The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, December 11, 2018 at 9:00 a.m.

The meeting was called to order by Board Chairperson Goihl.

Resolution No.: 2018-220

Whereas, Brenda Sosa-Johnson owner of parcel M22.06020.00 residential property located at 730 W 6th St. #301 Lake City, MN has provided a written request to the Wabasha County Board of Commissioners regarding the local option abatement for property qualifying for disaster credit as defined in MS273.1233;
Whereas, the Wabasha County Assessor has determined that fifty percent or more of the structure was destroyed by fire July 25, 2018.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, a reduction in the 2018 property tax is granted on parcel M22.06020.00 based on the number of complete months the property was inhabitable or unlivable.

Resolution No.: 2018-221

Whereas, section 274.01, subdivision 1No changes in valuation or classification which are intended to correct errors in judgment by the county assessor may be made by the county assessor after the board of review or the county board of equalization has adjourned; however, corrections of errors for real or personal property that are merely clerical in nature or changes that extend homestead treatment to property are permitted after adjournment until the tax extension date for that assessment year. Any changes made by the assessor after adjournment must be fully documented and maintained in a file in the assessor's office and shall be available for review by any person. A copy of any changes made during this period shall be sent to the county board no later than December 31 of the assessment year. In the event a valuation and classification is not placed on any real property by the dates scheduled for the local board of review or equalization the valuation and classification determined in the preceding assessment shall be continued in effect and the provisions of section.
Subd. 1b.Assessment changes.

Whereas, the Wabasha County Assessor has brought forth all Clerical Error done in the county for property taxes payable 2018.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, All Clerical Error Forms have been presented to them for the taxes payable 2018.

Resolution No.: 2018-222

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Department be authorized to purchase Base One stabilization additive for County Hwy 4 and County Hwy 18 reconstruction projects from Team Lab Chemical Corp.

Resolution No.: 2018-223

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer be authorized to advertise for bids for SAP 079-598-027 – rehabilitation of CR 68 bridge 3219.

Resolution No.: 2018-224

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer be authorized to advertise for bids for CP 079-017-001 – resurfacing of County Highway 17 from 2.5 miles west of County Hwy 2 to County Hwy 2.

Resolution No.: 2018-225

Whereas, the Wabasha County Highway Department finds it beneficial to purchase one S5 Trimble Total Station, one TSC7 survey controller, one TSC3 survey controller, and one R8 GPS model 3 receiver, and including all associated hardware and software, and
Whereas, with the purchase of the above listed equipment, Unit 4495 Trimble 5600, one TSC2 survey controller, and one R8 GPS receiver is considered excess.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Department be authorized to purchase the above and attached listed equipment from Frontier Precision Inc.

Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 4495 Trimble 5600, one TSC2 survey controller, and one R8 GPS receiver as Excess Equipment and authorizes the County Engineer to dispose by trade-in.

Resolution No.:  2018-226

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that that pursuant to Minnesota Statute 161.36, the Commissioner of Transportation be appointed as Agent of Wabasha County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects.

Be it Further Resolved by the Wabasha County Board of Commissioners that the Wabasha County Engineer is hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in "Minnesota Department of Transportation Contract Number 1032863”, a copy of which said agreement was before the County Board and which is made a part hereof by reference.

Resolution No.: 2018-227

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer be authorized to advertise for bids for SP 079-070-012 and 079-070-014 – shoulder paving on various County Highways.

Resolution No.: 2018-228

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer be authorized to advertise for bids for SP 079-070-010 – realignment of CSAH 59 and CSAH 10 intersection at Hwy 61.

Resolution No.: 2018-229

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Department be authorized to purchase one loader grapple bucket from Ziegler CAT.

Resolution No.:  2018-230

Now Therefore be it Resolved that the Wabasha County Board of Commissioners that Wabasha County enter into the attached “Federal Aid funding Exchange Agreement Between the City of Plainview and Wabasha County” for the project identified as S.P. 079-596-011 for improvements within the City of Elgin and hereby authorizes the Chair of the Board and County Administrator to execute the above Agreement.

Resolution No.: 2018-231

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the HP LaserJet M5035 MFP (s/n #CN4LB09556) asset # 4525 is declared as excess equipment with no market value and authorizes Metro Sales to dispose of the copier after removing all data from said copier;

Be it further resolved that, Ricoh Copier 3351 asset # 011255 is returned to inventory.

Resolution No.: 2018-232

Whereas, Wabasha County needs to add network capacity in several locations; and

Whereas, the IT Department has researched options compatible with our other systems and has selected suitable equipment; and

Whereas, the IT Department anticipates supply problems in 2019;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the IT Director is hereby authorized to purchase 5 high speed network modules, for $2,575.20.

Whereas, the Wabasha County Highway Department proposes to make improvements to the intersection of County State Aid Highway 26 and Mn Hwy 74 under SAP 079-626-005 and SP 7909-05; and 

Whereas, realignment of the approaching County Highway 26 and Mn Hwy 74 to the intersection is proposed in SP 079-626-005 and

SP 7909-05, and

Whereas, the proposed realignment and intersection layout has been presented to the County Board.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the presented proposed intersection layout in

SAP 079-626-005 and SP 7909-05 is considered to be for the public’s use, and in the public’s interest and benefit, and is hereby approved.

Resolution No.: 2018-235

Whereas, the Wabasha County Highway Department proposes to acquire property in addition to the  existing right of way of County State Aid Highway 26 and Minnesota Trunk Highway 74 for the purpose of improvements under project SAP 079-626-005 and SP 7909-05; and 

Whereas, the property necessary to be acquired for improvements and existing right of way for project SAP 079-626-005 and SP 7909-05 are described on Wabasha County Highway Right of Way Plat No. 50, and

Whereas, the property necessary to be used during construction under temporary easements from adjacent properties for project SAP 079-626-005 and SP 7909-05 are described on said project’s construction plans.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, improvements under project SAP 079-626-005 and SP 7909-05 are necessary in order to improve this segment of County State Aid Highway 26 and Minnesota Trunk Highway 74 to provide for public health, welfare, safety and convenience.

Be It Further Resolved by the Wabasha County Board of Commissioners that, hereby approves and accepts Wabasha County Highway Right of Way Plat No. 50 designating the location of right of way.

Be It Further Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer is hereby authorized to proceed to acquire the property as described in Wabasha County Highway Right of Way Plat No. 50 in accordance with applicable laws and statutes including the use of Eminent Domain.

Be It Further Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer is hereby authorized to proceed to make Application for Easement Across State Land to the State of Minnesota Department of Natural

Resources and acquire the Easement applied for including payment for necessary acquisition costs for the applicable property parcel(s) as described in Wabasha County Highway Right of Way Plat No. 50.

Be It Further Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Engineer is hereby authorized to proceed to acquire temporary easements as shown on project SAP 079-626-005 and SP 7909-05 construction plans in accordance with applicable laws and statutes including the use of Eminent Domain.

Resolution No: 2018-236

Resolution Authorizing the Purchase of One (1) Mobile radio
And authorization for Auditor’s Warrant

Whereas, the Wabasha County Sheriff’s Office is requesting to purchase a total of one (1) Mobile radio per attached quote from Motorola Solutions, and;

Whereas, the money for this purchase will be paid by Auditor’s Warrant from Insurance proceeds from Squad #10406 claim #18PC1436 & Equitable Sharing Funds, and,  

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Auditor is authorized to issue an Auditor’s Warrant to the respective vendor, Motorola Solutions, for the purchase of one (1) Mobile radio. 

Be it Further Resolved by the Wabasha County Board of Commissioners that the total cost for the radio will not exceed $4,900.

Be it Further Resolved by the Wabasha County Board of Commissioners that funding for this purchase will come from Insurance proceeds from Squad #10406 claim #18PC1436 & Equitable Sharing Funds.

Resolution No.: 2018-237

Whereas, the Wabasha County Highway Department submitted a CUP/IUP application to allow for the placement of fill in a general floodplain zone as part of a road embankment for the proposed County Highway 4 reconstruction project in Sections 25 & 26, Township 110 North, Range 12 West, Town of West Albany; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on November 26, 2018 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission considered the findings as required in the Wabasha County Zoning Ordinance and recommends (vote 4-0) to the Wabasha County Board of Commissioners that the request be approved as presented without any conditions.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Board of Commissioners agrees with the findings from the Planning Commission and approves the Conditional Use Permit for the Wabasha County Highway Department.

Resolution No: 2018-233

Resolution Authorizing the Purchase of One (1) Dodge Charger

And authorization for Auditor’s Warrant

Whereas, the Wabasha County Sheriff’s Office is requesting to purchase a total of one (1) 2019 Dodge Charger per attached quote from Dodge of Burnsville, MN, and;

Whereas, the money for this purchase will be paid by Auditor’s Warrant from Capital Funds not to exceed the amount of $38,500; and

Whereas, this above referenced cost includes installation and equipment: IRSA Camera System with 3 year extended warranty, Mobile radio, Emergency Lights and Siren, Cage, Console, Graphics, and Floor mats.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Auditor is authorized to issue an Auditor’s Warrant to the respective vendor, Dodge of Burnsville, for the purchase of one (1) Dodge Charger and the necessary equipment listed above.  

Be it Further Resolved by the Wabasha County Board of Commissioners that the total cost for the vehicle, which includes installation and above-named equipment, will not exceed $38,500 and that no funds shall be authorized to be used for the installation of the referenced equipment until approved by the Budget Committee.

Be it Further Resolved by the Wabasha County Board of Commissioners that once installation costs have been approved by the Budget Committee the funds delegated for that purpose will be released.
