Meeting of January 17, 2012

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, January 17, 2012 at 3:00 p.m.

 

The meeting was called to order by Board Chairman Harms.

 

The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,

Motion to have 'Public Forum' permanently listed under Approve Agenda; 'Commissioner Reports' and 'Board Concerns' moved to the end of the agenda.

Resolution No.: 2012-010

Whereas, the a petition was received by the Environmental Quality Board requesting that an Environmental Assessment Worksheet be completed prior to granting a Conditional Use Permit for the expansion of the Bremer Quarry;

Whereas, the County has been determined to be the Responsible Government Unit to make the decision on whether an EAW is need;

Whereas, the County has found that the potential for significant environmental effects from the proposed action does not exist;

Whereas, the County finds that the need for further environmental review by means of an Environmental Assessment Worksheet under Environmental Quality Board rules does not exist.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby finds that an Environmental Assessment Worksheet shall not be required.

Resolution No.: 2012-011

Whereas, the Planning Commission held a public hearing on December 26, 2011 and reviewed the Conditional Use Application submitted by KBS on behalf of PLAINVIEW VETERINARY CLINIC, PO BOX 417, PLAINVIEW, MN 55964 for a Conditional Use Permit to expand an existing veterinary clinic as regulated under Article 10 section 3 subd 10. The request involves the following property:

Resolution No: 2012-012

Whereas, the Planning Commission held a public hearing on December 26, 2011 and reviewed the Conditional Use Application submitted by JASON TIMM, 61215 202ND AVE, KELLOGG, MN 55945. The application is a request to establish a limited gun sales business as regulated under Article 9 section 3 subd. 17. The request involves the following described property:

Resolution No.: 2012-013

Whereas, Wabasha County Auditor/Treasurer administers elections as required by Minnesota State Statues.

Whereas, Wabasha County Auditor/Treasurer has a working relationship with Synergy Graphics for ballot layout, ballot printing and programming,

Whereas, Synergy Graphics would like to enter into a four year Service Agreement with Wabasha County for the above mentioned services. The four year service agreement would be at the 2010 prices. Agreement would start with the 2012 election cycle.

Whereas, Wabasha County Attorney's Office has reviewed the Service Agreement and does not see any problems as to form or content of the agreement.

Whereas, Wabasha County Auditor/Treasurer is recommending approval of the agreement as it will help with budgeting in the coming years.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the Service Agreement between Wabasha County and Synergy Graphics. Also approves the Board Chair to sign the agreement.

Resolution No.: 2012-014

Whereas, Minnowa Construction Inc. is the lowest responsible bidder for S.A.P. 079-599-076.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of and awards a Contract to Minnowa Construction Inc. for S.A.P. 079-599-076 – Bridge 79551 and Approaches – in the amount of $496,080 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Minnowa Construction Inc. for this work.

Resolution No.: 2012-015

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase three Ford F250s in an amount of $23,263/each from Heffernan Ford and hereby authorizes the County Auditor/Treasurer to issue warrants for applicable sales tax and license fees of the truck.

Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 941, 972 and 973 Pickups as Excess Equipment and authorizes the County Engineer to dispose of on E-bay.

Resolution No. 2012-016

Whereas, a 190' free standing Pirod Tower is considered a surplus; and,

Whereas, the Wabasha County Sheriff's Office is requesting that this item be sold on Ebay; and,

Whereas, the Wabasha County Sheriff Office is requesting that the proceeds from the sale of this item be deposited back into the E-911 fund of Wabasha County.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized and directed to sell the 190' free standing Pirod Tower on Ebay as noted above.

Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the E-911 fund of Wabasha County.

Resolution No.: 2012-017

Whereas, the Wabasha County Sheriff Office is requesting that the Sheriff's Office sell County vehicles as directed by the County Board;

Whereas, it is requested that the proceeds from the sale of these vehicles be deposited into a newly created Squad Replacement fund.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized to sell all County vehicles as directed by the County Board.

Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale of these vehicles be deposited into a Squad Replacement fund.

Resolution No.: 2012-018

Whereas, the Wabasha County Finance Policy Manual contains a policy for emergency purchases, and

Whereas, effective January 1, 2012 the position of the County Administrator has been abolished, and

Whereas, the policy states that the County Administrator shall have the authority to authorize purchases or secure services in case of an emergency without complying with regular County procedures.

Now therefore, be it resolved, that the Wabasha County Board of Commissioners hereby transfers authority in purchasing of goods and obtaining necessary services during an emergency situation to the Chairman of the Wabasha County Board of Commissioners and/or the Wabasha County Auditor-Treasurer. An emergency is defined as an unexpected situation of sudden occurrence of a serious and urgent nature that poses an immediate risk to health, life, property or environment and demands immediate action. Situations created by improper planning or negligence are not to be considered an emergency.

Further be it resolved, that a list of all claims incurred or services obtained under these procedures shall be presented to the county board at the next regularly scheduled meeting.

Resolution No.: 2012-019

Whereas, Policy Number 104 of the Wabasha County Comprehensive Policies and Procedures Manual states that "annual step increases will not be processed until the evaluations have been complete, discussed with the employee and filed with Human Resources", and

Whereas, effective January 1, 2012 the position of the County Administrator has been abolished, and

Whereas, the positions evaluated by the County Administrator would not receive an annual performance evaluation by their immediate supervisor.

Now therefore, be it resolved, that the Wabasha County Board of Commissioners approves step increases without the evaluations for positions evaluated by the former position of the County Administrator for 2012 or until further notice, whichever occurs first.
