Wabasha County Board of Commissioners Meeting of January 5, 2016 The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, January 5, 2016 at 9:00 a.m. Election of Board Chairperson and Vice Chairperson was held. WOBBE - KEY Motion to elect Rich Hall as Board Chairperson. Adopted Unanimously GOIHL - HALL Motion to elect Cheryl Key as Board Vice Chairperson. Adopted Unanimously The meeting was called to order by Board Chairman Rich Hall. The following Commissioners were present: Goihl, Hall, Key, Wobbe. Absent: Springer GOIHL - KEY Motion to approve the agenda. Adopted Unanimously GOIHL – WOBBE Motion to approve the consent agenda including the following: Minutes: December 28, 2015 Claims Meal Vouchers Donation of $978.00 from the annual Wabasha Combined Drive to the Substance Abuse Court. Resolution No: 2016-001 Whereas, the Wabasha County Sheriff's Office is requesting to purchase one (1) 2016 Dodge Ram 1500 at a cost of $27,548 per attached quote from Adamson Motors of Rochester, MN, and; Whereas, the money for the purchase of this vehicle and accessories will be paid from Capital Funds not to exceed the budgeted amount of $40,000.00. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Auditor is authorized to issue an Auditor's Warrant for the purchase of one (1) 2016 Dodge Ram 1500 from Adamson Motors of Rochester, MN. Be it Further Resolved by the Wabasha County Board of Commissioners that the total cost for the vehicle and accessories will not exceed the budgeted amount of $40,000.00. Be it Further Resolved by the Wabasha County Board of Commissioners that funding of the purchase for this vehicle and accessories will come from Capital Funds. Resolution No: 2016-002 Whereas, the Wabasha County Sheriff's Office is requesting to purchase one (1) 2016 Ford Explorer at a cost of $26,089 per attached quote from Tom Heffernan Ford of Lake City, MN, and; Whereas, the money for the purchase of this vehicle and accessories will be paid from Capital Funds not to exceed the budgeted amount of $40,000.00. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Auditor is authorized to issue an Auditor's Warrant for the purchase of one (1) 2016 Ford Explorer from Tom Heffernan Ford of Lake City, MN. Be it Further Resolved by the Wabasha County Board of Commissioners that the total cost for the vehicle and accessories will not exceed the budgeted amount of $40,000.00. Be it Further Resolved by the Wabasha County Board of Commissioners that funding of the purchase for this vehicle and accessories will come from Capital Funds. Resolution No: 2016-003 Whereas, a personnel request was submitted for the 2016 budget for a full-time Dispatcher position; and, Whereas, this request was approved as part of the budget per Resolution #2015-313 on December 28, 2015; and, Whereas, on December 22, 2015, the Personnel Committee recommended to start the hiring process for this position. Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners hereby authorizes advertising and hiring for a full-time Dispatcher. Adopted Unanimously KEY - GOIHL Resolution No.: 2016-004 Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority (the "HRA") administered the Minnesota Investment Fund ("MIF")on behalf of Wabasha County in order to assist businesses affected by the 2010 flood; and Whereas, Farris-Domke, LLC has borrowed funds through the Small Business Administration ("SBA") and the MIF Program in order to rehabilitate their business following the 2010 flood; and Whereas, Bremer Bank has foreclosed on the property owner; and Whereas, SBA requires a twelve (12) month redemption period; and Whereas, Bremer Bank has requested that the right of redemption be release in order for the property to be listed for sale and marketed. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the right of redemption be release contingent upon SBA releasing their right of redemption Adopted Unanimously KEY - WOBBE Resolution No.: 2016-005 Whereas, the Wabasha County Board of Commissioners has advertised to accept sealed bids for the Wabasha County legal newspaper for 2016; and Whereas, the Wabasha County Board of Commissioners desires to open the sealed bids on Tuesday, January 5, 2016; and Whereas, three bids were received; the Lake City Graphic, The Plainview News and The Wabasha County Herald; and Whereas, the Plainview News is the apparent low bidder of $9.75 per standard advertising unit (SAU). Now therefore be it resolved by the Wabasha County Board of Commissioners hereby accepts the bid of the Plainview News as the "legal County newspaper," to include publications of the Commissioners Proceedings, the Delinquent Tax List and other notices ordered by the County Board of Commissioners as required by law for the year 2016. Now therefore be it further resolved by the Wabasha County Board of Commissioners hereby gives the Plainview News until January 31st, 2016 to issue the Wabasha County a $1,000 printers bond. Adopted Unanimously KEY - GOIHL Resolution No.: 2016-006 Be It Resolved, That the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2016 the payment for necessary express, freight, telephone, water, light, e-bay, expenses related to an emergency, justice center debt service payments and other utility charges to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.16. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Be It Resolved, That the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2016 the payment for necessary charges to be paid on the Warrant of the County Auditor/Treasurer to avoid finance charges, upon receipt of itemized bills. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Be It Resolved, That the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2016 the payment due to other governments and payroll deductions, to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.15. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Be It Resolved, that the Wabasha County Board of Commissioners hereby sets the mileage reimbursement rate for 2016 at the 2016 IRS mileage rate; and (Effective January 1, 2016 the rate at 54 per mile) ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Be It Resolved, That the Wabasha County Board of Commissioners hereby approves the establishment and/or continuance of a Petty Cash Fund, pursuant to MS 375.162; and Be It Further Resolved, That Sheriff Rodney Bartsh shall be custodian of said fund. The amount of the fund shall not exceed $100.00. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Whereas, the County Auditor/Treasurer's Office currently maintains a checking account for the sole purpose of refunding over-payment of taxes, Be It Resolved, the County Auditor/Treasurer is authorized to maintain a checking account for overpayment of taxes and also for refunds of miscellaneous over-payments or payments made in error as required by all Wabasha County Departments. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Whereas, it is in the best interest of Wabasha County to reduce administrative costs and increase departmental efficiency, and Whereas, costs are increasing to mail refunds of overpayments and return documents not processed because of underpayments, Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to retain overpayments in amounts not exceeding $2.00 for services of any kind. Revenue from such overpayments shall be deposited in the General Revenue fund in a timely manner, and Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to accept, at their discretion, underpayments of any kind with the deficit amount not exceeding $2.00 and to process the document or transaction regardless of the deficiency. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Be It Resolved, that the Wabasha County Board of Commissioners hereby sets the maximum reimbursable meal allowance, for 2016, at $8.00 for breakfast, $10.00 for lunch and $15.00 for dinner. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Be It Resolved, that any employee of Wabasha County who has funds to be deposited in a designated financial depository of Wabasha County, shall take said funds to the Office of the County Auditor/Treasurer for transfer to said depository. No employee shall personally transfer or transport funds, except for the County Auditor/Treasurer or designee thereof. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the County Auditor/Treasurer to cash checks not to exceed $2,000 to replenish the change fund. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Whereas, the County Board under Minnesota Statute may authorize the treasurer or chief financial officer to perform deposit and investment functions relating to public funds. Now Therefore Be It Resolved By The Wabasha County Board of Commissioners, that the following appointments and actions are hereby directed and approved: 1. That the Wabasha County Board of Commissioners hereby grants to Debbie Koenig, Finance Director, the authority to designate depositories for the County of Wabasha as provided for in Minnesota Statute 118A.02 subd. 1. 2. That the Wabasha County Board of Commissioners hereby authorizes Denise Anderson, Auditor/Treasurer, or Debbie Koenig, Finance Director to make investments of funds under sections 118A.01 to 118A.06 of Minnesota Statutes or other applicable law. Adopted Unanimously WOBBE - KEY Resolution No.: 2016-007 Whereas, the Wabasha County Board of Commissioners is required by statute to set minimum salaries for elected officials up for election in that calendar year, and; Whereas, the minimum salary set in 2014 were: Commissioners $17,324.68, plus $500 for Board Chair. And Whereas, it is appropriate for these amounts to stay the same. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the minimum salaries for elected positions in 2016 are as follows: Commissioner $17,324.68, plus $500 for Board Chair. Adopted Unanimously WOBBE - GOIHL Resolution No.: 2016-008 Whereas, the County of Wabasha has designated First State Bank of Wabasha as a depository of its public funds pursuant to Minnesota Statues, Chapter 118A, and Whereas, Mike Wobbe is removed as the board chair, and Whereas Rich Hall has been appointed board chair for 2016, and Now, therefore, be it resolved by the Wabasha County Board of Commissioners the following changes are approved to be made to the First State Bank authorizations: 1. Rich Hall is approved as an authorized signer on certain accounts at First State Bank of Wabasha per the attached list. 2. Mike Wobbe is removed as an authorized signer on the County accounts at First State Bank of Wabasha per the list approved January 5th, 2016. Be it further resolved, by the Wabasha County Board of Commissioners that the following employees and Board Chairman are given specific authority at First State Bank of Wabasha per the attached. (See attachment) Adopted Unanimously WOBBE - GOIHL Resolution No.: 2016-009 Whereas, the Federal Highway Administration (FHWA) requires that states agree to operate and maintain facilities constructed with federal transportation funds for the useful life of the improvement and not change the use of right of way or property ownership acquired without prior approval from the FHWA; and Whereas, Transportation Alternatives projects receive federal funding; and Whereas, the Federal Highway Administration (FHWA) requires project sponsors to make available sufficient funds to cover the estimated local share of costs plus any additional project costs in the event the project exceeds the estimated total cost of the project; and Whereas, the Minnesota Department of Transportation (Mn/DOT) has determined that for projects implemented with alternative funds, these above requirements should be applied to the project sponsor; and Whereas, Wabasha County is the project sponsor for the transportation alternative project identified as Wabasha County Bridge 3219 Preservation. Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that: Wabasha County act as sponsoring agency for the transportation alternative project identified as Wabasha County Bridge 3219 Preservation Project and has reviewed and approved the project as proposed. Sponsorship includes a willingness to secure and guarantee the local share of costs associated with this project and responsibility for seeing this project through to its completion, with compliance of all applicable laws, rules and regulations. Be it further resolved that Wabasha County will make available sufficient funds to cover the estimated local share of costs plus any additional project costs in the event that the project exceeds the estimated total cost of the project as reflected in the project application. Be it further resolved that Wabasha County hereby agrees to assume full responsibility for the operation and maintenance of property and facilities related to the aforementioned Transportation Alternatives project, for the useful life of the improvements and will not change the use of right of way or ownership of property within the project without prior approval from the FHWA. Sponsorship includes a willingness to secure and guarantee the local share of costs associated with this project and responsibility for seeing this project through to its completion, with compliance of all applicable laws, rules and regulations. Be it further resolved that Wabasha County will make available sufficient funds to cover the estimated local share of costs plus any additional project costs in the event that the project exceeds the estimated total cost of the project as reflected in the project application. Be it further resolved that Wabasha County hereby agrees to assume full responsibility for the operation and maintenance of property and facilities related to the aforementioned Transportation Alternatives project, for the useful life of the improvements and will not change the use of right of way or ownership of property within the project without prior approval from the FHWA. Adopted Unanimously KEY - GOIHL Resolution No.: 2016-011 Whereas, the County Board has many responsibilities that relate to other civic and governmental organizations and agencies; and Whereas, frequently, these responsibilities require the County Commissioners participate as a Committee or Board Member for these organizations and agencies. Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that: 2016 Committee and/or Board appointments/assignments are as follows:
Be it further resolved that if a commissioner is unable to attend an assigned meeting that a substitute commissioner is authorized to act in their place and collect the same per diem due to the original commissioner.
