Meeting of July 28, 2015

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, July 28, 2015 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Wobbe.

The following Commissioners were present: Goihl, Hall, Key, Wobbe. Absent: Springer

Resolution No.: 2015-168

Whereas, Wabasha County maintains a position classification plan that allocates each position within the County covered to its appropriate class (pay grade) ; and

Whereas, recently Wabasha County had the position of Human Resources Generalist reviewed by an outside consultant to determine the proper placement of the position on the County's classification plan; and

Whereas; that review recommends that the position is placed on Pay Grade 7;

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners places the position of Human Resources Generalist on Pay Grade 7 and assigns the position 402 points..

Resolution No.: 2015-152

Whereas, Wabasha County is a members of Southeastern Minnesota Emergency Services Joint Powers Board (JPB); and

Whereas, the JPB has identified the need to update the current joint powers agreement that has not been reviewed since 2007; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners agrees to ratify the revised joint powers agreement included in the Board packet.

Resolution No.: 2015-153

Whereas, the position of Paralegal/Victim-Witness Coordinator became vacant on July 5, 2015;

Whereas, Wabasha County Attorney Karrie S. Kelly met with the Personnel Committee on July 21, 2015 and received approval to advertise and interview applicants to fill the position.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves advertising and interviewing applicants to fill the position of Paralegal/Victim-Witness Coordinator.

Resolution No.: 2015-154

Whereas, the Wabasha County Assessor's Office has two current vacancies in the position of appraiser due to Penny Schmit being hired as the Assessor and one due to the resignation of Shelly Schad.

Whereas, prior to the vacancies the Assessor's Office had three full time appraisers

Whereas, the Wabasha County Assessor's office would like to hire two appraisers from the current posting to fill both positions

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Assessor is authorized to fill both vacancies to maintain normal operations of the Assessor's Office.

Presentations for 2016 budget appropriation requests were made by: Wabasha County Fair, SMIF, Southern MN Tourism Association, Whitewater Watershed Project, SEMCAC and S&WCD.

Resolution No.: 2015-155

Whereas, the Board authorizes the Veteran Service Office to purchase a new van, for the transportation of veterans to the VA Medical Center, from Dodge of Burnsville, which was the lowest bidder at $20,266.00

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

The Veteran Service Office is to purchase a new van from Dodge of Burnsville at a cost of $20,266.00.

Resolution No.: 2015-156

Whereas, SAP 079-598-026 and SAP 079-611-031 with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Fitzgerald Excavating and Trucking Inc. for completion of Project SAP 079-598-026 and SAP 079-611-031 in the amount of $38,480.82.

Resolution No.: 2015-157

Whereas, Bennett & Sons Sand & Gravel Company is the lowest responsible bidder for SAP 079-599-077.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Bennett & Sons Sand & Gravel Company for SAP 079-599-077 in the amount of $322,093.38 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Bennett & Sons Sand & Gravel Company for this work.

Resolution No.: 2015-158

Whereas, the Wabasha County Board of Commissioners has previously authorized and levied a wheelage tax as provided in Minnesota Statutes 163.051, and

Whereas, the Wabasha County Board of Commissioners has desired to use the revenue generated from the enacted wheelage tax for County Highway projects.

Now Therefore Be It Resolved that the Wabasha County Board of Commissioners that the revenue generated from the enacted County wheelage tax be used for on-going and future County Highway pavement preservation projects.

Resolution No.: 2015-159

Whereas, the following applicants wish to have their County License approved:

License to Collect and Transport Solid Waste and Recyclables

Lake City Recycling Disposal, Lake City MN 55041

Wabasha Rubbish Removal, Wabasha MN 55945

Rommel Rubbish, Kellogg MN 55945

Advanced Disposal, Rochester MN 55984

Whereas, the applicants do have current licenses issued by Wabasha County, and

Whereas, the applications have been approved by the County Zoning Administrator. The Zoning Administrator has received the certificate of insurance and the appropriate license fee. The license will run to December 31, 2015.

Now therefore be it resolved that Wabasha County Board of Commissioners hereby approves the renewal of License to collect and Transport Solid Waste and Recyclables to the individuals listed above.

Resolution No.: 2015-160

Whereas, the County has entered into a Service Agreement with La Crosse County, La Crosse, WI, for delivery of solid waste from Wabasha County to Xcel Energy, French Island, La Crosse, WI; and

Whereas, the County has been delegated the authority to enter into a delivery contract with the solid waste haulers in order to assure a supply of solid waste to a solid waste disposal facility that meets the County's environmental and other policy objectives, pursuant to Minnesota Statutes, Sections 471.59, 115A et. seq.; and

Whereas, the solid waste haulers that desire to operate in Wabasha County have signed a contract with the County to deliver waste to a Facility that meets the County's environmental and other policy objectives.

Now Therefore Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the 2015-2020 Wabasha County Waste Delivery Contract with each of the solid waste haulers listed in the attached documents.

Be It Further Resolved, that any solid waste hauler that does not enter into a contract with Wabasha County for the delivery of solid waste to a disposal facility that meets the County's environmental and other policy objectives will be prohibited from collecting household solid waste in Wabasha County.

The Board discussed options for supplementary collection of recyclables and directed Environmental Services director, Kevin Krause, to send out an RFP.

Finance Director, Deb Koenig, presented the quarterly financial reports of budget, investments and cash flow.

Whereas, The County Board of Commissioners of the County of Wabasha, State of Minnesota, desire to offer for sale certain parcels (listed below) of land that have been forfeited to the State of Minnesota for non-payment of taxes; and

Whereas, said parcels of land have been viewed by the Soil & Water Conservation District and Wabasha County Environmental Services and have been classified as non-conservation lands as provided for in Minnesota Statutes 282.01.

Now, Therefore Be It Resolved that the Wabasha County Board of Commissioners hereby certify that all parcels of land listed above have been viewed and comply with the Provisions of Minnesota Statutes 85.012, 92.461, 282.01, Subd 8, and 282.018 and other statutes that require the withholding of tax-forfeited lands from sale.

Be It Further Resolved that the Wabasha County Board of Commissioners hereby request approval from the Minnesota Department of Natural Resources for the sale of said lands.

Resolution No.: 2015-162

Whereas, the Wabasha County Administrator has accepted the retirement of Judy Siebenaler effective July 31, 2015 on behalf of the Wabasha County Board of Commissioners; and

Whereas, Ms. Siebenaler has been employed by Wabasha County Social Services as a Family Service Aide for 29 years; and

Whereas, the County would like to recognize the contributions Ms. Siebenaler has made to support the children and families of our community both through her work in general and in her role as Coordinator of the Wabasha County Youth Link Mentorship Program;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the retirement of Judy Siebenaler is accepted, with reluctance and regrets, and in appreciation of her dedication to improve the lives of the children and families of our community.

Resolution No.: 2015-163

Whereas, Wabasha County is required to do design review and inspections on type IV septic systems, and

Whereas, Current staff does not hold the level of certification to do design review and inspections on type IV systems or systems over 2,500 gallons of flow per day, and

Whereas, It has been determined to not be cost effective, at this time to have staff trained to this level, due very low number of such systems that have been installed requiring intermediate or advanced level certification, and

Whereas, There is a private contractor, Gopher Septic who has staff with this level of certification and they are willing to contract with the county for this service, on an occasional basis,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County approve the contract brought forward for Gopher Septic to provide this service at the request of Wabasha County staff. It is understood that this is not an exclusive contract and the county may contract with other vendors in addition to Gopher Septic

Resolution No.: 2015-164

Whereas, Wabasha County Public Health has a current State Health Improvement Program grant which expires October 31, 2015 and,

Whereas, Minnesota Department of Health has offered the opportunity for Wabasha County Public Health to apply for a continuation of that grant to run from November 1, 2015-Oct 31,2020, and

Whereas, there is no county levy dollars required to be utilized to meet the grant duties of the SHIP program,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County Public Health apply for the Nov. 1, 2015 through October 31, 2020 State Health Improvement Program grant .

Resolution No.: 2015-165

Whereas, Minnesota Department of Transportation has awarded Wabasha County Public Health a $21,175 Towards Zero Death grant, and

Whereas, Wabasha County Public Health has been successfully collaborating with law enforcement for several years in the implementation of Towards Zero Death program, and

Whereas, no county tax levy dollars goes into supporting grant activity duties;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

Wabasha County Public Health accept $21,175 Toward Zero Death Grant for the time period of October 1 ,2015 through September 30, 2016

Discussion was held in regard to drafting a Public Non-Community Water Supply Ordinance.

Resolution No.: 2015-166

Whereas, Ashley Lang, PHN is expecting to deliver her baby August 14, 2015 and

Whereas, Ashley has not been an employee of Wabasha County long enough to qualify for FMLA or parental leave, and

Whereas, Ashley would like to take an 8 week unpaid leave following the birth of her baby, and current county policy allows up to 12 weeks,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Ashley Lang be granted an 8 week unpaid leave beginning with the date of the delivery of her baby.
