Meeting of April 5, 2016


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, April 5, 2016 at 9:00 a.m.

The meeting was called to order by Board Chairman Hall.

Resolution No. 2016-095

Whereas, As part of the bond refunding with Springsted Incorporated the County has agreed to engage Springsted Investment Advisors to serve as Investment Advisor regarding the placement of investments from the proceeds of the General Obligation Bonds, Series 2016A, and

Whereas, Any fees associated with will be paid from the proceeds of the investments.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that it authorizes the County Finance Director to sign documents as needed by Springsted Investment Advisors for the purpose of investing the proceeds of the General Obligation Bonds, Series 2016A.

Disposal of Excess Generators

Whereas, Wabasha County currently has two large generators located at the shop next to the Old Courthouse Annex and the Public Heath/Social Services building that are no longer being used and are considered excess; and

Whereas, disposal of such equipment will provide access to additional county storage and provide relief from unnecessary clutter; and

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves of the disposal of the excess generators at the above referenced location and that the County Administrator or their designee is authorized to dispose of them in a manner that they determine appropriate.

Whereas, Lynn Sandstrom, Registered Nurse has tendered her resignation, effective April 8, 2016, and;

Whereas, Lynn has performed her duties in a professional and efficient manner,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they

accept the resignation of Lynn Sandstrom, effective April 13, 2016 with regret and with appreciate for the work she has done on behalf of the Wabasha County residents.

Resolution Number: 2016-098

Resolution Authorizing

2016 State of Minnesota DNR

Annual County Boat and Water Safety Grant

Contract #107178

Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2016 State Boat and Water Safety Grant; and,

Whereas, the Sheriff’s Office has received the 2016 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and,

Whereas, the Sheriff requests the approval and signing of the 2016 State of Minnesota (DNR) Annual County Boat and Water Safety Grant Agreement by the County Administrator and Chairman of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2016 State of Minnesota (DNR) Annual County Boat and Water Safety Grant Agreement is hereby approved and authorizes it’s signing by the County Administrator and Chairman of the County Board.

Resolution Number: 2016-099

2015-2025 Waste Delivery Contract – Sunshine Sanitation

Whereas, the County has entered into a Service Agreement with La Crosse County, La Crosse, WI, for delivery of solid waste from Wabasha County to Xcel Energy, French Island, La Crosse, WI; and

Whereas, the County has been delegated the authority to enter into a delivery contract with the solid waste haulers in order to assure a supply of solid waste to a solid waste disposal facility that meets the County’s environmental and other policy objectives, pursuant to Minnesota Statutes, Sections 471.59, 115A et. seq.; and

Whereas, Sunshine Sanitation desires to operate in Wabasha County and has signed a contract with the County to deliver waste to a Facility that meets the County’s environmental and other policy objectives.

Now Therefore Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the 2015-2020 Wabasha County Waste Delivery Contract with Sunshine Sanitation.

Be It Further Resolved, that any solid waste hauler that does not enter into a contract with Wabasha County for the delivery of solid waste to a disposal facility that meets the County’s environmental and other policy objectives will be prohibited from collecting household solid waste in Wabasha County.

Resolution Number: 2016-100

License to Collect and Transport Solid Waste and/or Recyclables

Whereas, Wabasha County has adopted a Solid Waste Ordinance in order to promote the health, welfare, and safety of the general public and to also protect the environment; and

Whereas, The Wabasha County Solid Waste Ordinance requires the issuance of a license to collect, transport, or dispose of solid waste or recyclables generated within Wabasha County; and

Whereas, Wabasha County reserves the right to revoke any license for a violation of any provision of the Solid Waste Ordinance; and

Whereas, Licenses for the collection, transport, or disposal of solid waste or recyclables generated within Wabasha County are issued on a yearly basis.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the 2016 license to collect solid waste and recyclables for Sunshine Sanitation.

Resolution Number: 2016-101

Graner Conditional Use Permit

Whereas, Kenneth Graner submitted a Conditional Use Permit to transfer the dwelling density from parcel 06.00161.00 to parcel 06.00156.00 to allow for the construction of two additional dwellings on parcel 06.00156.00 located in Section 16, Township 109 North, Range 11 West, Town of Highland; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on March 28, 2016 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with one condition.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Kenneth Graner with the condition as follows:

1. Only one additional dwelling shall be allowed to be constructed on parcel 06.00156.00 and a deed restriction shall be recorded for parcel 06.00156.00 and the balance of 160 acres on parcel 06.00161.00 to prohibit any additional dwellings.

Resolution Number: 2016-102

Johnson Conditional Use Permit

Whereas, Arlene and Mike Johnson submitted a Conditional Use Permit to allow for the use of an existing driveway through a bluff impact zone for access to a newly constructed home to be located on parcel 15.00201.09 located in Sec. 24, T. 109 N., R. 10 W., Town of Watopa (14133 County Road 14, Kellogg); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on March 28, 2016 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with one condition.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Arlene and Mike Johnson with the condition as follows:

1. The driveway shall be constructed to allow for emergency vehicle access.
