Meeting of May 27, 2014


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 27, 2014 at 9:00 a.m.


The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms. Absent: Roschen

Resolution No: 2014-143

Whereas, the following applicants wish to have their County On Sale and Off 3.2 Beer Licenses approved:

On Sale
Dan Preble Mazeppa Area Jaycees West Albany Township
Steven Schwen Oak Center General Store Gillford Township
On & Off Sale
Roy Eggenberger Roy's Tavern West Albany Township

Whereas, the applications have been approved by the County Attorney and County Sheriff and have paid the required license fee. Term of license is from July 1, 2014 to June 30, 2015.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the renewal of 3.2 Beer License to the individuals listed above, subject to the approval of the State of Minnesota.

Resolution No.: 2014-144

Whereas, the Zumbrowatha Trails Snowmobile Clubs of Wabasha County request that Wabasha County be their local sponsoring unit of government for pass-through of MN DNR snowmobile trail system funding.

Now therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County act as the sponsor for an application for funding to the State of Minnesota Department of Natural Resources for development of maintenance of snowmobile trails managed by the clubs of Zumbrowatha Trails-Wabasha County for the 2014-2015 snow season.

Be it further resolved: that upon approval of its application by the state, that Wabasha County may enter into an agreement with the State of Minnesota for the above referenced project and that it will act as the pass-thru for funds to the clubs as outlined in the Assistance Program manual.

Be it further Resolved: that the County Auditor/Treasurer and/or Deputy Auditor/Treasurer is hereby authorized to serve as the fiscal agent for the above referenced project.

Be it further resolved: that Marvin Howatt is appointed to be a County Trail Coordinator to work with the county clubs and assist the county in administering this program.

Resolution No.: 2014-145

Whereas the State of Minnesota DNR along with Wabasha County has approved the Zumbrowatha Trails Association of Wabasha County's request for the County to act as the sponsoring unit of government for pass-thru of funds to the snowmobile clubs for the 2014-2015 snow year as outlined in the Assistance Program Manual.

Therefore, be it resolved that the Wabasha County Commissioners enter into a County-Club contract with each of the five snowmobile clubs within the Zumbrowatha Trails Association to administer their club's portion of the trail system for the 2014-2015 snow year according to the regulations outlined in the attached contract. The five snowmobile clubs consist of the Zumbro Valley, Wabasha Driftskippers, Cliff & Coulee Climbers, Polar Barons and the Four Seasons.

Resolution No.: 2014–146

Whereas, the parcels listed below forfeited to the State of MN on 05/27/11 due to delinquent taxes.

• Parcel Number R27.01306.00, Wabasha Business Park, Sec 32 Twn 111 Ran 010, 1.77 Ac, Lot 2 Blk 2

• Parcel Number R27.01307.00, Wabasha Business Park, Sec 32 Twn 111, Ran 010, 3.40 Ac, Lot 3 Blk 2

• Parcel Number R27.01308.03, Wabasha Business Park, Sec 32, Twn 111, Ran 010, 1.35 AC, SEly 150' of Lot 4 Blk 2

Whereas, the City of Wabasha adopted resolution # 788 on 06/06/11 applying special assessments to the above parcels once the parcels are back in private ownership. The City also adopted resolution # 7 – 2012 on 03/06/12 authorizing Wabasha Port Authority to negotiate on behalf of City Council the special assessment amount.

Whereas, the Wabasha County Auditor/Treasurer had a public auction on 01/18/12 to sell the parcels listed above but at the sale there were no interested buyers.

Whereas, the Auditor/Treasurer and Assessor have been meeting with the City of Wabasha regarding the forfeited parcels. City of Wabasha has informed the Auditor/Treasurer that they are removing the current amount of special assessments that are applied to the parcels and will be assessing a different amount against the parcels.

Whereas, Minn. Stat. § 282.01, subd. 3, para. (a) states that all nonconservation tax-forfeited land must be sold unless the county board determines it is not advisable to do so. The county board may decide that the parcels in question should not be sold at this time because of the changes in the special assessments.

Now, Therefore, Be It Resolved that the Wabasha County Board of Commissioner's hereby removes the above listed parcels from the sales list until more information can be received from the City.

Resolution No.: 2014–147

Whereas, the Commissioner of Natural Resources of the State of Minnesota has made application under authority of M.S.A. Section 282.01, subd. 1 on behalf of the Department of Natural Resources, a state agency, for release of the following described lands from the trust in favor of the taxing district:

PID # R07.00177.00

Tax Description: 5.00 acres, Section 22 Township 109 Range 013, SW1/4NE1/4 AUD LOT 12, DOC # 263060

Full Legal Description: Commencing one hundred and twenty rods (1980.00 feet) south of the quarter section stake on the north line of Section Twenty two. Town one hundred and nine North. Range thirteen West: thence running thirty one rods (511.50 feet) east: thence twenty six rods (429.00 feet) south: thence thirty one rods (511.50 feet) west: thence twenty six rods (429.00 feet) north to the place of beginning- being in Section Twenty two.

Whereas, Commissioner of Natural Resources provided Wabasha County Auditor/Treasurer an "Option for the Purchase of Real Estate and Memorandum of Conditions" for consideration. Wabasha County Auditor/Treasurer recommends the Wabasha County Board sign the "Option".

Whereas, Wabasha County Attorney has reviewed the "Option" and has no legal concerns with the document.

Now, Therefore, Be It Resolved that the Wabasha County Board of Commissioners hereby authorizes Wabasha County Board Chairperson and Interim County Administrator sign the "Option for the Purchase of Real Estate and Memorandum of Conditions".

Resolution No.: 2014-148

Whereas, AAA Striping Service Company is the lowest responsible bidder for S.P. 079-070-006; Minn. Proj. HSIP 7914 (120).

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

Wabasha County hereby accepts the bid of and awards a Contract to AAA Striping Service Company for S.P. 079-070-006 in the amount of $231,280.16 and that the Chair of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with AAA Striping Service Company for this work.

Resolution No. 2014-149

Whereas, the Wabasha County Negotiation Team met in negotiations and mediation with the Teamsters #320 Law Enforcement unit, and;

Whereas, the parties have reached a Tentative Agreement, and;

Whereas, the County Board has reviewed the agreement and it met with their unanimous approval, and

Whereas, the Teamsters Law Enforcement unit staff have voted to accept the agreement as presented

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners approves the adoption of the attached agreement (Exhibit #1).
