WABASHA COUNTY BOARD OF ADJUSTMENT MEETING - SEPTEMBER 13, 2016


Minutes

1. The meeting was called to order at 7:00 p.m. by Chair Robert Walkes. Other members present were Ken Jacob, Mike Wallerich, Jon Beckman, and Gayle Gillespie.

2. Motion by Gillespie/Jacob to approve the agenda as presented. Motion carried.

3. Motion by Beckman/Jacob to approve the minutes of the August 16, 2016 meeting. Motion carried.

4. Public Hearing:

• Application submitted by Barb and Gary Schumacher requesting a variance from Section 4, Subdivision 407 of the Wabasha County Feedlot Ordinance to allow for a manure storage facility to be placed approximately 185’ from the center of a public road. The property on which the request is being made is described as parcel R12.00344.00 located in Section 36, Township 109 North, Range 12 West, Town of Oakwood (26539 570th Street, Plainview).

5. Motion by Gillespie/Jacob to close the public hearing and move to the findings. Motion carried.

6. Motion by Jacob/Gillespie to approve the Schumacher variance request as presented. Motion carried.

7. Public Hearing:

• Application submitted by Lana Walters requesting a variance from Article 13, Section 8, Subd. 4 of the Wabasha County Zoning Ordinance to allow for the placement of a dwelling to be less than 100’ from Lake Zumbro and less than 15’ from a property line. Also, a variance is being requested to allow for the placement of a septic system to be less than 75’ from Lake Zumbro. The property on which the request is being made is described as parcel R17.00357.00 located in Section 34, Township 109 North, Range 14 West, Town of Zumbro (40612 Ryan’s Bay Road, Zumbro Falls).

8. Motion by Wallerich/Jacob to close the public hearing and to move to the findings. Motion carried.

9. Motion by Jacob/Gillespie to approve the Walters variance request as presented with one condition. Motion carried. The one condition of approval is as follows:

1. A shoreland buffer of native vegetation shall be established below the 924’ contour except for the area identified as the “lake access area” on the map submitted with the application.

10. Public Hearing:

• Application submitted by Jonathon Fjelsted requesting a variance from Chapter 394.36, Subd. 4 Minn. Stats. to allow for the expansion of a nonconforming structure. The property on which the request is being made is described as parcel R05.00464.03 located in Section 18, Township 110 North, Range 9 West, Town of Greenfield (65164 140th Ave., Wabasha).

11. Motion by Gillespie/Beckman to close the public hearing and to move to the findings. Motion carried.

12. Motion by Gillespie/Jacob to approve the Fjelsted variance request as presented with one condition. Motion carried. The one conditions is as follows:

1. A shoreland buffer of native vegetation shall be established to a depth of 20’ from the normal pool level except for an area between the existing patio and the water.

13. Public Hearing:

• Application submitted by Bernard McNab requesting a variance from Chapter 7.06(1) of the Wabasha County Zoning Ordinance to allow for a garage to be located less than 30’ from a public road right-of-way. The property on which the request is being made is described as parcel R05.00487.39 located in Section 19, Township 110 North, Range 9 West, Town of Greenfield (64682 140th Ave., Wabasha).

14. Motion by Beckman/Jacob to close the public hearing and move to the findings. Motion carried.

15. Motion by Beckman /Wallerich to approve the McNab variance request as presented. Motion carried.

16. Public Hearing:

• Application submitted by Bryan Jeurs requesting a variance from Chapter 394.36, Subd. 4 Minn. Stats. to allow for the expansion of a nonconforming structure. The property on which the request is being made is described as parcel R11.00198.00 located in Section 26, Township 111 North, Range 13 West, Town of Mount Pleasant (69753 Hwy. 63, Lake City).

17. Motion by Gillespie/Beckman to close the public hearing and move to the findings. Motion carried.

18. Motion by Jacob/Beckman to approve the Jeurs variance request as presented. Motion carried.

19. Application submitted by Alex Hagedorn requesting an after-the-fact variance from Chapter 11.02(7) of the Wabasha County Zoning Ordinance to allow for the placement of a driveway on a slope greater than 30%. The property on which the request is being made is described as parcel R16.00220.03 located in Section 28, Township 110 North, Range 12 West, Town of West Albany (29865 640th St., Millville, MN) (Public hearing was conducted at the July 12th meeting). Ken Jacob recused himself from the matter.

Motion by Beckman/Wallerich to deny the request based upon multiple factors. Motion carried. The reasons for denial are as follows:

1. A township road is already available for use.

2. The proposal to construct a road in a bluff zone over 30% is not in accordance with the Comprehensive Plan or Zoning Ordinance.

3. The applicant has not demonstrated a hardship to justify the granting of the variance request.

20. No additional business discussed.

21. Motion by Gillespie/Jacob to adjourn at 8:07 p.m. Motion carried.
