Meeting of October 21, 2014


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, October 21, 2014 at 9:00 a.m.


The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms, Roschen

Administrator's Update: the County Administrator provided a public summary of his Performance Evaluation, which was drafted by the County Attorney's Office.

Resolution No.: 2014-225

Whereas, on October 13, 2014, the City of Lake City voted to enter into a contract for prosecution services with the Wabasha County Attorney's Office;

Whereas, the Wabasha County Attorney's Office believes such a contract would be beneficial to both the city and the county;

Whereas, the County Board wants to decrease the budget of departments to offset a budget shortfall;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Attorney's Office to enter into a contract for prosecution services as outlined in the attached contract. The entire value of the contract shall go into the County Attorney's budget to offset salary costs.

Resolution No.: 2014-226

Whereas, the Wabasha County Attorney's Office has provided prosecution services to the City of Plainview since 2009;

Whereas, a portion of that contract has been paid to each attorney in the form of a monthly stipend;

Whereas, the County Board wants to decrease the budget of departments to offset a budget shortfall;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby to allow the entire value of the contract for the prosecution of cases for the City of Plainview to go into the budget of the Wabasha County Attorney's Office to offset salary costs. The past practice of paying a monthly stipend to the attorneys shall cease.

Resolution No. 2014-227

Whereas, the County desires professional legal services in the area relating to Minnesota Government Data Practices Act; and

Whereas, the firm of Ratwik, Roszak, & Maloney provides such services to Counties, and has the skill and expertise necessary to perform the duties as set forth in the attached retainer agreement;

Whereas, The Firm shall provide consultation and advice on issues relating to the Minnesota Government Data Practices Act, including responses to requests for information and data, review of government data, and acting as the County's designee for responding to data if requested. The primary attorneys to render such advice will be Ann Goering and Erin Benson, or their delegates.

Now Therefore Be it Resolved by the Wabasha County Board that County enter into the retainer agreement with Ratwik, Roszak, & Maloney. to provide the above described services.

Resolution No. 2014-228

Whereas, over the past year Wabasha County has engaged in negotiations with the various unions within Wabasha County; and

Whereas; during the course of those negotiations the County identified the need and trend toward requiring employee contributions towards single coverage health care; and

Whereas; to that end Wabasha County has secured employee contributions in all of the settled union contracts which call for employee contributions of %5 in 2015, %10 in 2016 towards the base single coverage health care plans;

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that effective immediately, the County shall implement the following changes to the insurance plans listed below:

For single coverage Wabasha County shall pay the full cost of coverage for all regular full-time Employees for the base group hospital and medical insurance deductible plan in 2014, 95% of the cost in 2015, and 90% of the cost in 2016 (currently $250 deductible, $10 generic drug plan.) The County shall pay 80% of the family coverage premium cost for the base deductible plan (currently $250 deductible, $10 generic drug plan.) Any additional cost of the premium shall be paid by the Employee through payroll deduction.

Motion to close open meeting and go into closed session.

Resolution No. 2014-229

Whereas, Minn. Stat. ยง13D.05 subd. 3(b) permits closing a County Board meeting if such closure is permitted by the attorney-client privilege;

Whereas, the County Board desires to consult with its attorney regarding a settlement offer that was received from the Board of Water and Soil Resources; and

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting; and

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel; and

Whereas, certain phases of the litigation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be It Resolved, a closed meeting of the County Board addressing the above referenced concerns will be held with the County's counsel. No subject matter other than the foregoing shall be discussed at said meeting.
