Meeting of March 19, 2013

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, March 19, 2013 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Hall.

 

The following Commissioners were present: Hall, Wobbe, Springer, Harms, Roschen

Motion to approve the agenda after moving Items F, I and J (J to be an action item) to the next Board meeting.

Resolution No.: 2013-058

Whereas, the Minnesota Housing Finance Agency, State of Minnesota, has been authorized to undertake a program to provide funds for Family Homeless Prevention & Assistance Projects; and,

Whereas, the Southeastern Minnesota Housing Network, working through: 1) Lutheran Social Services LINK Program 2) Olmsted Community Action, 3) Semcac, and 4) Three Rivers Community Action, has developed a renewal application for the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program; and

Whereas, the Southeastern Minnesota Housing Network through Lutheran Social Services LINK Program, Olmsted Community Action, Semcac, and Three Rivers Community Action has demonstrated the ability to perform the required activities of the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program;

Now, Therefore, be it resolved that the Southeastern Minnesota Housing Network is hereby authorized as an entity to be charged with the administration of funds made available through the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program in the County of Wabasha, in Minnesota.

Resolution No.: 2013-064

Whereas, Wabasha County Board and the Olmsted County Board held a joint meeting to discuss how to proceed to complete the creation of the Lake Zumbro Improvement District (LZID); and

Whereas, the Boards agreed to reestablish the Lake Zumbro Joint Powers Board (JPB) and the Joint Powers Agreement governing the activities of the Board; and

Whereas, those agreements have been completed which now requires Wabasha County to appoint two members to serve on the JPB; and

Now, Therefore, Be it Resolved that the Wabasha Board of Commissioners hereby appoints Commissioners Springer and Wobbe to serve on the above referenced Joint Powers Board.

Resolution No.: 2013-059

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes Wabasha County Highway Department to advertise for applicants for three - 2013 Part-Time Temporary Summer Employment Positions.

Resolution No.: 2013-060

Whereas, the Wabasha County Highway Department proposes to acquire land along the existing right of way of County State Aid Highway 30 for the purpose of the proposed construction under S.A.P. 079-630-015; and

Whereas, S.A.P. 079-630-015 is necessary in order to improve this segment of County State Aid Highway 30 to provide for public health, welfare, safety and convenience; and

Whereas, the lands necessary to be acquired for S.A.P. 079-630-015 were described in Wabasha County Highway Right of Way Plat No. 42; and

Whereas, the following additional lands to the Plat No. 42 are necessary to be acquired for S.A.P. 079-630-015:

That part of the Auditors Lot 11 being in the Northwest ¼ of the Northwest ¼ Section 10, Township 110 North, Range 10 West, Wabasha County, Minnesota described as follows: commencing at the Northwest corner of the Northwest quarter, thence S0º-14'-26"W distant 982.97 feet; thence S89º45''34"E distant 303.59 to the point of beginning; thence S74º-51'-23"W distant 25.00 feet; thence S15º-08'-37"E distant 100.00 feet; thence N74º-51'-23"E distant 25.00 feet; thence N 15º-08'-37"W distant 100.00 feet to the point of beginning and there terminating.

Containing 0.06 acres more or less.

 

That part of the Northwest ¼ of the Northwest ¼ Section 10, Township 110 North, Range 10 West, Wabasha County, Minnesota described as follows: commencing at the Northwest corner of the Northwest quarter, thence S0º-14'-26"W distant 949.81 feet; thence S89º-45'-34"E distant 424.11 to the point of beginning; thence S74º-51'-23"W distant 25.00 feet; thence S15º-08'-37"E distant 100.00 feet; thence N74º-51'-23"E distant 25.00 feet; thence N 15º-08'-37"W distant 100.00 feet to the point of beginning and there terminating.

Containing 0.06 acres more or less.

Now therefore be it resolved that the Wabasha County Board of Commissioners that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to proceed to acquire the necessary lands as described above in accordance with applicable laws and statutes.

WOBBE - ROSCHEN

Resolution No.: 2013-061

Whereas, the Minnesota Department of Transportation wishes to cooperate closely with local units of government to coordinate the delivery of transportation services and maximize the efficient delivery of such services at all levels of government; and

Whereas, Mn/DOT and local governments are authorized by Minnesota Statutes sections 471.59, 174.02, and 161.20, to undertake collaborative efforts for the design, construction, maintenance and operation of state and local roads; and

Whereas, the parties wish to be able to respond quickly and efficiently to such opportunities for collaboration, and have determined that having the ability to write "work orders" against a master contract would provide the greatest speed and flexibility in responding to identified needs.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners,

1. That the County of Wabasha enter into a Master Partnership Contract (mnDOT Agreement # 02858) with the Minnesota Department of Transportation, a copy of which was before the Board.

2. That the Chairman to the County Board and Clerk to the Board are authorized to execute such contract and any amendments thereto.

3. That the Wabasha County Engineer is authorized to negotiate work order contracts pursuant to the Master Contract, which work order contracts may provide for payment to or from Mn/DOT, and that the Wabasha County Engineer may execute such work order contracts on behalf of Wabasha County without further approval by the Wabasha County Board of Commissioners.

Resolution No.: 2013-062

Whereas, the Wabasha County Human Services Board created the position of Collections Officer in the Fall of 2009; and

Whereas, the filling of this vacancy is anticipated to result in a 2013 budget savings of approximately $2,900 as an individual will likely be hired at a salary less than the incumbent; and

Whereas, the development of a Collections Officer position has been shown to produce the desired results of the Human Services Board, by collecting more funds than the expense of the position, holding service recipients accountable for their portion of service expenditures; and

Whereas, the Director of Social Services recommends this vacancy be filled;

Now therefore be it resolved by the Wabasha County Board of Commissioners authorizes the Director of Social Services to fill the Collections Officer vacancy to maintain normal operations of the Social Services Department.

By consensus, the Board approved the Cargill Grant. Commissioner Roschen abstained.

 

SPRINGER - WOBBE

Resolution No.: 2013-063

Whereas, the Wabasha County Attorney's Office has provided prosecution services to the City of Plainview from April 2008 to present.

Whereas, the City of Plainview wishes to extend the contract for one year starting April 2013.

Whereas, the County Board of Commissioners, with the recommendation of the County Attorney that said contract be extended at a cost to the City of Plainview of $1,800.00 per month.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the chairman of the County Board and its Acting Board Clerk sign said contract upon receipt from the City of Plainview.
