Meeting of October 23, 2012


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, October 23, 2012 at 1:00 p.m.


The meeting was called to order by Board Chairman Harms.


The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,



Motion to approve the agenda, after striking "$30,000" from the 2014 union contract negotiations RFP item.

South Country Alliance gave a presentation and recognized Wabasha County for its 10-year partnership with South Country.



Resolution No.: 2012-209

Whereas, a 2000 Ford Taurus utilized by the Wabasha County Assessor's Office is being replaced with a 2009 Malibu from Wabasha County Social Services; and

Whereas, the Wabasha County Assessor's Office is requesting that the 2000 Ford Taurus be sold since it is considered excess property; and

Whereas, the Wabasha County Sheriff's Department regularly sells vehicles on eBay.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners authorizes the Wabasha County Sheriff to sell the 2000 Ford Taurus (VIN: 1FAFP5327YG249470) from the Wabasha County Assessor's Office.

Be It Further Resolved, funds from the sale shall be deposited to the Wabasha County Sheriff's squad car fund.

Resolution No.: 2012-210

Whereas, Minnesota Statute 273.061 declares that the terms of office as county assessor shall begin on January 1 of every fourth year after 1973.

Whereas, January 1, 2013 will begin a new term of office for county assessors statewide,

Whereas, Minnesota Statute also requires the Commissioner of Revenue to approve the appointment and the reappointment of all county assessors,

Whereas, the completed appointment form must be completed and returned to the Department of Revenue before January 1, 2013 in order for a county assessor re-appointee to be approved by the Commissioner of Revenue and meet the requirements stated in law.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners reappoints Loren Benz as assessor for Wabasha County for a four (4) year term commencing January 1, 2013.

Resolution No: 2012-211

Whereas, the Wabasha County Board is responsible for all personnel administration and policies; and

Whereas, the Wabasha County Board has the responsibility to represent the taxpayers interest in union contract negotiations; and

Whereas, the Wabasha County Board must evaluate and determine if it is in the best interest of the taxpayers to have the 2014 union contract negotiation executed by an independent or outside legal firm; and

Whereas, the Wabasha County Board desires additional information in making this determination; and

Whereas, past and/or occasional precedent has been established to utilize independent or outside legal representation in union contract negotiations for Wabasha County; and

Whereas, seeking outside legal counsel and the decision to do so is within the authority of the board; and

Whereas, the collection of Request for Proposals will provide thorough and necessary information to ensure the Wabasha County Board can render an objective and educated decision regarding the benefits and disadvantages of independent or outside legal representation as it pertains to union contract negotiations;

Now therefore be it resolved, that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Coordinator to solicit Request for Proposals for the purpose of 2014 union contract negotiations.

Resolution No.: 2012-212

Whereas, Buckshot Ridge, LLC has applied for a Conditional Use Permit for a cabin on parcel 04.00040.06 located in Section 6, Township 110 North, Range 11 West, Town of Glasgow ; and

Whereas, The Wabasha County Planning Commission has conducted a public hearing on the request on September 24, 2012; and

Whereas, the Planning Commission on a 4-0 vote wishes to forward the application to the Wabasha County Commissioners for consideration with a recommendation of approval.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the conditional use permit submitted by Buckshot Ridge, LLC for a cabin on property as described in the application.

Resolution No.: 2012-213

Whereas, Project CP 79-12-8030 – Furnish and Apply Chloride with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Envirotech Services Inc. in the amount of $9854.43.

Resolution No.: 2012-214

Whereas, November 6th 2012 is the State General Election date.

Whereas, if a recount is called by the Secretary State a Recount Agreement is needed between State of Minnesota and Wabasha County.

Whereas, State of Minnesota has drafted the Recount Agreement (attached).

Whereas, Assistant County Attorney, Michael Plante and Chief Election Official, Denise M Anderson have reviewed the agreement.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby authorizes Denise M Anderson, Chief Election Official, to sign the agreement with State of Minnesota dealing with a possible recount.

Resolution No.: 2012-215

Whereas, the appointment of the Wabasha County Medical Examiner is done annually; and

Whereas, on January 3, 2012, the Board appointed Dr. Pesch to perform those function; and,

Whereas, due to unforeseen circumstances Wabasha County is in need of another doctor to perform those services; and,

Whereas, per State Statute a medical examiner for the County must be appointed by the County Board;

Now, Therefore, Be It Resolved by the Wabasha County Board of Commissioners that Kent Jeffery is now appointed to serve as the County Medical Examiner under the same terms and conditions of the previous contract ($8,137 annually, prorated for the rest of the year) and that Dr. Thomas Peyla is appointed to continue to serve as the Assistant Medical Examiner.
