The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, July 03, 2018 at 9:00 a.m.
The meeting was called to order by Board Chairperson Goihl.

Resolution Number: 2018-102

Whereas, the County of Wabasha on behalf of its Count Attorney and Sheriff desires to enter into a Joint Powers Agreement with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State’s criminal justice data communications network for which the County is eligible.  The Joint Powers Agreement further provide the County with the ability to add, modify and delete connectivity, systems and tools over the five year life of the agreement and obligates the County to pay costs for the network connections.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that

  1. That the State of Minnesota Joint Powers Agreement by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Wabasha on behalf of its County Attorney and Sheriff are hereby approved.  Copies of the Joint Powers Agreement and Court Data Services Subscriber Amendment to CJDN Subscriber Agreement are attached to this Resolution and made a part of it.  Both agreements are assigned as SWIFT Contract #111369.  The Court Data Services Subscriber Amendment to CJDN Subscriber Agreement is an amendment to the Master Subscriber Agreement for Minnesota Court Data Services for Governmental Agencies that was originally approved by Resolution #2015-233, by the Wabasha County Board of Commissioners, on October 6, 2015.
  2. That the PSAP/TAC Supervisor, Blaine John Hentz, or his successor, is designated the Authorized Representative for the Sheriff.  The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by7 the State of Minnesota to maintain the County’s connection to the systems and tools offered by the State.To assist the Authorized Representative with the administration of the agreement, PSAP/TAX Supervisor Blain John Hentz is appointed as the Authorized Representative’s designee.
  3. That the Wabasha County Attorney, Karen Sierp Kelly, or her successor, is designated the Authorized Representative for the County Attorney.  The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minneso9ta to main the County’s connection to the systems and tools over by the State. To assist the Authorized Representative with the administrator of the agreement, Wabasha County Attorney Karen Sierp Kelly is appointed as the Authorized Representative’s designee. That Brian Goihl, the Chair of the County of Wabasha Board of Commissioners and Michael Pasquinel Plante, the Wabasha County Administrator, are authorized to sign the State of Minnesota Joint Powers Agreement and Court Data Services Subscriber Amendment to CJDN Subscriber Agreement.


Resolution No.:  2018-103


Whereas,  Wabasha County must  notify the Office of the State Auditor its intent to have a certified private accounting (CPA) firm conduct the annual County audits pursuant to Minnesota Statute Section 6.481, sub.7, and
Whereas, the required notification is to be done by August 1 on the even-numbered years, and
Whereas, Wabasha County has determined that a CPA firm will be utilized to conduct the audits for the fiscal years ending 2018 and 2019.
Now Therefore be it resolved by the Wabasha County Board of Commissioners that, a CPA firm will be used for the annual county audits ending fiscal years 2018 and 2019 and directs the Finance Director to provide the required notification to the Office of the State Auditor by August 1, 2018.


Resolution No.: 2018-104


Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer be authorized to advertise for bids for SAP 079-599-078 – Watopa Township bridge replacement.


Resolution No.: 2018-105

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer be authorized to advertise for bids for SAP 079-618-008 – reconstruction of CSAH 18 from approximately 4miles west of Hwy 61 to Hwy 61.

Resolution No.:  2018-106


Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to proceed in coordinating with Goodhue County for the performance of sealcoating work on CSAH 35.
Be it further Resolved by the Wabasha County Board of Commissioners that the work planned to sealcoat CSAH 35 is authorized to be awarded by Goodhue County to the lowest responsible bidder, and payments made by the Wabasha County Engineer to Goodhue County for the work certified and approved by the Wabasha County Engineer on the sealcoating of CSAH 35. 


Resolution No.: 2018-107


Whereas, the use of tobacco is harmful to persons using it, and those around them who are exposed to 2nd and 3rd hand smoke, the Public Health Director has developed a policy on the use of a CO Monitor donated by AMA-MN to Wabasha County Public Health ; and 
Whereas, the Director has set parameters for numbers of clients  Public Health Nursing Staff  is to assess and assist with smoking cessation during home visits, and office visits: and
Whereas, the authorized staff involved in this policy understands they will comply with the Public Health CO Monitor Policy, adopted July 3rd, 2018.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the use of the CO Monitor Policy be accepted effective July 3rd, 2018.

Whereas, the applicants do have current food & beverage licenses issued by Minnesota Dept of Health, and
Whereas, the applications have been approved by the County Attorney and County Sheriff.  The Wabasha County Auditor/Treasurer has received the certificate of insurance and the appropriate license fee.  The liquor license will run from August 1, 2018 to July 31, 2019.


Now therefore be it resolved that Wabasha County Board of Commissioners hereby approves the renewal of Liquor License to the individuals listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.

RESOLUTION NO. 2018-109

Resolution Approving State Of Minnesota Joint Powers Agreement With The County Of Wabasha On Behalf Of Its County Probation Department


WHEREAS, the County of Wabasha on behalf of its County Probation Department desires to enter into a Joint Powers Agreement with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State’s criminal justice data communications network for which the County is eligible.  The Joint Powers Agreement further provides the County with the ability to add, modify and delete connectivity, systems and tools over the five year life of the agreement and obligates the County to pay the costs for the network connection.


Now, Therefore, Be It Resolved by the County Board of Wabasha, Minnesota as follows:


1. That the State of Minnesota Joint Powers Agreement by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Wabasha on behalf of its County Probation Department are hereby approved.  Six copies of the Joint Powers Agreement are attached to this Resolution and made a part of it.


2. That the PSAP/TAC Supervisor, Blaine John Hentz, or his or her successor, is designated as the Authorized Representative for the Sheriff.  The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County’s connection to the systems and tools offered by the State.
To assist the Authorized Representative with the administration of the agreement, PSAP/TAC Supervisor Blaine John Hentz is appointed as the Authorized Representative’s designee.


3. That the Wabasha County Probation Director, Traci Green, or his or her successor, is designated the Authorized Representative for the County Probation Department.  The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County’s connection to the systems and tools offered by the State.
To assist the Authorized Representative with the administration of the agreement, Wabasha County Probation Director Traci Green is appointed as the Authorized Representative’s designee.


4.  That Brian Goihl, the Chair of the County of Wabasha, and Michael Plante, the County Administrator, are authorized to sign the State of Minnesota Joint Powers Agreement.

Resolution No.: 2018-110

Resolution Authorizing the purchase of a

PowerPhone Total Response System for Dispatch

Whereas, the Wabasha County Sheriff’s Office is requesting authorization to purchase a PowerPhone Total Response System from PowerPhone in the amount not to exceed $70,000.  This amount includes the Total Response System along with the appropriate fees for interface needed from Computer Information Systems (CIS).


Whereas, this purchase will be paid from the E911 Reserve Funds.


Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,
The Wabasha County Sheriff’s Office is authorized to purchase the PowerPhone Total Response System from PowerPhone and interface needs from Computer Information Systems (CIS) not to exceed $70,000.

Resolution No.: 2018-111


Whereas, Paul Schmidt on behalf of Lake Pepin Golf Course applied for a Conditional Use Permit to allow for outdoor weddings on parcel 13.00473.00 located in Section 18 & 19, Township 111 North, Range 11 West, Town of Pepin; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on June 25, 2018 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission considered the findings as required in the Wabasha County Zoning Ordinance and recommends (vote 4-0) to the Wabasha County Board of Commissioners that the request be approved with six conditions

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Board of Commissioners agrees with the findings from the Planning Commission and approves the Conditional Use Permit for Lake Pepin Golf Course with the six conditions as follows:

  1. The CUP is being issued to only allow for the addition of weddings, reunions, birthday parties, graduation parties, anniversary parties, and other similar social events to the property.
  2. The project shall be undertaken only in accordance with the plans and specifications as submitted in the application.
  3. Hours of operation shall be limited to 6:00 a.m. to 1:00 a.m. Monday through Sunday.
  4. The applicant shall be responsible for the coordination and payment of an inspection to be completed by the County’s contracted building code inspector to determine compliance with the State’s accessibility requirements.  The applicant shall have six months from the date the CUP is issued to have the property inspected and have any deficiency found by the building code inspector be corrected.
  5. The noise generated from any outdoor function shall not be perceptible beyond the boundaries of the property as per Chapter 9.02(1) of the Wabasha County Zoning Ordinance.

There shall be no parking along the township road to help ensure access for emergency vehicles in the event of an emergency.

Resolution Number: 2018-112

Amendments to Chapter 16.01 and Article 18 of the Wabasha County Zoning Ordinance
WHEREAS, Wabasha County has adopted a Comprehensive Zoning Ordinance as provided in Chapter 394 Minn. Stats.; and
WHEREAS, the Wabasha County Planning Commission has reviewed the Zoning Ordinance and discussed the proposed language and the necessity for such ordinance amendments; and
WHEREAS, the Planning Commission conducted a public hearing on June 25, 2018 and after the public hearing voted 4-0 that the revisions be forwarded to the Wabasha County Board of Commissioners with a recommendation that the revisions be approved by the County Board. 
NOW THEREFORE BE IT RESOLVED, the Wabasha County Board of Commissioners has received and reviewed the recommendations of the Wabasha County Planning Commission; and
BE IT FURTHER RESOLVED, the Wabasha County Board of Commissioners adopts the revisions as attached to Chapter 16.01 of the Wabasha County Zoning Ordinance and adopts Chapter 18 as attached to respectively replace Article 18 of the Wabasha County Zoning Ordinance.
