Meeting of February 16, 2016


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, February 16, 2016 at 9:00 a.m.

The meeting was called to order by Board Chairman Hall.

The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe

Resolution No.: 2016-044

Whereas, the Sheriff’s Office requests the hiring of Todd Baab as a Full-Time Dispatcher whom meets all Office and County requirements for this position, and;

Whereas, be it further requested for approval to fill a Jail Sergeant vacancy created by this new position.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners: authorizes the hiring of Todd Baab as a Full-Time Dispatcher in which Mr. Baab will move to Dispatcher pay at Step 5.

Be it Further Resolved that the Wabasha County Board of Commissioners authorizes the Sheriff’s Office to fill the vacant Jail Sergeant position created by this new position.

Resolution No: 2016-045

Whereas, a vacancy for a Full-Time Jailer had been created by the resignation of Greg Telisak,

Whereas, the hiring process is complete and an applicant has been selected;

Whereas, the Wabasha County Sheriff is requesting authorization to hire Shane Heinrich as a Full-Time Jailer, as soon as favorable physical examination and urinalysis results are received. The current Teamsters Union Contract Start pay rate will be assigned.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that:

The Wabasha County Jail is hereby authorized to hire Shane Heinrich as a Full-Time Jailer to fill the current vacancy.

Be it further Resolved by the Wabasha County Board of Commissioners that: Shane Heinrich be hired at the Start pay rate per current Teamsters Union Contract.

Resolution No.: 2016-046

Whereas, the anniversary date for the County Administrator is on March 4, 2016, and customarily would be the time that a step increase would occur for the position; and

Whereas, a request was received from the County Administrator to review the position’s placement within the specific pay grid; and

Whereas, the Personnel Committee reviewed the compensation practices of other Minnesota counties with County Administrators and recommended that the Wabasha County Administrator position be assigned to Step 6 of pay grade 15;

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that it approves the placement of the Administrator position to Step 6 of pay grade 15 effective March 4, 2016.

Resolution No.: 2016-047

A Resolution Approving the Appointment of Rich Hall to the Southeastern Minnesota Multi-County Housing and Redevelopment Authority consisting of the Counties of Wabasha, Winona, Goodhue and Dodge.

Be It Resolved, by the County Board of Wabasha County, Minnesota that the recommendation from the Southeastern Minnesota Multi-County Housing and Redevelopment Authority of Rich Hall to serve as Commissioner of the Southeastern Minnesota Multi-County Housing and Redevelopment Authority for a period of five (5) years, the recommendation of appointment is hereby approved.

Resolution No.: 2016-048

Whereas, two Scott Air Packs are no longer OSHA approved and are unsafe to use and/or store; and

Whereas, the Wabasha Fire Department donated the air packs to the Sheriff’s Office and willing to take the air packs back for training purposes; and

Whereas, the Wabasha County Jail is requesting that as a means of disposal, the air packs be returned to the Wabasha Fire Department.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Jail is authorized and directed to return the air packs to the Wabasha Fire Department.

Resolution No.: 2016-049

Whereas, the County has identified the need to review county buildings to improve current HVAC equipment, controls, lighting and other energy savings measures that can be implemented, and

Whereas, Honeywell has agreed to undertake certain preparatory activities as outlined in the attached Letter of Intent.

Now Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves the Letter of Intent with Honeywell Buildings Solutions Inc.

Resolution No.: 2016-051

Whereas, Chapter 18 Minn. Stats. has been adopted for the purpose of protecting the residents of the state from the injurious effects of noxious weeds on public health, the environment, public roads, crops, livestock, and other property; and

Whereas, A county must either appoint at least one county agricultural inspector or a county-designated employee to carry out the duties specified under Chapter 18 Minn. Stats.; and

Whereas, The Wabasha SWCD implements a noxious weed removal program for the residents of Wabasha County and currently has staff proficient in the identification and removal of noxious weeds.

Now, Therefore, Be It Resolved the Wabasha County Board of Commissioners appoints Jennifer Wahls of the Wabasha SWCD as the county-designated employee for 2016 to carry out the duties specified under Chapter 18.81 Minn. Stats. and Wabasha County will pay up to $500 for any additional expenses above the initial $250 allotment.

Be It Further Resolved, Any funds allocated by Wabasha County for the Noxious Weed Program will be provided to the Wabasha SWCD Office for the administration of the program and if either party wishes to terminate this agreement that they shall provide notice to the other party at least thirty days in advance.

Resolution No.: 2016-052

Whereas, Geronimo Energy on behalf of Carina Community Solar Gardens, LLC applied for a Conditional Use Permit to construct and operate a commercial solar energy system on parcel 07.00031.00 located in Section 5, Township 109 North, Range 13 West, Town of Hyde Park.; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on January 25, 2016 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with nine conditions.

Now Therefore, Be It Resolved the Wabasha County Board of Commissioners approves the Conditional Use Permit for Geronimo Energy on behalf of Carina Community Solar Gardens, LLC with the conditions as follows:

1. The project shall be undertaken only in accordance with the plans and specifications as submitted in the application or as outlined in these conditions.

2. The County may enter onto the premises at reasonable times and in a reasonable manner to ensure the permit holder is in compliance with the conditions and all other applicable ordinances.

3. A wetland delineation shall be submitted to and approved by the Wabasha WCA Technical Advisory Panel prior to the start of any construction activity. No solar panel or utility line shall be located in any area mapped as a wetland.

4. The applicant shall post a bond or issue an irrevocable letter of credit in the amount of $25,000 per megawatt to cover the costs of decommissioning and site restoration upon project termination. Upon expiration/revocation of this permit or voluntary termination of the project, the permittee shall dismantle and remove from the site all solar panels, mounted steel posts and beams, inverters, transformers, overhead and underground cables, buildings and foundations, and roads.

5. Except for designated roadways, the project area shall be re-vegetated as a low-growing, pollinator friendly native prairie. The vegetation in the project area shall be maintained to promote the pollinator friendly native prairie and to limit any noxious weeds or other undesirable plants such as any cool season grasses. A seed mix and maintenance plan shall be approved by the Zoning Department prior to the start of any construction.

6. Construction shall be limited to daytime working hours.

7. Existing natural screening shall be maintained on the property so as to provide a visual screen to any home located within 1,000 feet of the project.

8. Testing for stray voltage that is a result of the project shall be conducted by a third-party consultant at the start of operation and shall be completed annually for three years. After that point, it shall be completed once every three years. The results from such testing shall be submitted to the Wabasha County Zoning Department within 30 days of testing. The costs for such testing shall be paid for by the developer.

9. The solar modules shall be limited to a fixed-tilt system.

Resolution Authorizing Issuance and Sale of General Obligation

Jail Refunding Bonds, Series 2016A

Be It Resolved by the Board of County Commissioners (the “Board”) of Wabasha County, Minnesota (the “County”), as follows:

Section 1. Purpose. It is hereby determined to be in the best interests of the County to issue its General Obligation Jail Refunding Bonds, Series 2016A, in the approximate aggregate principal amount of $8,785,000, pursuant to Minnesota Statutes, Chapter 475 and Section 641.23, to refinance in a crossover advance refunding (i) the 2019 through 2028 maturities of the County’s General Obligation Jail Bonds, Series 2007A, dated, as originally issued, as of October 1, 2007, (ii) the 2019 through 2028 maturities of the County’s General Obligation Jail Bonds, Series 2008A, dated, as originally issued, as of June 1, 2008, and (iii) the 2019 through 2028 maturities of the County’s General Obligation Jail Bonds, Series 2009A, dated, as originally issued, as of February 15, 2009.

Section 2. Terms of Proposal. Springsted Incorporated, municipal advisor to the County, has presented to this Board a form of Terms of Proposal for the Bonds which is attached hereto and hereby approved and shall be placed on file by the County Administrator. Each and all of the provisions of the Terms of Proposal are hereby adopted as the terms and conditions of the Bonds and of the sale thereof. Springsted Incorporated is hereby authorized to solicit proposals for the Bonds on behalf of the County in accordance with the provisions of the Terms of Proposal.

Section 3. Sale Meeting. This Board shall meet at the time and place shown in the Terms of Proposal, for the purpose of considering proposals for the purchase of the Bonds and of taking such action thereon as may be in the best interests of the County.
