Meeting of June 4, 2013

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, June 4, 2013 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Hall.

 

The following Commissioners were present: Hall, Wobbe, Springer, Harms, Roschen

 

WOBBE - SPRINGER

Motion to approve the agenda.

Adopted Unanimously

 

There was a consensus of the Board to allow county employees to assist the 4-H program coordinator with county fair activities on work time, if done so with Department Head approval.

Donation of $1,000 from Conception Catholic Church Altar and Rosary Society to Public Health Special Needs Fund. 'Thank You' to Horizon Milling for improvements to recycling sheds.

Resolution No.: 2013-110

Whereas, Roger and Emily Smith have applied for a Conditional Use Permit to place a portable hunting shack on parcel R01.00226.03 located in the E ½ SE ¼, Section 25, Township 110 North, Range 14 West, Town of Chester ; and

Whereas, The Wabasha County Planning Commission has conducted a public hearing on the request on May 20, 2013; and

Whereas, the Planning Commission on a 3-0 vote wishes to forward the application to the Wabasha County Commissioners for consideration with a recommendation of approval.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit submitted by Roger and Emily Smith for a portable hunting shack on property as described.

Resolution No.: 2013-111

Whereas, Charles Kuehn has applied for a Conditional Use Permit for a cabin on parcel R11.00112.00 located in the SE ¼, Section 13, Township 111 North, Range 13 West, Town of Mount Pleasant ; and

Whereas, The Wabasha County Planning Commission has conducted a public hearing on the request on May 20, 2013; and

Whereas, the Planning Commission on a 3-0 vote wishes to forward the application to the Wabasha County Commissioners for consideration with a recommendation of approval.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit submitted by Charles Kuehn for a cabin on property as described.

Resolution No.: 2013-112

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Highway Committee will be comprised of two Commissioners: (Commissioner __________________ and Commissioner ________________), the County Engineer, and Highway Department Supervisors. Highway Department staff will participate as needed and requested.

Resolution No.: 2013-113

Whereas, On February 26, 2013, the Wabasha County Board of Commissioners established the Veteran's Service Officer Hiring Committee ("Committee") to recruit, interview, and recommend to the County Board suitable candidates to fill two positions within the Veteran's Service Office; and

Whereas, on May 13, 2013, the Wabasha County Board of Commissioners interviewed the top candidates to fill the position; and

Whereas, through that process the Wabasha County Board of Commissioners identified an individual to serve as the Veteran's Services Officer and the Assistant Veteran's Services Officer for Wabasha County; and

Now Therefore Be It Resolved, that the Wabasha County Board of Commissioners hereby formally offers the position of Veteran's Services Officer to Nathan Pelz. Pursuant to Minnesota Statute 197.60 Subd. 2 the term of the position shall be for four years with the first 12 months of the initial appointment being a probationary period. Additionally, Mr. Pelz will be placed at Step 1, Grade 5 of the Veteran's Services Officer Scale. Start date to be June 18, 2013.

Resolution No.: 2013-114

Now Therefore Be It Resolved, that the Wabasha County Board of Commissioners hereby formally offers the position of Assistant Veteran's Services Officer to Larry Larsen. Mr. Larsen will start at Step 1 of the Assistant Veteran's Services Officer Scale and shall be elevated to Step 2 after a 6 month probationary period and satisfactory performance review

SPRINGER - WOBBE

Resolution No.: 2013-115

Whereas, the Wabasha County Attorney's Office has provided prosecution services to the City of Plainview from April 2008 to present; and

Whereas, the Wabasha County Board of Commissioners extended the contract for one year which started April 1 2013; and

Whereas, the contract extension was done at a cost of $1,800.00 per month; and

Now Therefore be it Resolved by the contract be divided as follows: $1,800.00 per month paid to County, divided $750 a month to the County and $350 a month each attorney in the County Attorney's Office, with the prior months arrearages to be paid to the attorneys during the next pay cycle.

Clarification was asked for on the Cost of Living Adjustment for Non-Union Employees. The Board took no action but directed Deb Koenig, Finance Director, to bring back a new resolution specifying which positions qualified for the COLA increase.

Resolution No. 2013-116

A Resolution Setting Forth Findings

In Support of a Special Closed Meeting

Whereas, Minn. Stat. §13D.05 subd. 3(b) permits closing a County Board meeting if such closure is permitted by the attorney-client privilege;

Whereas, the County Board desires to consult with its attorney regarding the litigation/threat of litigation.

Whereas, the County Attorney has advised the Board that it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the plaintiff/party threatening litigation.

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel.

Whereas, in the closed session, the only subject to be discussed is the potential settlement of a claim made against the County.

Whereas, certain phases of the litigation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding a response to the litigation, and finds that such a discussion cannot be had in public session.

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be It Resolved, a special closed meeting of the County Board addressing the Potential settlement of a claim made against the County will be held with the County Attorney. No subject matter other than the foregoing shall be discussed at said meeting.
