurer has recommended the position be advertised;

 

Now, Therefore be it Resolved by the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Auditor/Treasurer to advertise the vacant position of Deputy Auditor/Treasurer-Accounts Payable.

Resolution No.: 2011-004

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2011 the payment for necessary express, freight, telephone, water, light, e-bay, emergency car repairs and other utility charges to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.16.

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2011 the payment for sales tax and fees and fines due to other government, to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.15.

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby sets the mileage reimbursement rate for 2011 at the same level as the 2011 IRS mileage rate; and

 

Be It Further Resolved, that if an employees uses a personal vehicle without receiving department head approval, they will be reimbursed at $.17 less than the IRS mileage rate.

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the establishment and/or continuance of a Petty Cash Fund, pursuant to MS 375.162; and

 

Be It Further Resolved, that Sheriff Rodney Bartsh shall be custodian of said fund. The amount of the fund shall not exceed $100.00.

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby grants to Deb Koenig, Wabasha County Finance Officer, the authority to designate depositories of Wabasha County funds, pursuant to Minnesota Statute 118A.01 subd. 1.

 

Whereas, it is in the best interest of Wabasha County to reduce administrative costs and increase departmental efficiency, and

 

Whereas, costs are increasing to mail refunds of overpayments and return documents not processed because of underpayments,

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to retain overpayments in amounts not exceeding $5.00 for services of any kind. Revenue from such overpayments shall be deposited in the General Revenue fund in a timely manner, and

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to accept, at their discretion, underpayments of any kind with the deficit amount not exceeding $5.00 and to process the document or transaction regardless of the deficiency.

 

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby sets the maximum reimbursable meal allowance, for 2011, at $8.00 for breakfast, $10.00 for lunch and $15.00 for dinner.

 

Whereas, the County Auditor/Treasurer’s Office currently maintains a checking account for the sole purpose of refunding over-payment of taxes,

 

Be It Resolved, the County Auditor/Treasurer is authorized to maintain a checking account for overpayment of taxes and also for refunds of miscellaneous over-payments or payments made in error as required by all Wabasha County Departments.

 

Be It Resolved, that any employee of Wabasha County who has funds to be deposited in a designated financial depository of Wabasha County, shall take said funds to the Office of the County Auditor/Treasurer for transfer to said depository. No employee shall personally transfer or transport funds, except for the County Auditor/Treasurer or designee thereof.

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the County Auditor/Treasurer to cash checks not to exceed $2,000 to replenish the change fund.

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2011 the payment for necessary charges to be paid on the Warrant of the County Auditor/Treasurer to avoid finance charges, upon receipt of itemized bills.

 

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves payment of per diems for any Commissioner attending committees and board meetings assigned by the Board of Commissioners on the Committee and Board Assignment List, and other meetings assigned by the Board on a per meeting basis.

Resolution No.: 2011-005

 

Whereas, the County of Wabasha has designated First State Bank of Wabasha as a depository of its public funds pursuant to Minnesota Statues, Chapter 118A; and

 

Whereas, Merl Norman has been appointed board chair for 2011; and

 

Whereas, Denise Anderson has been elected as Auditor-Treasurer for a four year term beginning January of 2011.

 

Now, therefore, be it resolved by the Wabasha County Board of Commissioners as follows:

  1. 1.Merl Norman and Denise Anderson are approved as authorized signers at First State Bank of Wabasha.
  2. 2.Tom Dwelle and Jerry Leisen are removed as authorized signers at First State Bank of Wabasha.

 

Be it further resolved, by the Wabasha County Board of Commissioners that the following employees and Board Chairman are given specific authority at First State Bank of Wabasha per the attached. (See attachment)

Resolution No.: 2011-006

 

Whereas, the County Board is required to identify certain positions and/or individuals to perform certain depository functions for the County, and

 

Whereas, the following resolutions will be become effective January 4, 2011.

 

Therefore be it resolved by the Wabasha County Board of Commissioners that the following appointments and actions are hereby directed and approved:

 

  1. 1.That the Wabasha County Board of Commissioners hereby grants to Debbie Koenig, Wabasha County Finance Director, the authority to designate depositories for the County of Wabasha, pursuant to Minnesota Statute 118A.02 subd. 1.

 

  1. 2.That the Wabasha County Board of Commissioners hereby authorizes and directs Denise Anderson, Auditor-Treasurer, or Debbie Koenig, Finance Director to act on behalf of the County of Wabasha as indicated below:
  • Open or close any deposit account. (i.e. checking, savings, certificates of deposit)
  • Endorse checks and orders for the payment of money or otherwise withdraw or transfer funds on deposit.

 

  1. 3.That the Wabasha County Board of Commissioners hereby authorizes Denise Anderson, Auditor-Treasurer and/or the Board Chairperson be named as authorized signers on negotiable instruments for the County of Wabasha, provided as necessary all Countersignatures are present.

Resolution No.: 2011-009

 

Applicants must adopt and submit the following resolution. Financial assistance cannot be provided until this resolution is adopted and submitted.

 

Be It Resolved that Wabasha County act as the legal sponsor for project(s) contained in the Minnesota Recovers Request for Assistance Application and or the Minnesota Investment Fund Application to be submitted on or about December 28, 2010 and that

 

Joseph P. Wheeler (Executive Director of the Southeastern Minnesota Multi-County Housing and Redevelopment Authority) and David Johnson (Wabasha County Administrator) are hereby authorized to apply to the Department of Employment and Economic Development for funding of this project on behalf of Wabasha County.

 

Be It Further Resolved that Wabasha County has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate administration of the project(s).

 

Be It Further Resolved that Wabasha County has not violated any Federal, State, or local laws pertaining to fraud, bribery, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice.

 

Be It Further Resolved that upon approval of its application by the state, Wabasha County may enter into an agreement with the State of Minnesota for the above?referenced project(s), and that Wabasha County certifies that it will comply with all applicable laws and regulations as stated in all contract agreements.

 

Now, Therefore Be It Resolved that Joseph P. Wheeler (Executive Director of the Southeastern Minnesota Multi-County Housing and Redevelopment Authority) and David Johnson (Wabasha County Administrator), or their successors in office, are hereby authorized to execute such agreements, and amendments thereto, as are necessary to implement the project(s) on behalf of the applicant.

Whereas, a resolution approving the appointment of Rich Hall to the Southeastern Minnesota Multi-County Housing and Redevelopment Authority consisting of the Counties of Wabasha, Winona, Goodhue and Dodge.

 

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the recommendation from the Southeastern Minnesota Multi-County Housing and Redevelopment Authority of Rich Hall to serve as Commissioner of the SEMMCHRA for a period of five (5) years, the recommendation of appointment is hereby approved.

Be it resolved by the Wabasha County Board of Commissioners that Wabasha County designates its Website as the official publication for advertisements for bids of transportation projects.

Resolution No.: 2011-012  

 

Whereas, the Mississippi River is a well known corridor of great natural significance and beauty, and importance within Minnesota and America, and

 

Whereas, the proposed Mississippi River Trail is a bicycle route that offers an opportunity for travel along the entire river from the Headwaters in Lake Itasca State Park in Minnesota to the Gulf of Mexico in Louisiana, and

 

Whereas, the proposed Mississippi River Trail relies exclusively on existing highway shoulders, low-volume paved roads and paved recreational trails, and

 

Whereas, the Minnesota Department of Transportation expects the Mississippi River Trail will generate additional economic activity within Mississippi River host communities, and

 

Whereas, the Minnesota Department of Transportation will maintain statewide mapping and information regarding the Mississippi River Trail, convene meetings and facilitate the resolution of issues and alignment selection within the State, and

 

Whereas, Wabasha County makes no obligation of financial support to the Mississippi River Trail, and

 

Whereas, Wabasha County believes funds, if any, that may be used in the development of the Mississippi River Trail would serve a greater public need and purpose if directed towards road or bridge, maintenance and construction.

 

Now therefore be it resolved by the Wabasha County Board of Commissioners that Wabasha County supports the general purposes of the Mississippi River Trail; the promotion of health and economic activity, and enjoyment of the Mississippi River.

 

Be it further resolved by the Wabasha County Board of Commissioners that the Wabasha County Engineer is authorized to represent the County in ongoing collaborative discussions, and in matters regarding the operation and location of the Mississippi River Trail within its administrative boundaries.

Resolution No.: 2011-013

 

Whereas, the Wabasha County Highway Department proposes to acquire land along the existing right of way of County State Aid Highway 4 for the purpose of reconstructing this road under S.P. 079-604-044; and

 

Whereas, S.P. 079-604-044 is necessary in order to improve this segment of County State Aid Highway 4 to meet Minnesota State Aid standards and provide for public health, welfare, safety and convenience; and

 

Whereas, the necessary additional permanent lands for S.P. 079-604-044 are as described in Wabasha County Highway Right of Way Plat No. 40.

 

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts Wabasha County Highway Right of Way Plat No. 40.

 

Be it further resolved, that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to proceed to acquire the necessary lands as described in Wabasha County Highway Right of Way Plat No. 40 in accordance with applicable laws and statutes.

Be it resolved by the Wabasha County Board of Commissioners that Wabasha County enter into the attached “Utility Relocation Agreement and Contract for Quitclaim Deed or Conveyance of Rights in Land” with Dairyland Power Cooperative.

 

It is further resolved by the Wabasha County Board of Commissioners that the County Board of Commissioners Chair and the County Engineer is authorized to execute the Agreement and any amendments to the Agreement.

Whereas, it is necessary to publish the advertisements for bids for the following projects: SAP 079-604-048,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for the above referenced projects.

Resolution No.: 2011-016

 

Whereas, Wabasha County shall appoint Dr. Daniel Pesch as Wabasha County Medical Examiner for the calendar year 2011 at a rate of $8,137.00 per year. Also, Dr. Thomas Peyla is appointed as Assistant Medical Examiner at a rate of $650.00 per year.

 

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Dr. Daniel Pesch be appointed Wabasha County Medical Examiner and Dr. Thomas Peyla be appointed Assistant Medical Examiner at the above mentioned salary.
