Meeting of August 4, 2015

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, August 4, 2015 at 9:00 a.m.

 

The meeting was called to order by Board Vice Chairman Hall.

The following Commissioners were present: Goihl, Hall, Key, Springer. Absent: Wobbe

Whereas, the Wabasha County Sheriff's Office has been a member of the Southeastern Minnesota Drug Task Force for over 20 years; and,

Whereas, the current Joint Powers Agreement needed to be modified due to a name change from South East Minnesota Gang Task Force (SEMNGTF) to South East Minnesota Violent Crime Enforcement Team (SEMVCET); and,

Whereas, the Sheriff's Office has received the modified Joint Powers Agreement between the South East Minnesota Violent Crime Enforcement Team (SEMVCET) and the Wabasha County Sheriff's Office which needs to be approved and signed by the County Board Chairperson; and,

Whereas, the Sheriff requests the approval and signing of the Joint Powers Agreement between the South East Minnesota Violent Crime Enforcement Team (SEMVCET) and the Wabasha County Sheriff's Office by the Chairman of the County Board.

Now, Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Joint Powers Agreement between the South East Minnesota Violent Crime Enforcement Team (SEMVCET) and the Wabasha County Sheriff's Office is hereby approved and authorizes it's signing by the Chairman of the County Board.

Resolution No.: 2015-183

Whereas, the Wabasha County Board has previously approved the hiring of a child protection social worker; and

Whereas, Teryl Scharpen is currently employed as a social worker in another area of the department and has submitted an interest bid for this position; and

Whereas, after completing the internal bidding process and in consultation with the Social Services Supervisor, the Social Service Director is recommending that Teryl Scharpen be appointed to fill this position;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, it hereby authorizes the Social Services Director to appoint Teryl Scharpen to the child protection social worker position effective this date.

Resolution No.: 2015-170

Whereas, in 2012, Wabasha County Board had a public hearing regarding a Brew Pub Off Sale Intoxicating Liquor License to Reads Landing Brewing Company (RLBC) and the Board unanimously approved RLBP's request.

Whereas, MN Statue §340A.22 Sub 6, has recently been amended as follows: "malt liquor in growlers may only be sold at off-sale on Sundays. Sunday sales must be approved by the licensing jurisdiction and hours may be established by those jurisdictions."

Whereas, RLBC is asking the Board to add Sunday to the Brew Pub Off Sale Intoxication Liquor License.

Whereas, Wabasha County Auditor/Treasurer published a public hearing date in the Lake City Graphic, Plainview News and Wabasha County Herald, regarding the hours of operation for Sunday Growler Sales dealing with Brew Pub Off Sale License. Wabasha County Board of Commissioners held a public hearing on 08/04/15 at 9:15 am to hear concerns from interested parties on setting the hours of Sunday Growler Sales.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves setting hours of operation for Wabasha County – Sunday Growler Sales dealing Brew Pub Off Sale License as set accordingly to Sunday On Sale MN Statue §340A.504.

Andru Peters gave an update on the SMART Regional Trail System.

Will Harrington updated the Board about the Great River Ridge Trail.

Resolution No.: 2015-171

Whereas, SAP 079-596-009 with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Fitzgerald Excavating and Trucking Inc. for completion of Project SAP 079-596-009 in the amount of $23,582.73.

Whereas, Project CP 79-15-8150 – Furnish and Apply Chloride with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Envirotech Services Inc. in the amount of $6834.45.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for SAP 079-628-001 and SAP 079-628-002.

Resolution No.: 2015-174

Whereas, the Wabasha County Highway Department proposes to acquire property in addition to the existing right of way of County State Aid Highway 28 for the purpose of improvements under projects SAP 079-628-001 and 079-628-002; and

Whereas, improvements under projects SAP 079-628-001 and 079-628-002 are necessary in order to improve this segment of County State Aid Highway 28 to provide for public health, welfare, safety and convenience; and

Whereas, existing right of way through the project area and adjacent properties along County Highway 28 is presently a prescriptive easement; and

Whereas, a document of Record would more better define the existing prescriptive easement; and

Whereas, the property necessary to be acquired for improvements and existing right of way for projects SAP 079-628-001 and 079-628-002, and through adjacent properties are described in the attached document "County Highway 28 Right of Way Descriptions" labeled as Description 1 through 6.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the County Highway Engineer is hereby authorized to proceed to acquire the property as described above in accordance with applicable laws and statutes.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for SAP 079-601-029, SAP 079-607-023, and CP 079-086-006.

Resolution No.: 2015-176

Maintenance Agreements with Cities for 2016 (Option A)

Whereas, Wabasha County is obligated to maintain County State Aid Highways within cities throughout the County, and

Whereas, it is more expedient for the citizens of the listed cities to have those cities perform the maintenance activities of snow and ice control and removal, and sweeping and removal of debris.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the County of Wabasha enter into the attached agreements for the maintenance activities described above with the City of Elgin, Kellogg, Mazeppa, Millville, Plainview and Wabasha, and authorizes the Chair of the Board and County Administrator to execute the Agreements. The table below is a summary of the mileages and payment amounts of the agreements.

Resolution No.: 2015-178

Whereas, Brent Beck submitted a preliminary and final plat to expand parcel R07.00243.00 located in the NW ¼, Section 13, Township 109 North, Range 13 West, Town of Hyde Park; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on July 27, 2015 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter and with a vote of 5-0 recommends to the Wabasha County Commissioners the preliminary and final plat be approved without conditions.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves Deer Valley Estates 2 Plat without conditions.

Resolution No.: 2015-179

Whereas, Wabasha County has adopted a Zoning Ordinance pursuant to Minn. Stats. 394.21 for the purpose of promoting the health, safety, morals, and general welfare of the community; and

Whereas, Uniform application of the Zoning Ordinance is critical to provide fairness to every property owner of Wabasha County; and

Whereas, The use of a citation can be an effective tool in the administration of the Zoning Ordinance to achieve compliance.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners by a majority vote approves of the Wabasha County Citation Schedule for Zoning Violations as attached.

Resolution No.: 2015-180

Whereas, The IT Department has requested capital funds annually to maintain and improve the county's data network,

Whereas, the IT Department has designed a project that will provide additional capacity for networked equipment in the Criminal Justice Center, will enhance emergency response capabilities, and will improve the resiliency of the county's data networking for disaster recovery,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the IT Director is authorized to spend capital funds to purchase a network switch, various interface and communication modules, along with any appropriate accessories, cables, licenses and services, up to a limit of $10,000,

Resolution No.: 2015-181

Whereas, there is a need to add 2 new fees to the Wabasha County fee schedule for new services that will be provided by Public Health Environmental Services, and

Whereas, these fees are to recuperate the cost of providing services to specific individuals or businesses,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the following be added to the Wabasha County fee schedule effective today:

1. Permit for type IV septic system or septic systems with a flow rated over 2,500gallons per day-base fee of $700, plus $65/hour for any additional inspections or services needed due to design flaws or installation issues.

2. Annual fee to public non-community water supply facilities of $125.00 base fee plus an additional $50/well. In addition there would be our usual trip fee of $75 for each required retest due to poor water quality or reinspection required for non-conforming sanitary survey findings.

Resolution No.: 2015-182

Whereas, the Minnesota Department of Human Services published a Request For Proposals to provide health care services to recipients of Medical Assistance and MinnesotaCare in 87 Minnesota counties including Wabasha County; and

Whereas, the Minnesota Department of Human Services requested that counties evaluate and make a recommendation regarding these proposals; and

Whereas, after evaluation of these proposals the Wabasha County Human Services Board recommended the approval of South County Health Alliance to provide health care services in Wabasha County as their proposal both met the needs of our citizens and their organization has a demonstrated history of being a valuable, responsive partner in providing affordable and effective health care services in our community; and

Whereas, the Wabasha County Human Services Board also recommended the approval of UCare as an additional plan to provide health care services in Wabasha County; and

Whereas, the Minnesota Department of Human Services wantonly disregarded both recommendations and chose alternate plans for Wabasha County;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, it hereby objects to Minnesota Department of Human Services' selection of participating health plans for Wabasha County and, specifically, the Department's decision to reject South County Health Alliance's proposal to provide healthcare through the Prepaid Medical Assistance and MinnesotaCare programs. Wabasha County hereby authorizes the submission of a request for mediation with the Department pursuant to Minn. Stat. § 256B, both on behalf of Wabasha County individually and through South Country Health Alliance.
