The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, December 20,2011 at 9:00 a.m.
The meeting was called to order by Board Chairman Norman.
The following Commissioners were present: Norman, Hall, Wobbe, Harms, Roschen

ROSCHEN - WOBBE Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: November 29,2011 Donations of $25.00 each from Nicki Moline, Lisa McNally, Marci Hitz and Lisa Schuth-Stuhr to the Youth Link Mentorship Program. Adopted Unanimously HARMS - ROSCHEN Resolution No.: 2011-273 Whereas, the County has budgeted cost ofliving increases for elected officials, non-union and union employees; and Whereas, the County Board of Commissioners did not accept a increase in 2009, 2010 and 2011; and Whereas, Minnesota State Statute 375.055 requires that County Commissioners salaries and per diems be established by a resolution before January 1 ofthe year in which they become effective. Now therefore be it resolved by the Wabasha County Board of Commissioners that the following salaries and per diems are approved for 2012: 0 percent change Adopted Unanimously WOBBE-HALL Resolution No.: 2011-271 Whereas, the Board has approved the Union Contracts to include a l.0% COLA increase effective January 1,2012; and Whereas, a 1.0% increase for non-union employees would preserve the pay differentials required to maintain Pay Equity required by State Statutes; and Whereas, the current Consumer Price Index published by the Bureau of Labor Statistics shows that the inflation rate for 2011 is 3.5% through the end of October, the most current date available. Now therefore be it resolved by the Wabasha County Board of Commissioners that Non-Union Employees be granted the same 1.0% COLA as Union employees effective January 1,2012. Nay: Harms, Roschen, Norman Failed ROSCHEN - HARMS Resolution No.: 2011-272 Whereas, State Statute requires that the County Board set the annual salary for elected officials prior to the end of the current year for the following year. Now Therefore Be it Resolved by the Wabasha County Board of Commissioners that the salary for the elected officials be at: Recorder $65,333.11, Sheriff $84,706.85, Attorney $89,659.52, and Auditor/Treasurer $62,814.35. Now Therefore Be it Further Resolved by the Wabasha County Board Commissioners these salaries be effective 01/01/12. 1 percent for Sheriff; 2 percent for Auditor/Treasurer; Recorder and Attorney stay the same. Nay: Wobbe Adopted HALL-HARMS Resolution No.: 2011-285 Whereas, the Wabasha County Attorney's Office utilizes specialized software for all of its case files Whereas, the software is outdated for the County's server and operating system Whereas, upgraded software is available to replace existing software and covert data Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby authorize the Wabasha County Attorney to enter into a contract with Judicial Dialog Systems to upgrade its specialized software for the amount of $21,180 Adopted Unanimously ROSCHEN - HALL Resolution No.: 2011-267 Whereas, the Wabasha County Board of Commissioners per Minnesota Statute 275.07 is required to adopt a fmal property tax levy for taxes payable year 2012 and certify that amount to the county auditor no later than December 28,2011; and Whereas, based upon the final budget the following amounts have been determined to be needed for the 2012 property tax levy.
Now, Therefore, be it resolved by the Wabasha County Board of Commissioners that the County Auditor-Treasurer is to certifY the 2012 [mal property tax levy to the Mirmesota Department of Revenue as presented. Adopted Unanimously WOBBE - HARMS Resolution No.: 2011-268 Whereas, The Wabasha County Board of Commissioners approved a Special Benefit Tax agreement dated July 1, 2005 with Southeastern Minnesota Multi-County Housing and Redevelopment Authority for the purpose of paying, in part the debt service on the Authority's Tax Increment Revenue notes, Series 2005; and Whereas, pursuantto this agreement, the Wabasha County Board of Commissioners does hereby certifY the special benefit property tax levy in the amount of $50,000.00 for the Southeastern Minnesota Multi-County Housing Redevelopment Authority, a Special Taxing district. Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County AuditorTreasurer to certifY the above 2012 special benefit property tax levy for Southeastern Minnesota Multi-County Housing Redevelopment Authority to the Minnesota Department of Revenue. Adopted Unanimously HALL-ROSCHEN Resolution No.: 2011-269 Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority was created by action of the Boards of Commissioners of Dodge, Goodhue, Wabasha and Winona Counties pursuant to Minnesota Statutes, Section 469.004; and Whereas, Mirmesota Statute Section 469.033 subs. 6, permits the Authority to levy and collect a special benefits tax not to exceed 0.0185 percent of taxable market value; and Whereas, the Wabasha County Board of Commissioners has considered the Authority's request to approve a special benefit tax to be levied upon all taxable market value of taxable property within the Authority's area of operation within Wabasha County. Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County AuditorTreasurer to certifY a 2012 [mal special benefit property tax levy in the amount of$60,288 for Southeastern Minnesota Multi-County Housing Redevelopment to the Minnesota Department of Revenue. Adopted Unanimously ROSCHEN - HARMS Resolution No.: 2011-270 Whereas, the Wabasha County Board of Commissioners is required by Minnesota Statute 275.07 to adopt a final budget for 2012; and Whereas, The Wabasha County Board of Commissioners have reviewed the fiscal year 2012 final budget as shown below; and
Whereas, the Wabasha County Board of Commissioners has considered the duties of each and every office, department and agency and the experience, qualifications and perfonnance of employees, elected officials and appointed employees in the development of this budget; and Whereas, capital expenditures included in the 2012 budget shall be made only after approval of the Board of Commissioners per the County Purchasing Policy. Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the 2012 Wabasha County Final Budget is adopted as presented. Adopted Unanimously By consensus, in accordance with the County Fund Balance Policy, the County Board of Commissioners agrees to set aside assigned funds to be disbursed as outlined in the requests for the following: Safe Driving Class-fees collected; Impound Lot-fees collected; Court Service Intake Fees-fees collected; Narrowband Siren Project-$100,000
ROSCHEN - HARMS Resolution No: 2011-274 Whereas, the County Board of Commissioners of the County of Wabasha, State of Minnesota, desires to offer for sale to the public, parcels ofland that has forfeited to the State of Minnesota for non-payment of property taxes and listed on attached Tax Forfeited Land List 2011; and Whereas, the County Board of Commissioners must determine the appraised value of the forfeited property to be sold. The sale price cannot be less than the appraised value. Now, therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the appraised value on the Tax Forfeited Land List 2011. Adopted Unanimously HARMS - WOBBE Resolution No: 2011-275 Whereas, three parcels ofland have forfeited to the State of Minnesota for non-payment oftaxes; and Whereas, the Wabasha County Board of Commissioners desires to sell these parcels at a public auction. Be it Resolved by the Wabasha County Board of Commissioners that: all parcels oftax forfeited land listed on Tax Forfeited Land List 2011 be classified as non-conservation land; that the basic sale price of each parcel on the Tax Forfeited Land List 2011 be approved and authorization for a public sale be granted; pursuant to M.S. 282.01; that the sale will be held at lO:OO a.m., Wednesday, January 18,2012 by the Wabasha County AuditorlTreasurer in the Commissioner's Room of the Wabasha County Courthouse, for not less than the basic sale price; and that the sale be cash/money order/check only; that the County Auditor/Treasurer is hereby directed to publish a notice of sale as provided by law. Be it Further Resolved, that the conditions and terms of the public sale shall be as described in the list contained here-in and approved by the Wabasha County Board of Commissioners. Adopted Unanimously NO MOTION Resolution No.: 2011-276 Whereas, Wabasha County is a founding partner in the development and operation of South Country Health Alliance; and Whereas, the Joint Powers Board of South Country Health Alliance has recommended each participating county consider and approve an amendment to the Joint Powers Agreement; Therefore, Be It Resolved by the Commissioners of Wabasha County, that this county approves the further amendment of the Fifth Amended Joint Powers Agreement of South Country Health Alliance, amending Section 12.1 of that Agreement to allow member counties until March 30,2012 to give notice to withdraw at the end of 2012, such that Section 12.1 will read as follows: 12.1 Method of Withdrawal A Member County may withdraw from this Amended Agreement by filing with the Joint Powers Board Chair a written notice of intent to withdraw by December 31, one year prior to the year of withdrawal. The effective date of withdrawal shall be December 31 of the year following the written notice ("Effective Date"). Notwithstanding the foregoing, any county wishing to withdraw effective December 31, 2012, shall have until March 30, 2012, to provide its written notice of withdrawal, effective on December 31, 2012. Upon receipt ofthe resolution of a withdrawal, the Chair shall send a copy of said resolution to each Member County.
ROSCHEN - HALL Resolution No.: 2011-277 Whereas, Wabasha County is one of 11 counties partnering with Mayo Clinic to develop an interoperable electronic medical record, and Whereas, strict data privacy and HIP AA rules must be abided by as spelled out in the Southeast Beacon Data Access agreement for this endeavor to be successful,Now Therefore be it Resolved, by the Wabasha County Board of Commissioners that: Wabasha County sign the Southeast Beacon Data Access agreement. Adopted Unanimously HALL - ROSCHEN Resolution No.: 2011-278 Whereas, Wabasha County has an approved Comprehensive Local Water Plan with the State of Minnesota; and Whereas, Wabasha County has received a Natural Resources Block Grant (NRBG) grant agreement from BWSR. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the county sign the NRBG Grant Agreement. Adopted Unanimously ROSCHEN - HARMS Resolution No.: 2011-279 Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Engineer to apply to the Local Road Improvement Program for the proposed resurfacing and improvements on Wabasha County State Aid Highway 30 from Minnesota TH 61 to Wabasha County State Aid Highway 24, and Be it further resolved that Wabasha County supports this project and the proposed improvements. Adopted Unanimously WOBBE-HALL Resolution No.: 2011-280 Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Engineer to apply to the Local Road Improvement Program for the proposed resurfacing and improvements on Wabasha County State Aid Highway 2 from Wabasha County State Aid Highway 25 to Minnesota TH 247, and Be it further resolved that Wabasha County supports this project and the proposed improvements. Adopted Unanimously HARMS - ROSCHEN Resolution No.: 2011-281 Be it resolved by the Wabasha County Board of Commissioners that pursuant to Minnesota Statute 161.36, the Commissioner of Transportation be appointed as Agent of Wabasha County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. Be it further resolved by the Wabasha County Board of Commissioners that the County Board Chair and the County Administrator are hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in "Minnesota Department of Transportation Agency Agreement No. 99979", a copy of which said agreement was before the County Board and which is made a part hereof by reference. Adopted Unanimously HALL-HARMS Resolution No.: 2011-282 Whereas, Projects SP 088-070-025 - Edgeline Pavement Markings Applied on Various Roads District 6 Counties with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for [mal payment to Century Fence Company in the amount of $63,865.18. Adopted Unanimously HALL-ROSCHEN Resolution No.: 2011-283 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for the Furnish and Apply Chloride Solution Project - CP 79-12-8030. Adopted Unanimously NO MOTION Resolution No.: 2011-284 Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby waives the Mailbox Installation and Support Policy previously adopted for the reconstruction of County Highway 4 from MnTH 42 to the south County line and authorizes the County Engineer to proceed with temporary relocation and replacements of supports for this project.

ROSCHEN - HALL Resolution No.: 2011-259 Whereas, the Reads Landing Sanitary and Water District has been established and Whereas, Minnesota Statute 115 provides that the Sanitary and Water District Board Members are to be appointed jointly by the County of Wabasha and the Township of Pepin and Whereas, Wabasha County Board of Commissions wishes to delegate the board appointment authority Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby delegates the appointment authority for the Reads Landing Sanitary and Water District to the existing board members for all future board appointment.
