The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, April 24, 2012 at 1:00 p.m.

 

The meeting was called to order by Board Chairman Harms.

Whereas, the Wabasha County Board is responsible for personnel administration and structure; and

Whereas, the Wabasha County Board has decided to create and fill a county coordinator position; and

Whereas, a court-ordered government study commission was initiated by a group who has repeatedly expressed their opposition to the county board's efforts to streamline the administrative functions of county government; and

Whereas, the county board has repeatedly sought objective legal counsel regarding the authority and impartiality of the court-ordered government study commission and their influence over the decision making of the Wabasha County Board; and

Whereas, the court, by order, has authorized the Government Study Commission expenditures up to $5,000 for fees necessary in the course of their efforts; and

Whereas, the county attorney has been appointed to the court-ordered commission resulting in a conflict of interest as it relates to the county attorney's ability to properly advise and represent the county board relative to the court-ordered government study commission, the county coordinator position, and Wabasha County's current government structure; and

Whereas, the court has found that the hiring of outside legal counsel is permissible in extraordinary occurrences and for specific purposes when the county attorney is unable to render effective service to properly represent the interest of the county; and

Whereas, seeking outside legal counsel and the decision to do so is within the authority of the board; and

Whereas, the hiring of Mohrman & Kaardal will provide the competent and diligent representation necessary in regard to the identified issues and ensure that the Wabasha County Board receives objective and unbiased legal advice and opinions on government structure, and;

Whereas, the Mohrman & Kaardal Law Firm has already performed extensive research and developed dependable and accurate opinions on this matter;

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Board Chair to enter into the Morhman & Kaardal Fee Agreement, accepting the terms of the agreement including the present fee (and costs) cap of $5,000.

(Strike second bullet in Retainer and Fee Agreement: "Assist the County Board in the process to consider a referendum question for civil counsel for the County Board on the ballot including assistance with public hearings regarding the ballot question.")

Resolution No.: 2012-079

Whereas, Minnesota Statutes Chapter 375 establishes the procedure and requires a process for redistricting County Commissioner districts based on population figures from the Federal Census; and,

Whereas, Minnesota Statute section 204B.135, subd. 2 requires that County Commissioner Districts be redistricted or reestablished within 80 days of when the legislature has been redistricted or at least 15 weeks before the state primary election, whichever comes first; and,

Whereas, pursuant to these statutes the 2010 Federal Census population figures shall be used to redistrict the Wabasha County Commissioner Districts by May 1, 2012, and that Commissioner Districts shall be bounded by town, municipal, ward, or precinct lines; and,

Whereas, the Wabasha County Board of Commissioners has considered the possibility or potential for maximizing minority representation on the board of commissioners; and,

Whereas, MN Statue 375.025 sub 1 states different laws regarding balancing of population in commissioner districts. Wabasha County current districts pass all criteria of MN Statue 375.025 see Exhibit A.

Now, Therefore Be It Resolved that the Wabasha County Board of Commissioners hereby reestablishes the boundaries of the County Commissioner's District and reestablishes the length of terms as follows:

District 1 - (4-year term, 2012 Election) Highland Township, Plainview Township, Watopa Township, Plainview City P1 and Plainview City P2

District 2 - (4-year term, 2014 Election) Chester Township, Gillford Township, Glasgow Township, Lake Township, Mt Pleasant Township, Pepin Township, West Albany Township, Bellechester City, Mazeppa City, and Zumbro Falls City

District 3 - (4-year term, 2012 Election) Elgin Township, Hyde Park Township, Mazeppa Township, Oakwood Township, Zumbro Township, Elgin City, Hammond City and Millville City

District 4 - (4-year term, 2014 Election) Greenfield Township, Minneiska Township, Kellogg City, Minneiska City, Wabasha City Ward 1, Wabasha City Ward 2, and Wabasha City Ward 3

District 5 - (4-year term, 2014 Election) Lake City Precinct 1,Lake City Precinct 2 and Lake City Precinct 3

Be It Resolved that the Wabasha County Board Chairperson is directed to file the reestablished plan with the County Auditor by May 1st, 2012, to be effective on June 1st, 2012, for the 2012 primary and general election and publish in the Wabasha County Herald.

Be It Finally Resolved that the districts are, for illustrative purposes, identified in a map of the county attached hereto and marked Exhibit B which by reference is hereby made a part hereof.

Whereas, the Wabasha County Sheriff's Office has been authorized to participate in the 2012 Federal Boating Safety Patrol Supplement Grant; and

Whereas, the Sheriff's Office has received the 2012 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and

Whereas, the Sheriff requests the approval and signing of the 2012 Minnesota Department of Natural Resources Federal Boating Safety Patrol Supplemental Grant by the County Administrator and Chairman of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2012 Minnesota Department of Natural Resources Federal Boating Safety Patrol Supplement Grant is hereby approved and authorizes it's signing by the County Auditor (Clerk to the County Board) and Chairman of the County Board.

Whereas, the Wabasha County Sheriff's Office has been authorized to participate in the 2012 State Boat and Water Safety Grant; and,

Whereas, the Sheriff's Office has received the 2012 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and,

Whereas, the Sheriff requests the approval and signing of the 2012 Minnesota Department of Natural Resources State Boat and Water Safety Grant by the County Administrator and Chairman of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2012 Minnesota Department of Natural Resources State Boat and Water Safety Grant is hereby approved and authorizes it's signing by the County Auditor (Clerk to the County Board) and Chairman of the County Board.

Resolution No.: 2012-082

Whereas, On April 10, 2012, the County Board discussed the merits of issuing a Request for Proposals (RFP) to examine Wabasha County's current compensation system; and

Whereas, the objective for this study would be to select, construct and establish a compensation system that aligns with the County's mission, vision and values as well as keeping the County in compliance with all relevant regulations; and

Whereas; at the time the discussion was tabled until April 24, 2012, to allow the Commissioners to have more time to review the RFP materials; and

Now, Therefore, Be It Resolved, The Wabasha County Board of Commissioners authorizes Deb Koenig to issue a Request for Proposals (RFP) for the Market Survey and Compensation Study, in a form to be consistent with the "Employee Classification, External Market Survey and Compensation Study" packet.
