Wabasha County Board of Commissioners Meeting of March 6, 2018 The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, March 6, 2018 at 9:00 a.m. The meeting was called to order by Board Chairperson Goihl. The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe SPRINGER-KEY Motion to approve the agenda Adopted Unanimously Staff Updates: • Penny Schmit – County Assessor Update Administrator Updates: A. Anniversaries: • Lisa Schuth-Stuhr, Social Services – 30 Years of Service • Joe Schneider, Sheriff’s Office – 15 Years of Service Public Forum: SPRINGER-HALL Motion to approve the consent agenda including the following: Minutes: February 20, 2018 Claims Meal Vouchers Per Diems Resolution No.: 2018-035 Whereas, the Wabasha County Board of Commissioners on an annual basis per the Fund Balance policy approves by consensus designated fund balances as of the end of the financial reporting period. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the following designations as of December 31, 2017 are approved:
Resolution No.: 2018-036 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that that pursuant to Minnesota Statute 161.36, the Commissioner of Transportation be appointed as Agent of Wabasha County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. Be it Further Resolved by the Wabasha County Board of Commissioners that the Wabasha County Engineer is hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in "Minnesota Department of Transportation Agency Agreement No. 1030637", a copy of which said agreement was before the County Board and which is made a part hereof by reference. Resolution No.: 2018-037 Whereas, on November 28th 2017 the Wabasha County Board of Commissioners authorized the County Engineer to petition Zumbro Township for establishment of a cartway under Minnesota Statute 164.08, and Whereas, in accordance with Minnesota Statute 164.08 subd. 2(c) the Zumbro Town Board has required the petitioner to post a security for the total estimated damages before the Town Board takes action on the petition, and Whereas, Zumbro Township has required the deposit of funds in the amount of $20,000 for security of petitioned cartway estimated damages. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the County Engineer be authorized to make a $20,000 deposit with Zumbro Township for security of establishment of a cartway as petitioned. Resolution No.: 2018-038 Whereas, Wabasha County is preparing plans for SP 079-070-010 on County State Aid Highway 10 from approximately 0.1 mile west of US Hwy 61 and on County State Aid Highway 59 to approximately 0.4 mile east of US Hwy 61; and Whereas, Minnesota Rules for State Aid Operation 8820.9920 requires a Minimum Design Speed of 40 mph; and Whereas, the reason for this variance request are the constraints of design due to the adjacent US Hwy 61 and railroad crossing to the proposed project, and the additional impacts to surrounding properties if the project was constructed to the above Rule, and increase in costs of construction if the project was constructed to the above Rule. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County does hereby request a variance from the Minnesota Department of Transportation State Aid Operations Rules Chapter 8820.9920 Minimum Design Standards; Rural and Suburban Undivided; New or Reconstruction Projects to allow for the following horizontal and vertical curves (approximate Stationing and, for horizontal curves, appropriate superelevation in consideration of Stop conditions and radius) in lieu of a Design Speed of 40mph: Horizontal curve #1: STA 12+23 – 13+30; horizontal curve radius 273’ Horizontal curve #2: STA. 14+95 – 17+43; horizontal curve radius 150’ Horizontal curve #3: STA. 30+32 – 36+46; horizontal curve radius 260’ Vertical curve #1: STA. 36+58 – 37+08; vertical curve length of 50’ Be It Further Resolved by the Wabasha County Board of Commissioners that, Wabasha County hereby indemnifies, saves and hold harmless the State of Minnesota, and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of utilizing the above horizontal and vertical curves instead of the Minimum Design Speed in Minnesota Rules 8820.9920 and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting this variance. Resolution No.: 2018-039 Whereas, the Department of Public Health has requested the approval to covert a one person office space to a two person office space; and Whereas, the current furniture cannot be used for this space; and Whereas, the Director of Public Health and County Administrator has reviewed the bid and is recommending the purchase of office furniture for $4844.96. The total amount will be divided in half and will be billed in two invoices to the Radiation Reception Center Grant, and the Relocation Grant; Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Board approves the purchase of office furniture from Schmidt Goodman as recommended by the Director. The Director is authorized to complete the purchase, and acquire the equipment. Adopted Unanimously KEY-WOBBE Resolution No.: 2018-040 Whereas, The Minnesota Department of Employment and Economic Development (DEED), in partnership with Minnesota Housing and the Minnesota Department of Revenue, is now accepting Opportunity Zone proposals from cities of the first class, counties and tribal governments, and Whereas, Opportunity Zones use tax incentives in low-income urban and rural communities nationwide to draw long-term investment to areas that are in the most economic need by creating a fund for these investments. In Minnesota, Governor Dayton can recommend 123 census tracts out of a possible 491 that meet the law’s low income requirements for Opportunity Zone designation, and Whereas, Wabasha County would be the applicant on behalf of the City of Lake City and the City of Wabasha. The County is also collaborating with Goodhue County to take a regional approach. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the County Administrator is authorized to apply for Opportunity Zone Designation on behalf of the cities within the county as well as the overall region. Adopted Unanimously SPRINGER-WOBBE Resolution No.: 2018-041 Whereas, Wabasha County Board of Commissioners approved applying for the Voting Equipment Grant for Wabasha County Precincts on Resolution # 2017-192. Whereas, on January 29, 2018 Wabasha County was awarded $61,314.46 for the Voting Equipment Grant to purchase precinct counters. Whereas, communication has been ongoing with Townships & Cities in Wabasha County regarding their portion of the grant and Township & Cities will reimburse the balance to Wabasha County for their precinct counters. Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby authorizes, Board Chair and Wabasha County Auditor/Treasurer to accept the Voting Equipment Grant and sign the Voting Equipment Grant Agreement on behalf of Wabasha County. Grant paperwork will be on file in the Wabasha County Auditor/Treasurer’s Office. Now Therefore be it Further Resolved by the Wabasha County Board of Commissioners hereby authorizes, Wabasha County Auditor/Treasurer to purchase the precinct counters, apply the grant money to the cost of the counters, pay the balance and invoice townships and cities for their share.
