Meeting of July 2, 2013

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, July 2, 2013 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Hall.

 

The following Commissioners were present: Hall, Wobbe, Springer, Harms, Roschen

Motion to approve the agenda.

Motion to approve the consent agenda including the following:

Resolution No.: 2013-136

Whereas, the Minnesota Government Data Practices Act (MGDPA) creates a presumption that all local government records are accessible to the public; and

Whereas, Minnesota Statutes, section 13.02, subdivision 16, requires that Wabasha County appoint an employee as the Responsible Authority to administer the requirements for collection, storage, use and dissemination of data on individuals within the county; and

Whereas, because of the threat of litigation by Commissioner Roschen against staff of the County Attorney's Office it is no longer feasible for their office to provide those services; and

Now therefore be it resolved, the Wabasha County Board of Commissioners hereby appoints _______________________ as the Responsible Authority for Wabasha County for the purpose of meeting all requirements of Minnesota Statutes, chapter 13, as amended, and with rules as lawfully promulgated by the Commissioner of Administration.

Resolution Not Needed

Michael Plante, Asst. County Attorney, has the authority to appoint a Responsible Authority for Wabasha County.

 

SPRINGER - HARMS

Resolution No.: 2013-128

Whereas, a 1999 Ford F150 squad vehicle (#05) with over 193,000 miles is considered a surplus; and,

Whereas, this vehicle was originally obtained through a DWI Forfeiture; and,

Whereas, the Wabasha County Sheriff's Office is requesting that this vehicle be sold on Ebay; and,

Whereas, the proceeds from the sale of this vehicle will be split pursuant to State Statute 169A.63, Subd. 10 (a1 & a2)_70% Sheriff/30% County Attorney and that the proceeds from the sale of this item be deposited back into the respective forfeiture funds.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized and directed to sell the 1999 Ford F150 (#05) bearing VIN #2FTRX18W1XCA04854 on Ebay as noted above.

Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the respective forfeiture fund accounts as noted above.

Resolution No. 2013-129

Whereas, a 2007 Dodge Durango vehicle (#87) with over 180,000 miles is considered a surplus; and,

Whereas, this vehicle has been replaced with a 2013 Dodge Durango (squad #08); and,

Whereas, the Wabasha County Sheriff's Office is requesting that this vehicle be sold on Ebay; and,

Whereas, the Wabasha County Sheriff's Office is requesting that the proceeds from the sale of this vehicle be deposited to the Squad Replacement fund.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized and directed to sell the 2007 Dodge Durango (#87) bearing VIN #1D8HB482X7F539518 on Ebay as noted above.

Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the Squad Replacement fund as noted above.

Resolution No.: 2013-130

Whereas, the Wabasha County Sheriff's Office uses many computer and information systems;

Whereas, a long term goal of the county is to improve public safety and increase efficiency by providing direct access to those systems by installing mobile data terminals in the county's squad cars;

Whereas, a project has been proposed that takes the next steps towards mobile data terminals, and the project will have other benefits to the county, local police departments, and the public;

Whereas, the County IT Director, the County Sheriff and the County PSAP Coordinator all recommend these purchases;

Now therefore be it resolved by the Wabasha County Board of Commissioners that the IT Director is hereby authorized to purchase equipment, software and licensing; and services not to exceed $75,000 to continue the project, to be paid from the capital fund designated for mobile data terminals.

Resolution No.: 2013-131

Whereas, the Training Room/EOC is in need of a projector permanently installed on the ceiling; and

Whereas, this equipment is an allowable purchase with the Radiological Emergency Preparedness grant that is available to the county; and

Whereas, the cost of the system for Wabasha County will be $2,740 and will be reimbursed after the quarter ends on September 30, 2013.

Now, Therefore, be it resolved that Wabasha County approves purchase and installation of the projector in the Training Room/EOC at the Criminal Justice Center.

Whereas, the applicants do have current food & beverage licenses issued by Wabasha County Public Health, and

Whereas, the applications have been approved by the County Attorney and County Sheriff. The Wabasha County Auditor/Treasurer has received the certificate of insurance and the appropriate license fee. The liquor license will run from August 1, 2013 to July 31, 2014.

Now therefore be it resolved that Wabasha County Board of Commissioners hereby approves the renewal of Liquor License to the individuals listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.

Resolution No: 2013-133

Whereas, The County Board of Commissioners of the County of Wabasha, State of Minnesota, desire to offer for sale certain parcels (listed below) of land that have been forfeited to the State of Minnesota for non-payment of taxes; and

• Parcel Number R22.02164.00, Sec 05 Twn 111 Ran 012, City of Lake City, Scottish Village at the Jewel Lot 5 Blk 1

• Parcel Number R26.00524.00, Sec 08 Twn 108 Ran 011, City of Plainview, East Plainview, Lot 7 Blk 2

Whereas, said parcels of land have been viewed by the Soil & Water Conservation District and have been classified as non-conservation lands as provided for in Minnesota Statutes 282.01.

Now, Therefore Be It Resolved, That the Wabasha County Board of Commissioners hereby certify that all parcels of land listed above have been viewed and comply with the Provisions of Minnesota Statutes 85.012, 92.461, 282.01, Subd 8, and 282.018 and other statutes that require the withholding of tax-forfeited lands from sale.

Be It Further Resolved That the Wabasha County Board of Commissioners hereby request approval from the Minnesota Department of Natural Resources for the sale of said lands.

ROSCHEN - WOBBE

Resolution No: 2013-134

Whereas, the County Board of Commissioners of the County of Wabasha, State of Minnesota, desires to offer for sale to the public, parcels of land that has forfeited to the State of Minnesota for non-payment of property taxes and listed on attached Tax Forfeited Land List 2012; and

Whereas, the County Board of Commissioners must determine the appraised value of the forfeited property to be sold. The sale price cannot be less than the appraised value.

Now, therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the appraised value on the Tax Forfeited Land List 2012.

ROSCHEN - HARMS

Resolution No: 2013-135

Whereas, four parcels of land have forfeited to the State of Minnesota for non-payment of taxes; and

Whereas, the Wabasha County Board of Commissioners desires to sell these parcels at a public auction.

Be it Resolved by the Wabasha County Board of Commissioners that: all parcels of tax forfeited land listed on Tax Forfeited Land List 2012 be classified as non-conservation land; that the basic sale price of each parcel on the Tax Forfeited Land List 2012 be approved and authorization for a public sale be granted; pursuant to M.S. 282.01; that the sale will be held at 10:00 a.m., Thursday, August 22, 2013 by the Wabasha County Auditor/Treasurer in the Commissioner's Room of the Wabasha County Courthouse, for not less than the basic sale price; and that the sale be cash/money order/check only; that the County Auditor/Treasurer is hereby directed to publish a notice of sale as provided by law.

Be it Further Resolved, that the conditions and terms of the public sale shall be as described in the list contained here-in and approved by the Wabasha County Board of Commissioners.
