Meeting of May 21, 2013

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 21, 2013 at 1:00 pm.

 

The meeting was called to order by Board Chairman Hall.

 

The following Commissioners were present: Hall, Wobbe, Springer, Harms, Roschen

Resolution Number: 2013-100

Whereas, Wabasha County government strives to provide convenient access to public data to all its taxpayers and the general public;

Whereas, Current applications which provide data access via the internet are unique to Wabasha County, have limitations to public users, and are not user friendly;

Whereas, Beacon, provided by the Schneider Corporation is a proven, all-inclusive solution that is currently being utilized in approximately 15 counties in Minnesota;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that authorize and enter into a 3 year-contract with the Schneider Corporation and MCCC for the creation of a Beacon Web Portal.

Resolution Number: 2013-101

Whereas, Wabasha County government strives to provide convenient access to public data to all taxpayers and the general public;

Whereas, The current application used to render building sketches is outdated, not easily deciphered by the general public, and not intuitive for staff use;

Whereas, Apex will provide an easily interpreted drawing that can be implemented with Beacon and shared with taxpayers.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that authorize the contract and purchase of Apex .

Resolution No.: 2013-085

Whereas, the Wabasha County Human Services Board has one (1) current vacancy in the position of Account Technician; and

Whereas, the filling of this vacancy is anticipated to result in a budget savings of approximately $1,500 (annualized) as the individual will likely be hired at a salary less than the incumbent; and

Whereas, the processing of payments to vendors, receipting funds for the Department, and completion of fiscal services are essential to the successful operation of the Department, benefiting the citizens of Wabasha County; and

Whereas, the Director of Social Services recommends this vacancy be filled;

Now therefore be it resolved by the Wabasha County Board of Commissioners, that the Director of Social Services hereby be authorized to fill the Account Technician vacancy to maintain normal operations of the Social Services Department.

Resolution No.: 2013-107

Whereas, Wabasha County is required under Minnesota Statute 471.6161 to solicit formal request for proposals (RFP) for employer paid dental insurance every five years; and

Whereas, Ochs Inc will provide all RFP services at no cost to the County.

Now Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby authorizes Ochs Inc to provide services to obtain dental insurance proposals for the County in order to stay in compliance with Minnesota Statute 471.6161.

Resolution No.: 2013-106

Now Therefore be it Resolved that Wabasha County enter into Mn/DOT Agreement No. 03636 with the State of Minnesota, Department of Transportation for the following purposes:

To provide for the State to enter upon County Right of Way to install Mississippi River Trail signing along the designated Mississippi River Trail route on County roadways and for the County to provide for proper maintenance of the route signing. Such work will be conducted under State Project No. 8826-139 (T.H. 61) and State Aid Project No. 091-060-103.

Be it further resolved that the Wabasha County Board of Commissioners Chair and the Clerk to the Board are authorized to execute the Agreement No. 03636 and any amendments to the Agreement.

Resolution No.: 2013-102

Whereas, the following applicant wishes to have its "1 to 4 Day Temporary On-Sale Liquor License" approved: Theilman Sportsman Club, 62643 261st AVE, Theilman, West Albany Township, and

Whereas, the liquor license will be in effect for July 3rd and 4th, 2013.

Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the "1 to 4 Day Temporary On Sale Liquor Licenses" to the Club listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner

Resolution No: 2013-103

Whereas, the following applicants wish to have their County On Sale and Off 3.2 Beer Licenses approved:

Whereas, the applications have been approved by the County Attorney and County Sheriff and have paid the required license fee. Term of license is from July 1, 2013 to June 30, 2014.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the renewal of 3.2 Beer License to the individuals listed above, subject to the approval of the State of Minnesota.

SPRINGER – HARMS

Resolution No.: 2013-104

Whereas, the Zumbrowatha Trails Snowmobile Clubs of Wabasha County request that Wabasha County be their local sponsoring unit of government for pass-through of MN DNR snowmobile trail system funding,

Now therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County act as the sponsor for an application for funding to the State of Minnesota Department of Natural Resources for development of maintenance of snowmobile trails managed by the clubs of Zumbrowatha Trails-Wabasha County for the 2013-2014 snow season,

Be it further resolved: that upon approval of its application by the state, that Wabasha County may enter into an agreement with the State of Minnesota for the above referenced project and that it will act as the pass-thru for funds to the clubs as outlined in the Assistance Program manual,

Be it further Resolved: that the County Auditor/Treasurer and/or Deputy Auditor/Treasurer is hereby authorized to serve as the fiscal agent for the above referenced project,

Be it further resolved: that Marvin Howatt is appointed to be a County Trail Coordinator to work with the county clubs and assist the county in administering this program.

Resolution No.: 2013-105

Whereas the State of Minnesota DNR along with Wabasha County has approved the Zumbrowatha Trails Association of Wabasha County's request for the County to act as the sponsoring unit of government for pass-through of funds to the snowmobile clubs for the 2013-2014 snow year as outlined in the Assistance Program Manual.

Therefore, be it resolved that the Wabasha County Commissioners enter into a County-Club contract with each of the five snowmobile clubs within the Zumbrowatha Trails Association to administer their club's portion of the trail system for the 2013-2014 snow year according to the regulations outlined in the attached contract. The five snowmobile clubs consist of the Zumbro Valley, Wabasha Driftskippers, Cliff & Coulee Climbers, Polar Barons and the Four Seasons.

Whereas, at some point in time, Wabasha County could be faced with employee layoffs and at present there is no provision for this action, and

Whereas, the Wabasha County Policy Committee has worked to create a Layoff Policy that includes creating a re-hire list, and

Whereas, the Wabasha County Policy Committee asks the Wabasha County Board to review and adopt the Layoff Policy (#214).

Now Therefore be it Resolved that the Wabasha County Board of Directors hereby adopts the attached Policy #214 Layoff Policy.

Resolution No.: 2013-108

The County Board of Wabasha County Ordains: Amending the Wabasha County Zoning Ordinance – Nonmetallic Mining and Reclamation (Chapters 6 and 24)

Whereas, Wabasha County is authorized to carry on County planning and zoning activities in the unincorporated areas of the County pursuant to Minn. Stat. Chapt. 394; and

Whereas, the Wabasha County Zoning Ordinance was adopted by the Wabasha County Board of Commissioners on July 17, 2001 and became effective on September 1, 2001 and amended on November 16, 2004, August 15, 2006 and November 16, 2010; and

Whereas, on August 2, 2011, by resolution 2011-153, the County Board adopted a moratorium to fully study the and evaluate the effects of silica sand mining operations and related processing and transportation facilities on the public health, safety; and

Whereas, since that time the Wabasha County Planning Commission has diligently studied the issue and has made recommended changes to the County Board; and

Whereas, both the Wabasha County Planning Commission as well as the Wabasha County Board of Commissioners has held public hearings to allow for all citizens to submit testimony regarding the proposed amended changes to the County's zoning ordinance; and

Whereas, the Wabasha County Planning has voted unanimously to recommend that the proposed amendments be adopted by the County Board of Commissioners:

Whereas, the Wabasha County Board of Commissioners deems it necessary to adopt the amended Chapter 6 and Chapter 24 of the Zoning Ordinance to promote the health and welfare of the County residents, and protect and preserve the environment and the quality of life in Wabasha County; and

Now Therefore Be It Resolved, that the Wabasha County Board of Commissioners has received and reviewed the recommendation of the Wabasha County Planning Commission for the passage of the amended zoning ordinance; and

Be It Further Resoslved, that the Wabasha County Board of Commissioners hereby adopts the amended Chapter 6 and Chapter 24 of the Wabasha County Zoning Ordinance relating to Nonmetallic Mining and Reclamation. (Attached as Exhibit #1).
