Meeting of March 1, 2016


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, March 1, 2016 at 9:00 a.m.

The meeting was called to order by Board Chairman Hall.

The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe

Resolution No. 2016-056

Whereas, a vacancy for a Full-Time Jailer has been created by the resignation of Jail Sergeant Todd Baab, and;

Whereas, the hiring process is complete and an applicant has been selected, and;

Whereas, the Wabasha County Jail Administrator is requesting authorization to hire Jim Binion as a Jailer. The start date is unknown at this time. The current Teamsters Union Contract Start pay rate will be assigned.

Now, Therefore, be it resolved that the Wabasha County Board of Commissioners that the Wabasha County Jail is hereby authorized to hire Jim Binion as a Full-Time Jailer to fill the current vacancy.

Be it Further Resolved that the Wabasha County Board of Commissioners that Jim Binion will be hired at the Start pay rate per current Teamsters Union Contract.

Resolution No. 2016-058

Now, Therefore, be it resolved that Wabasha County Board of Commissioners that the attached “Wabasha County Highway Department CDL Drug and Alcohol Testing Policy” is hereby approved.

Resolution No. 2016-059

Whereas, the Wabasha County Highway Department finds it beneficial to purchase one 2017 Western Star 4700 Tandem Truck and snow removal equipment, and

Whereas, with the purchase of one Tandem Truck and snow removal equipment, Unit 982 – Ford Tandem Truck and snow removal equipment is considered excess.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one 2017 Western Star Tandem Truck from Boyer Ford Trucks, Inc. and Snow Removal Equipment from Universal Truck Equipment, and hereby authorizes the County Auditor/Treasurer to issue warrants for applicable sales tax and license fees of the truck.

Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 982 – Ford Tandem Truck and associated snow removal equipment as Excess Equipment and authorizes the County Engineer to dispose as a trade-in allowance.

Resolution No. 2016-060

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Board of Commissioners hereby authorizes Wabasha County Highway Department to advertise and hire three 2016 Part-Time Temporary Seasonal Employment Positions.

Resolution No. 2016-061

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for the Furnish and Delivery of Diesel Fuel.

Resolution No. 2016-062

Whereas, Stephanie Hauschildt applied for a Conditional Use Permit for a dog kennel on parcel 03.00319.00 located in Section 35, Township 110 North, Range 13 West, Town of Gillford (33665 630th Street, Zumbro Falls); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on February 22, 2016 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with seven conditions.

NOW THEREFORE BE IT RESOLVED, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Stephanie Hauschildt with the conditions as follows:

1. The permit to operate a dog kennel for the described property in the application shall only be valid for Stephanie Hauschidlt and/or Christopher Hauschildt and shall not be transferable to any other individual.

2. The applicant shall abide by all representations and commitments made during the permitting process as well as before the Planning Commission, in accordance with all conditions to the conditional use permit, taken as a whole, as approved by the Planning Commission and the County Board.

3. The applicant shall meet sanitary requirements for the collection of dog waste and wastewater.

4. The applicant shall comply with all relevant regulations and standards of Wabasha County and the State of Minnesota.

5. The total number of dogs over 28 weeks of age shall be limited to 25 on the property.

6. The applicant shall allow for random inspections and consent to allow access to the Zoning Administrator, the Wabasha County Sheriff, or any designee of the Sherriff.

7. An outdoor exercise and socialization yard shall be maintained on the property.

Resolution No. 2016-063

Whereas, Curtis and Darla Tesmer applied for a Conditional Use Permit for a dog kennel on parcel 03.00215.00 located in Section 26, Township 110 North, Range 13 West, Town of Gillford (63723 County Road 2, Millville); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on February 22, 2016 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with seven conditions.

NOW THEREFORE BE IT RESOLVED, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Curtis and Darla Tesmer with the conditions as follows:

Resolution No. 2016-064

Whereas, the Wabasha County Sheriff’s Office is requesting to enter into a rental agreement (regarding leasing space at 1025 Skyline Terrace a/k/a the Wabasha County Tower Site) between Wabasha County and Whitewater Wireless; and,

Whereas, this would be for a 5-year agreement commencing on March 1, 2016 through February 28, 2021.

Whereas, the monthly revenue for this agreement will be Two hundred dollars and no cents ($200.00); and,

Whereas, the monies will go into the 911 (290) account.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Wabasha County Board of Commissioners Chairperson and the PSAP Supervisor is hereby authorized to sign the proposed Rental Agreement between Wabasha County and Whitewater Wireless regarding the Wabasha County Tower Site; and,

Be it Further Resolved by the Wabasha County Board of Commissioners that the monies will go into the 911 (290) account.

Resolution No. 2016-065

Whereas, Resolution #2015-301 was approved on December 28, 2015 Authorizing Office of Traffic Safety (OTS), Minnesota Department of Public Safety (DPS) 2016 In-Squad Computer Grant – A-CMPTR16-2016-WABASHSO-00004

Whereas, the money for the purchase of this equipment will come out of Capital Funds designated for Mobile Data Terminals project per 2015 budget approval.

Whereas, the Sheriff also requests approval for the Auditor’s Office to cut an Auditor’s Warrant not to exceed the amount of $46,000. **Note: This is a 50% local match grant in which the state will reimburse.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: payment is authorized for MDT grant related equipment as presented in resolution #2015-301 at a cost not to exceed $46,000.

Be it Further Resolved by the Wabasha County Board of Commissioners that funding of this purchase will come out of Capital Funds designated for mobile data terminals project.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor’s Office is hereby authorized to cut an Auditor’s Warrant not to exceed the amount of $46,000 to the respective vendor.
