MINUTES OF THE SEPTEMBER 24, 2018

WABASHA COUNTY PLANNING COMMISSION MEETING


MINUTES

1. Jeanne Pietig called the meeting to order at 7:00 p.m. Other members present were Ken Jacob, Gayle Gillespie, Jon Beckman, and Rich Hall.

2. Motion by Beckman/Gillespie to approve the agenda as presented. Motion carried.

3. Motion by Gillespie/Jacob to approve the minutes for the August 27, 2018 meeting. Motion carried.

4. Motion by Pietig/Gillespie to open the public hearing for the application submitted by Good Shepherd Church for the expansion of an existing church on parcel 02.00212.06 located in Section 24, Township 108 North, Range 12 West, Town of Elgin (52668 275th Ave., Plainview). Motion carried.

5. Motion by Gillespie/Beckman to close the public hearing. Motion carried.

6. Motion by Beckman/Jacob to forward the request from Good Shepherd Church to the County Board of Commissioners with a recommendation that the CUP be approved with three conditions. Motion carried. The three conditions are as follows:

• The CUP is being issued to only allow for an addition to the existing church on the property and does not allow for any additional uses on the property other than what is outlined in the CUP application.

• The expansion project shall be undertaken only in accordance with the plans and specifications as submitted in the application.

• There shall be no parking along the township road for any regular or special events.

7. Motion by Pietig/Jacob to open the public hearing for the application submitted by Three Rivers Community Action, Inc. for the expansion of an existing business on parcel 14.00303.00 located in Section 4, Township 108 North, Range 11 West, Town of Plainview (55049 241st Ave., Plainview). Motion carried.

8. Motion by Gillespie/Jacob to close the public hearing. Motion carried.

9. Motion by Beckman/Jacob to forward the request from Three Rivers Community Action to the County Board of Commissioners with a recommendation that the CUP be approved with three conditions. Motion carried. The three conditions are as follows:

• The CUP is being issued to only allow for the construction of a new administrative building on the property.

• The projects shall be undertaken only in accordance with the plans and specifications as submitted in the application.

• The applicant shall be responsible to ensure that the business will meet the State’s accessibility requirements.

10. Motion by Pietig/Jacob to open the public hearing for the application submitted by Steven Overton for the operation of a bar and restaurant on parcel 09.00435.00 located in Section 34, Township 109 North, Range 14 West, Town of Mazeppa (40240 County Rd. 90, Mazeppa). Motion carried.

11. Motion by Gillespie/Jacob to close the public hearing. Motion carried.

12. Motion by Beckman/Jacob to forward the request from Steven Overton to the County Board of Commissioners with a recommendation that an IUP be approved for the business with nine conditions. Motion carried. The nine conditions are as follows:

• The permit is being issued as an Interim Use Permit that is valid only for Steven Overton to be the operator of the bar and restaurant located on the respective property.

• The IUP is being issued to only allow for the operation of a bar and restaurant within the confines of the existing structure on the property as proposed in the application. There shall not be any additional uses on the property, especially any event located outside of the permanent structure on the property.

• Hours of operation shall be limited to 11:00 a.m. to 1:00 a.m., Wednesday through Sunday.

• There shall be no parking in the area labeled “Parking Lot B” as indicated on the applicant’s map unless a waiver is obtained from the Wabasha County Highway Engineer and the owner(s) of the respective property.

• The applicant shall be responsible for the coordination and payment of an inspection to be completed by the County’s contracted building code inspector to determine compliance with the State’s accessibility requirements. The applicant shall have six months from the date the IUP is issued to have the property inspected and have any deficiency found by the building code inspector be corrected.

• The noise generated as part of the business shall not be perceptible beyond the boundaries of the property as per Chapter 9.02(1) of the Wabasha County Zoning Ordinance.

• Any exterior lighting shall utilize downcast lights where the lighting must be directed inward and not toward any property line. No upward-directed lighting shall be permitted.

• The property shall not exceed the impervious surface restrictions outlined in Chapter 13 of the Wabasha County Zoning Ordinance.

• The granting of the IUP does not permit the applicant the right to block the access to the lake through the access easement. It is the applicant’s obligation to ensure that the requirements for the access easement are satisfied according to those that hold title to the easement.

13. Motion by Jacob/Gillespie to adjourn the meeting at 8:37 p.m. Motion carried.
