Wabasha County Board of Commissioners Meeting of May 3, 2016 The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 3, 2016 at 9:00 a.m. The meeting was called to order by Board Chairman Hall. The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe GOIHL-KEY Motion to approve the agenda Adopted Unanimously Staff Updates Administrator Update SPRINGER-KEY Motion to approve the consent agenda including the following: Minutes: April 26, 2016 Claims Meal Vouchers Per Diems Donations Utility Permit Resolution No.: 2016-120 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the attached “County Provided Clothing Policy” is hereby approved. Adopted Unanimously SPRINGER-HALL Resolution No.: 2016-118 Approval as a pass-through for MN DNR snowmobile funds Whereas, the Zumbrowatha Trails Snowmobile Clubs of Wabasha County request that Wabasha County be their local sponsoring unit of government for pass-through of MN DNR snowmobile trail system funding. Now therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County act as the sponsor for an application for funding to the State of Minnesota Department of Natural Resources for development of maintenance of snowmobile trails managed by the clubs of Zumbrowatha Trails-Wabasha County for the 2016-2017 snow season. Be it further resolved: that upon approval of its application by the state, that Wabasha County may enter into an agreement with the State of Minnesota for the above referenced project and that it will act as the pass-thru for funds to the clubs as outlined in the Assistance Program manual. Be it further Resolved: that the County Auditor/Treasurer and/or Deputy Auditor/Treasurer is hereby authorized to serve as the fiscal agent for the above referenced project. Be it further resolved: that Marvin Howatt is appointed to be a County Trail Coordinator to work with the county clubs and assist the county in administering this program. Adopted Unanimously SPRINGER-GOIHL Resolution No.: 2016-119 Approval of County-Club contracts Whereas the State of Minnesota DNR along with Wabasha County has approved the Zumbrowatha Trails Association of Wabasha County’s request for the County to act as the sponsoring unit of government for pass-thru of funds to the snowmobile clubs for the 2016-2017 snow year as outlined in the Assistance Program Manual. Therefore, be it resolved that the Wabasha County Commissioners enter into a County-Club contract with each of the five snowmobile clubs within the Zumbrowatha Trails Association to administer their club’s portion of the trail system for the 2016-2017 snow year according to the regulations outlined in the contract. The five snowmobile clubs consist of the Zumbro Valley, Wabasha Driftskippers, Cliff & Coulee Climbers, Polar Barons and the Four Seasons. Adopted Unanimously SPRINGER-KEY Resolution No.: 2016-128 Whereas, Public Health Director, Judy Barton, has submitted her letter of retirement effective June 30, 2016, and Whereas, the Human Services Board has by majority consensus approved filling the Public Health Director position as it currently is, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, The County Administrator advertise, interview, and hire for this position on pay grade 12. Starting salary recommendation will be made by HR as outlined in County Policy 102. Adopted: Nay: Goihl, Hall GOIHL-WOBBE Resolution No.: 2016-121 Whereas, Rochester Sand and Gravel – Division of Mathy Construction Company is the lowest responsible bidder for CP 079-086-007. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Rochester Sand and Gravel – Division of Mathy Construction Company for CP 079-086-007 in the amount of $409,145.40 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Rochester Sand and Gravel – Division of Mathy Construction Company for this work. Adopted Unanimously SPRINGER-KEY Resolution No.: 2016-122 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for improvements on County Highway 2 and 67 under SAP 079-602-040, and SAP 079-602-041. Adopted Unanimously SPRINGER-GOIHL Resolution No.: 2016-123 Whereas, the Wabasha County Highway Department proposes to acquire property in addition to the existing right of way of County Aid Highway 73 for the purpose of improvements under project CP 079-073-002; and Whereas, improvements under project CP 079-073-002 are necessary in order to improve this segment of County Aid Highway 73 to provide for public health, welfare, safety and convenience; and Whereas, the property necessary to be acquired for improvements and existing right of way for project CP 079-073-002 are described in the attached “ CR 73 Right of Way Descriptions” Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the County Highway Engineer is hereby authorized to proceed to acquire the property as described above in accordance with applicable laws and statutes. Adopted Unanimously SPRINGER-WOBBE Resolution No.: 2016-124 Now Therefore be it Resolved that the Wabasha County Board of Commissioners that Wabasha County enter into the attached “Cooperative Agreement Between the City of Elgin and Wabasha County” for improvements on Wabasha County Highways 2 and 67 and hereby authorizes the Chair of the Board and County Administrator to execute the above Agreement. Adopted Unanimously GOIHL-HALL Resolution No.: 2016-125 Resolution Authorizing Execution of Letter of Agreement Whereas, the MN Department of Human Services (DHS) is interested in entering into an agreement with Wabasha County for the purpose of having a permanent reception center site at the Wabasha-Kellogg School to be used for possible decontamination efforts in the event an incident occurs at the Prairie Island Nuclear Generating Plant in Red Wing, MN; and Whereas, the Agreement provides that DHS will provide training to the responders, HSEM will provide funding for training and equipment for the responders, and Wabasha County will administer the funding and aid the city in responding once it is notified that an incident has occurred at the Prairie Island Nuclear Generating Plant. Now, Therefore, Be It Resolved that the Wabasha County Board of Commissioners approves and executes the Letter of Agreement with the Minnesota Department of Human Services. Adopted Unanimously KEY-HALL Resolution Number: 2016-126 Klein Conditional Use Permit Whereas, Dean Klein submitted an application for a Conditional Use Permit to allow for the expansion of an existing feedlot on parcel 11.00194.00 located in Section 25, Township 111 North, Range 13 West, Town of Mount Pleasant; and Whereas, The Wabasha County Planning Commission conducted a public hearing on April 25, 2016 to provide an opportunity for the public to present any testimony related to the request; and Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with three conditions. Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Dean Klein with the conditions as follows: 1. The number of animal units on the respective parcel shall be limited to 998.2. 2. The owners shall maintain compliance with the MPCA regulations that pertain to feedlots. 3. The construction of any new buildings shall adhere to the setback requirements established in the Wabasha County Feedlot Ordinance or the Wabasha County Zoning Ordinance. Adopted 4-0 Abstain: Goihl KEY-GOIHL Resolution Number: 2016-127 Denman Conditional Use Permit Whereas, Trevor Denman applied for a Conditional Use Permit to transfer the dwelling density from parcel 04.00371.06 to parcel 04.00253.06 (Section 25, Township 110 North, Range 11 West, Town of Glasgow) to allow for a second dwelling; and Whereas, The Wabasha County Planning Commission conducted a public hearing on April 25, 2016 to provide an opportunity for the public to present any testimony related to the request; and Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with one condition. Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Trevor Denman with the condition as follows: 1.
