Meeting of November 20, 2018


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, November 20, 2018 at 9:00 a.m.
The meeting was called to order by Board Chairperson Goihl.

Resolution No.: 2018-212

Now, Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Highway Department is authorized to dispose of the following listed equipment by sale at auction or waste disposal:
                Item 5100 Air Compressor
                Item 5130 Air Compressor
                Item 5033 Forney Welder

Resolution No.: 2018-213

Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for Local Road Improvement and

Whereas, the Commissioner of Transportation has given notice that funding for Project SAP 079-618-008 is available; and

Whereas, the amount of the grant has been determined to be $800,000.

Now, Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant consistent with Minnesota Statutes, section 174.52, and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated but not required. 

Be it Further Resolved by the Wabasha County Board of Commissioners that the Wabasha County Engineer is hereby authorized to execute the Grant Agreement (MnDOT Agreement No. 1032781) with the Commissioner of Transportation including “Exhibit C Bond Financed Property Certification”.

Resolution No.: 2018-214

Whereas, Roberson Lime & Rock Inc. is the lowest responsible bidder for C.P. 79-19-6030.

Now, Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Roberson Lime & Rock Inc. for C.P. 79-19-6030 – Aggregate Surfacing - in the amount of $167,750 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Roberson Lime & Rock Inc. for this work.

Resolution No.:  2018-215

Whereas, Sir-Lines-A-Lot had the lowest bid for Project C.P. 79-19-6000 – Furnish and Apply Traffic Paint to Roads in Wabasha County.

Now, Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Sir-Lines-A-Lot for Project C.P. 79-19-6000 – Furnish and Apply Traffic Paint to Roads in Wabasha County - in the amount of $32,310.64 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Sir-Lines-A-Lot for this work.

Resolution No.: 2018-216

Whereas, Northern Salt Inc. is the lowest responsible bidder for C.P. 79-19-6020.
Now, Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Northern Salt Inc. for Project C.P. 79-19-6020 in the amount of $51,857.47 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Northern Salt Inc. for this work.

Resolution No.:  2018-217

Whereas, Phoenix Corp. is the lowest responsible bidder for CP 079-004-001.

Now, Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Phoenix Corp. for CP 079-004-001 in the amount of $118,160 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Phoenix Corp. for this work.

Resolution No.: 2018-218

Whereas, The Mazeppa Cenex is under new ownership, and is now called Mazeppa BP, LLC has applied for a new tobacco license and paid the license fee; and

Whereas, The Wabasha County Board of Commissioners has approved issuance of a tobacco license for The Mazeppa BP, LLC, effective for the period 11/20/18 to 11/19/2019; and

Now, therefore be it resolved, the Wabasha County Board by the Wabasha County Board of Commissioners that:  Mazeppa BP, LLC is licensed to sell tobacco products according to Wabasha County Ordinance No. 40.

Open the Closed Session

Resolution Number: 2018-219

Whereas, M.S. §13.05, Subd. 3(b) permits closing a County Board meeting if such closure is permitted by attorney-client privilege;

Whereas, the County Board desires to consult with its attorney regarding a zoning matter that is pending;

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting; and,

Whereas, without such a meeting the County will have to make decisions without full benefit of consultation with counsel, and is concerned that, without full consultation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision-making available only in a closed session with counsel; and,

Whereas, County strategy may be impaired if every discussion is available for the benefit of the opposing parties; and

Whereas, based on the foregoing, the Board finds there is an absolute need for confidentiality of the matter.

Now, Therefore be it Resolved by the Wabasha County Board of Commissioners, a closed meeting of the County Board addressing the above-referenced concerns will be held with the County’s counsel.  No subject matter other than the foregoing shall be discussed at said meeting.
