Meeting of April 1, 2014

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, April 1, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

 

The following Commissioners were present:  Springer, Wobbe, Hall, Harms.  Absent:  Roschen

Whereas, Rochester Sand And Gravel, Division of Mathy Construction Co. is the lowest responsible bidder for S.A.P. 079-600-012.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County hereby accepts the bid of and awards a Contract to Rochester Sand And Gravel, Division of Mathy Construction Co. for S.A.P. 079-600-012 in the amount of $358,701 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Rochester Sand And Gravel, Division of Mathy Construction Co. for this work.

Resolution No.: 2014-104

Whereas, Fitzgerald Excavating & Trucking Inc. is the lowest responsible bidder for S.A.P. 079-598-026 and 079-611-031.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County hereby accepts the bid of and awards a Contract to Fitzgerald Excavating & Trucking Inc. for S.A.P. 079-598-026 and 079-611-031 in the amount of $824,400.75 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Fitzgerald Excavating & Trucking Inc. for this work.

Resolution No.: 2014-105

Whereas, Rochester Sand And Gravel, Division of Mathy Construction Co. is the lowest responsible bidder for S.A.P. 079-609-011.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County hereby accepts the bid of and awards a Contract to Rochester Sand And Gravel, Division of Mathy Construction Co. for S.A.P. 079-609-011 in the amount of $1,841,472.88 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Rochester Sand And Gravel, Division of Mathy Construction Co. for this work.

Resolution No.: 2014-106

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County hereby accepts the proposal of Contech Engineered Solutions LLC for the 2014 Corrugated Metal Culvert Materials in the amount of $28,282.16 and that the Chairman of the County Board and the Clerk to the Board are hereby authorized to execute a Contract with Contech Engineered Solutions LLC for these materials.

Resolution No.: 2014-107

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Department be authorized to order Regular Road Salt through the State of Minnesota as a Cooperative Purchasing Venture Member for the 2014/2015 winter season.

Resolution No.: 2014-108

Whereas, the County of Wabasha is planning to implement County State Aid Highway projects in 2014 which will require State Aid funds in excess of those available in its State Aid Regular Construction Account, and

Whereas, said County is prepared to proceed with the construction of said projects through the use of an advance from the County State Aid Construction Fund to supplement the available funds in their State Aid Regular Construction Account, and

Whereas, the advance is based on the following available balances and estimated expenditures:

Regular Account Balance available as of date 3/24/2014               $575,149

Estimated disbursements:

Whereas, repayment of the funds so advanced will be made in accordance with the provisions of Minn. Stat. 162.08, Subd. 5 & 7 and Minn. Rules, Chapter 8820, and

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Commissioner of Transportation be and is hereby requested to approve this advance for financing approved County State Aid Highway projects of the County of Wabasha in an amount up to $1,424,851 in accordance with Minnesota Rules 8820.1500, Subp. 9 and hereby authorize repayments from subsequent accruals to the Regular Construction Account of said County from future year allocations until fully repaid.

Resolution No.: 2014-109

Whereas, Fitzgerald Excavating & Trucking Inc. is the lowest responsible bidder for S.A.P. 079-598-025.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County hereby accepts the bid of and awards a Contract to Fitzgerald Excavating & Trucking Inc. for S.A.P. 079-598-025 in the amount of $144,256.50 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Fitzgerald Excavating & Trucking Inc. for this work.

Resolution No.: 2014-110

Whereas: Integrated comprehensive watershed planning will benefit the water resources of the Zumbro River Watershed.

Whereas: Planning and implementation at the watershed scale will likely improve efficiencies and reduce county costs.

Whereas:  The 6 counties, 6 SWCD's and Bear Valley WD in the Zumbro River Watershed already have a long and successful history of cooperation for resource protection and enhancement,

Whereas: State  grant funding is now available for counties, SWCD's, and watershed districts who wish to cooperate in a pilot watershed planning effort,

Whereas: Participating in the One Watershed One Plan pilot will provide funding for plan development and if successful, may  increase our potential for future statewide funding sources,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, be it resolved, that Wabasha County/SWCD will participate in the grant application for the One Watershed One Plan Pilot Program

Be it further resolved, that if the state grant is awarded,   Wabasha County/SWCD will enter into a cooperative Joint Powers Board Agreement similar to the attached agreement; "Example Agreement for Zumbro Watershed Planning"

Resolution No.: 2014-111

Whereas, the old courthouse at 625 Jefferson Ave has several electrical panels installed that are of a type with a history of dangerous failures;

Whereas, the county IT Director has requested quotes for replacement;

Whereas, quotes have been received and reviewed;

Now therefore be it Resolved by the Wabasha County Board of Commissioners that the IT Director is hereby authorized to accept the quote for parts, labor and inspection from Passe Electric in the amount of $11,676.00.

SPRINGER - WOBBE

Resolution No.:  2014-112

Whereas, Wabasha County Emergency Management develops and maintains a county-wide All-Hazard Emergency Operations Plan (EOP) that must and does contain at least 18 Superfund Amendments and Reauthorization Act of 1986 (SARA) Title III items listed in the Local Emergency Operations Plan Crosswalk;

Whereas, said EOP is updated then reviewed yearly by a 4-year-cycle review process developed by the Minnesota Division of Homeland Security and Emergency Management;

Whereas, by executing the EOP, the Wabasha County Board of Commissioners approves of its use as a tool with which to refer to when officials respond to all types of hazards within Wabasha County;

Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes execution of the 2014 Wabasha County All-Hazard Emergency Operations Plan (EOP) with its revisions and updates by signing the EOP Certification of Plan Approval page.

Resolution No.: 2014-113

Whereas, the Wabasha County Human Services Board has accepted the resignation of Megan Gosse effective March 26, 2014; and

Whereas, Ms. Gosse has been employed by Wabasha County Social Services as a Child Support Officer; and

Whereas, the Wabasha County Human Services Board has approved the filling of the vacancy created by Ms. Gosse's resignation;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Director of Social Services hereby be authorized to fill the Child Support Officer vacancy in order to maintain normal operations of the Social Services Department.

It was the consensus of the Board that all Child Support Officers could work up to 40 hours per week until a new CSO is hired.

Commissioners reported on meetings they attended.

 

Resolution No.: 2014-114

Whereas, Minn. Stat. §13D.01 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult with its attorney regarding the best course of action to take during the upcoming labor negotiations.

Whereas, the County Attorney has advised the Board that it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the opposing party

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel.

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session.

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be It Resolved a closed meeting of the County Board addressing the labor negotiation strategy will be held with the County Attorney and other County staff. No subject matter other than the foregoing shall be discussed at said meeting.

It was the consensus of the Board to not go into closed session for labor negotiations.
