Meeting of June 19, 2018


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, June 19, 2018 at 9:00 a.m.

The meeting was called to order by Board Chairperson Goihl.

Appoint Extension Committee Member – Mike Zabel

WHEREAS, Wabasha County delivers Extension programming throughout the County. One of the goals of the statewide Extension program is to create a stronger Minnesota through education and research.; and

WHEREAS, To oversee the goals of the programming and the performance of the Coordinator, the County has established an Extension Committee. The County Extension Committee consists of nine members, including two members of the County Board, the County Auditor and six county residents.; and

WHEREAS, The Committee is seeking Mike Zabel’s appointment; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners appoints Mike Zabel to the Wabasha County Extension Committee for a four year term which would expire on December 31, 2021.

Resolution Authorizing

2018 Spring Creek Motocross Contract

Whereas, the Spring Creek Motocross event will take place from July 19th through July 21, 2018 at 63633 298th Avenue, Millville, MN in which the County will need to provide security and traffic control services. 

Whereas, the Sheriff’s Office has received the 2018 contract agreement made by and between Wabasha County and John and Greta Martin d/b/a Spring Creek Motocross which needs to be approved and signed by the County Board Chairperson, County Administrator, and County Attorney; and,

Whereas, the Sheriff requests the approval and signing of the 2018 Spring Creek Motocross contract by the County Board Chairperson, County Administrator, and County Attorney.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2018 Spring Creek Motocross contract is hereby approved and authorizes it’s signing by the County Board Chairperson, County Administrator, and County Attorney.

Resolution to participate in the Zumbro Watershed

One Watershed, One Plan project.

WHEREAS, the Minnesota Board of Water and Soil Resources has developed policies for coordination and development of comprehensive watershed management plans, also known as One Watershed, One Plan, consistent with Minnesota Statutes, Chapter 103B.801, Comprehensive Watershed Management Planning Program; and

WHEREAS, Minnesota Statutes, Chapter 103B.301, Comprehensive Local Water Management Act, authorizes Minnesota Counties to develop and implement a local water management plan; and

WHEREAS, Minnesota Statutes, Chapter 103D.401, Watershed Management Plan, authorizes Minnesota Watershed Districts to develop and implement a watershed management plan; and

WHEREAS, Minnesota Statutes, Chapter 103C.331, subdivision 11, Comprehensive Plan, authorizes Minnesota Soil and Water Conservation Districts to develop and implement a comprehensive plan; and

WHEREAS, the counties, soil and water conservation districts, and watershed districts within the Zumbro River Watershed (planning area #30), as delineated in the attached One Watershed, One Plan Suggested Boundary Map, have interest in developing a comprehensive watershed management plan for this area.

NOW, THEREFORE, BE IT RESOLVED, that Wabasha County recognizes and supports watershed- scale planning efforts consistent with Minnesota Statutes, Chapter 103B.801, also known as One Watershed, One Plan; and

BE IT FURTHER RESOLVED that Wabasha County welcomes the opportunity to collaborate with the counties, soil and water conservation districts, and watershed districts within the Zumbro River watershed for watershed-scale planning efforts in the future; and

BE IT FURTHER RESOLVED that Wabasha County supports an application to the Board of Water and Soil Resources for a planning grant to develop a comprehensive watershed management plan and anticipates entering into the attached Memorandum of Agreement with the counties, soil and water conservation districts, and watershed districts within the Zumbro River Watershed, to collaborate on this effort, pending selection as a recipient of a planning grant.

Now Therefore be it Resolved by the Wabasha County Commissioners that Wabasha County will participate in the One Watershed One Plan (1W1P) collaboration pending selection as a recipient of a planning grant.

Resolution No.: 2018-100

WHEREAS, Wabasha County is a member in good standing of the Southeast Minnesota Water Resources Board, and

WHEREAS, the Southeast Minnesota Water Resources Board operates under an agreement effective May 5, 1987, and

WHEREAS, the Southeast Minnesota Water Resources Board reviewed and approved the proposed amendment to the agreement, and

WHEREAS, a copy of the amendment to the Agreement is attached hereto as Exhibit A,

NOW, THEREFORE, BE IT RESOLVED, that the Wabasha County Board of Commissioners approves the following changes to the attached agreement of the Southeast Minnesota Water Resources Board:

  1. Under Roman Numeral I, Part A. Composition, strike “Two” and replace with “One” and insert “and one alternate” after representative.
  2. Under Roman Numeral I, Part B. Powers (1), insert “Local” after Comprehensive and insert “or Comprehensive Watershed Management Planning” after planning.
  3. Under Roman Numeral I, Part B. Powers (3), insert “Local” after Comprehensive and insert “or Comprehensive Watershed Management Planning” after planning.
  4. Under Roman Numeral I, Part B. Powers (4), insert “(103B.301-355) and the Comprehensive Watershed Management Planning Program (103B.801).” after Act.

Under Roman Numeral I, Part B. Powers (last paragraph), insert “local county and watershed-based plans” after implement the.

Resolution No.: 2018-101

SUPPORT OF SOUTHEAST MINNEOSTA WASTEWATER INITATIVE PROGRAM

Whereas, the Lower Mississippi River Basin Fecal Coliform Implementation Plan reports that many of the rivers and streams in the Lower Mississippi River and Cedar River basins have fecal coliform impairments and providing a facilitator to assist communities was a recommended reduction strategy to address contributions related to wastewater, and

Whereas, unsewered and under-sewered communities with failing residential septic systems are a direct source of E. coli pollution to surface and ground waters, and

Whereas, a complex group process is usually necessary for a community to achieve a resolution to their wastewater problem, and

Whereas, most small communities do not have the resources to solve wastewater problems without outside help, and

Whereas, it has been demonstrated that a Wastewater Facilitator working with a community on an on-going basis can provide effective assistance to a community seeking solutions to their wastewater problems, and

Whereas, the Southeast Minnesota Wastewater Initiative has successfully assisted 29 small communities address their wastewater concerns, saving an estimated 360,040 gallons of sewage per day from entering surface or ground water, and 

Whereas, there is a documented number of small communities that will need to address their wastewater systems in the near future and could benefit from this service, and  

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County supports the goals of the Southeast Minnesota Wastewater Initiative program and is willing to provide in-kind assistance for the continuation of the program to show support and a need for the service in the county.
