The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, March 05, 2019 at 9:00 a.m.

The meeting was called to order by Board Chairperson Springer.

RESOLUTION NO: 2019-041

WHEREAS, the Twin Cities-Milwaukee-Chicago Second Train Passenger Rail Study completed the alternatives analysis and modeling for introducing a second daily train between the Twin Cities, Milwaukee and Chicago at speeds up to 79 miles per hour in December 2018; and

WHEREAS, the Twin Cities-Milwaukee-Chicago Second Train Passenger Rail Study identified approximately $38 million in track and signal improvements in and near Winona, Minnesota, and

WHEREAS, passenger trains would utilize the existing Amtrak Empire Builder corridor from Saint Paul, MN to Chicago, IL with Minnesota station stops at Union Depot in Saint Paul, Red Wing and Winona; and

WHEREAS, a second round-trip passenger train from the Twin Cities to Chicago will benefit Minnesota's economy by supporting and creating jobs, increasing tourism and providing a more economical travel choice; and

WHEREAS, freight railroads will benefit from the capital improvements needed for the Twin Cities-Milwaukee-Chicago Second Train.  Crossing improvements will make auto and truck travel safer; and

WHEREAS, MnDOT has requested $4 million in Governor Walz's capital funding request to the legislature to complete the environmental analysis, service development plan and final engineering.

NOW, THEREFORE, BE IT RESOLVED, the County of Wabasha, Minnesota, that it hereby supports funding for the Twin Cities-Milwaukee­ Chicago Second Train, and requests that Governor Walz include the $4 million request from the MnDOT Passenger Rail Office in his capital funding request to the Minnesota Legislature.

Whereas, the Wabasha County Board of Commissioners on an annual basis per the Fund Balance policy approves by consensus designated fund balances as of the end of the financial reporting period.

Minnesota DNR 2018 Federal Boating Safety Supplemental Equipment Grant

and authorization for Auditor’s Warrant

Whereas, the Sheriff’s Office has received notification of award for the 2018 Federal Boating Safety Supplemental Equipment Grant; and,

Whereas, the Sheriff requests the approval and signing of the 2018 Minnesota Department of Natural Resources Federal Boating Safety Supplemental Equipment Grant by the County Auditor or County Administrator, Chairperson of the County

Board, and Sheriff.

Whereas, this grant expires August 14, 2019 and all requirements must be met on or before this date in order to receive reimbursement.

Whereas, the Sheriff also requests approval for the Auditor’s Office to cut an Auditor’s Warrant not to exceed the award amount of $18,157 once the invoices are received to ensure reimbursement timelines are met.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2018 Minnesota Department of Natural Resources Federal Boating Safety Supplemental Equipment Grant is hereby approved and authorizes it’s signing by the Chairperson of the County Board, County Auditor or County Administrator, and Sheriff.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor’s Office is hereby authorized to cut an Auditor’s Warrant not to exceed the award amount of $18,157 to the respective vendors once invoices are received.

Property Assessed Clean Energy (PACE) Request – Pilot Mound Farm Application

Resolution No.: 2019-045

Whereas, Minnesota Statutes, Sections 216C.435 and 216C.436 (the “Act”) authorize the County to provide for the financing of the acquisition and construction or installation of energy efficiency and conservation improvements (the “Improvements”) on qualifying real property located within the boundaries of the County; and
Whereas, an application was received from the Pilot Mound Farm LLC for property located at 34901 County Road 78, Lake City, MN  55041 to participate in the PACE program (Parcel Number R11.00207.06 and R11.00205.00); and

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the above referenced application, which is formally adopted by reference, is approved and the Wabasha County Auditor/Treasurer’s office shall apply the special assessments to the property as noted in the February 7, 2019 letter from the St. Paul Port Authority.

Resolution Number: 2019-046

Approval for purchase of AIS radio campaign

WHEREAS, Wabasha County has an Aquatic Invasive Species (AIS) Management Plan for the purpose of preventing the spread of and managing AIS in Wabasha County; and

WHEREAS, Radio advertising offers an efficient and localized target for spreading awareness of AIS and informing best management practices to reduce their spread; and

WHEREAS, The approved 2019 Wabasha County AIS Management Plan includes $13,000 of budget allotted towards outreach; and

WHEREAS, Q-Media group owns and operates the included radio stations along with their advertising rights; and

WHEREAS, Wabasha County has been offered a partnership with Goodhue County and Winona County to share the cost of a radio campaign in 2019 for the three county area for a bid of:
 $9,945

NOW THEREFORE BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves a $9,945 payment for purchase of a partnered AIS radio campaign in 2019.

Finance: End of Year Financial Reports

Resolution No.: 2019-047

Whereas, Northside Mini Storage, LLC (Rick Speltz) applied for a Conditional/Interim Use Permit to allow for the expansion of an existing mini storage as parcel 02.00237.00 located in Section 27, Township 108 North, Range 12 West, Town of Elgin (29105 County Road 25, Elgin, MN); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on February 25, 2019 to provide an opportunity for the public to present any testimony related to the request; and

Whereas; The Planning Commission has considered the findings of fact and has considered all testimony related to the matter and recommends (vote 4-0) that the Wabasha County Board of Commissioners approve the request for a CUP with five conditions.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Board of Commissioners agrees with the findings from the Planning Commission and approves the Conditional Use Permit for Northside Mini Storage, LLC with five conditions as follows:

  1. A Conditional Use Permit is granted only for the expansion of the mini storage business as presented in the application.
  2. The business shall adhere to all requirements of the Wabasha County Zoning Ordinance and the conditions of this Conditional Use Permit to remain valid.
  3. The CUP does not allow for any additional use of the property beyond what was presented in the application.
  4. A land use permit shall be obtained from Wabasha County for the grading activity on the property and all fill placed below the regional flood elevation shall be removed by July 1, 2019.  Proper erosion control shall be installed before any excavation work begins and the site shall be stabilized as soon as practicable with an appropriate seed mix and mulch.

A stormwater pond shall be established as indicated in the application and shall be completed by July 1, 2019.

Resolution No.: 2019-048

Whereas, Scotch Prairie Farms (Brian Yotter) applied for a Conditional/Interim Use Permit to allow for the expansion of an existing feedlot on parcel16.00061.00 located in Section 11, Township 110 North, Range 12 West, Town of West Albany (27170 661st Street, Lake City, MN); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on February 25, 2019 to provide an opportunity for the public to present any testimony related to the request; and

Whereas; The Planning Commission has considered the findings of fact and has considered all testimony related to the matter and recommends (vote 3-1) that the Wabasha County Board of Commissioners approve the request for a CUP with four conditions.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Board of Commissioners agrees with the findings from the Planning Commission and approves the Conditional Use Permit for Scotch Prairie Farms with four conditions as follows:

  1. A Conditional Use Permit is granted only for the expansion of a feedlot as presented in the application.
  2. The number of animal units on the respective parcel shall be limited to 3,149.
  3. The owners shall maintain compliance with all MPCA regulations related to feedlots, including manure application requirements.

The construction of any new building or manure storage structure shall adhere to the setback requirements established in the Wabasha County Feedlot Ordinance or the Wabasha County Zoning Ordinance unless a variance is granted for any setback established in either ordinance.
