The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 21, 2019 at 9:00 a.m.

The meeting was called to order by Board Chairperson Springer.

The following Commissioners were present:  Hall, Key, Springer, Wobbe, ABSENT: Goihl

Resolution No.: 2019-088

Whereas,  years of service are recognized by Wabasha County;

Whereas,  full and part-time employees with five (5) years of service shall receive recognition by a recognition certificate and chamber bucks;

Whereas, the Labor Management Committee discussed and agreed that employees should be recognized at milestone anniversaries with gift cards instead of chamber bucks;

Whereas, a job description was developed and submitted to Springsted.  The position of Patrol Sergeant is Grade 12, 378 points.

Whereas, an MOU was drafted and signed reflecting the change in policy by the bargaining units with Employee Recognition articles in their contracts (Social Services, Courthouse, and Highway);

Now Therefore be it Resolved by the Wabasha County Board of Commissioners to adopt the revised Policy 408-Employment Recognition.

Resolution No.: 2019-089

Whereas, the Minnesota Housing Finance Agency, State of Minnesota, has been authorized to undertake a program to provide funds for Family Homeless Prevention & Assistance Projects; and,

Whereas, the Southeastern Minnesota Housing Network, working through: 1) Three Rivers Community Action, Inc. – Grantee and 2) Sub-Grantees Semcac and Lutheran Social Service of MN, have developed a renewal application for the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program; and

Whereas, the Southeastern Minnesota Housing Network working through: Three Rivers Community Action, Inc., and Sub-Grantees have demonstrated the ability to perform the required activities of the Minnesota Housing Finance Agency Family Homeless Prevention & Assistance Program;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Southern Minnesota Housing Network is hereby authorized as an entity to be charged with the administration of funds made available through the Minnesota Housing Finance Agency Family Homeless Prevention and Assistance Program in the county of Wabasha, in Minnesota.

Resolution No.:  2019-090

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County IT Director is authorized to purchase (3) MS Surface Pros along with related equipment needed to complete installation for the County Probation office. 

Be it Further Resolved by the Wabasha County Board of Commissioners that costs for the equipment will be paid from grant funds received by the Probation Department.

Be it Further Resolved by the Wabasha County Board of Commissioners that a auditors warrant is authorized to be issued to cover the costs

Resolution No.: 2019-091

Now Therefore be it Resolved that the Wabasha County Board of Commissioners that Wabasha County enter into the attached “Cooperative Agreement Between the City of Wabasha and Wabasha County” for the projects identified as S.A.P. 079-594-001 and S.A.P. 079-594-002 for improvements within the City of Wabasha and hereby authorizes the Chair of the Board and County Administrator to execute the above Agreement.

Resolution No.: 2019-092

Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for Local Road Improvement and

Whereas, the Commissioner of Transportation has given notice that funding for Project SAP 079-594-001 and SAP 079-594-002 is available; and

Whereas, the amount of the grant has been determined to be $295,000.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant consistent with Minnesota Statutes, section 174.52, and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated but not required. 

Be it Further Resolved by the Wabasha County Board of Commissioners that the Wabasha County Engineer is hereby authorized to execute the Grant Agreement (MnDOT Agreement No. 1034239) with the Commissioner of Transportation including “Exhibit C Bond Financed Property Certification.”

Resolution Authorizing 2019 State of Minnesota DNR

Annual County Boat and Water Safety Grant
Contract #157518

Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2019 State Boat and Water Safety Grant; and,

Whereas, the Sheriff’s Office has received the 2019 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and,

Whereas, the Sheriff requests the approval and signing of the 2019 State of Minnesota (DNR) Annual County Boat and Water Safety Grant Agreement by the County Administrator and Chairman of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2019 State of Minnesota (DNR) Annual County Boat and Water Safety Grant Agreement is hereby approved and authorizes it’s signing by the County Administrator and Chairman of the County Board.

Resolution Authorizing

Minnesota DNR 2019 Federal Supplemental Boating Safety Patrol Grant

Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2019 Federal Supplemental Boating Safety Patrol Grant; and

Whereas, the Sheriff’s Office is waiting on the 2019 contract which needs to be approved and signed by the Sheriff, County Auditor or Administrator, and County Board Chairperson; and

Whereas, the Sheriff requests the approval and signing of the 2019 Minnesota Department of Natural Resources Federal Supplemental Boating Safety Patrol Grant by the Sheriff, County Auditor or Administrator, and Chairperson of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2019 Minnesota Department of Natural Resources Federal Supplemental Boating Safety Patrol Grant is hereby approved and authorizes it’s signing by the Sheriff, County Auditor or Administrator, and County Board Chairperson.

Resolution Authorizing Communications Tower Lease Agreement

Between Wabasha County and Hiawatha Broadband Communications, Inc.
Regarding the Lake City Radio Tower Site

Whereas, the Wabasha County Sheriff’s Office is requesting to enter into a Lease Agreement with Hiawatha Broadband Communications, Inc. regarding the Lake City Radio Tower site; and,

Whereas, this lease agreement shall commence on the 1st day of the month the Tenant begins installing equipment at the site and extend through December 31, 2022; and,

Whereas, the monthly revenue for this agreement is Three hundred fifty dollars and no cents ($350.00) initially with a 3% increase annually per calendar year thereafter; and,

Whereas, the funds will go into the 911 (290) account.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Chairperson of the Wabasha County Board of Commissioners is hereby authorized to sign the Communication Tower Lease Agreement between Wabasha County and Hiawatha Broadband Communications, Inc. regarding the Lake City Radio Tower site.

Now Therefore be it further Resolved, that the income will go into the 911 (290) account.

Resolution Authorizing Maintenance Service Agreement with Vertiv
for UPS (uninterruptible power supply) equipment

Whereas, the Sheriff’s office is requesting authorization to enter into a maintenance agreement with Vertiv for the UPS systems which were installed in 2008; and,

Whereas, the annual cost is six thousand four hundred five dollars and no cents ($6,405.00); and,

Whereas, the monies for this will come from 911 (290) and Jail (251) funds;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that:  The PSAP Supervisor is hereby authorized to sign the Maintenance Agreement/Proposal for Service #Q02949434 with Vertiv for the UPS equipment.

Be it Further Resolved that the yearly cost will come from 911 (290) and Jail (251) funds.

Resolution No. 2019-097                       
Resolution Supporting Regional Park Or Trail Designation Application In Greater Minnesota

Park or trail name:_Zumbro Water Trail______________________________________

BE IT RESOLVED that the City of Oronoco as lead applicant, has the authority to act as legal public sponsor for the application described in the Request for Designation as a Regional Park or Trail in Greater Minnesota. As joint applicant(s)/partner(s) Wabasha County we formally support(s) and authorize(s) the applicant’s submission on behalf of the partnership.

BE IT FURTHER RESOLVED that as lead applicant and joint applicants we are fully aware of the information provided in the application and associated responsibilities, including long-term commitments as defined in the application and related master plan and supporting information as submitted.  

BE IT FURTHER RESOLVED that, should the Zumbro Water Trail receive formal designation as a Regional park or trail in Greater Minnesota by the Commission, that as the lead applicant or joint applicant(s)/partner(s)we have the legal authority to enter into formal designation and funding agreements with the Commission for the referenced park or trail.

BE IT FURTHER RESOLVED that listed applicant and joint applicant(s)/partner(s)  certify they will comply with all applicable laws and regulations associated with regional designation and any future grant funding for their respective portions of any project.

Resolution No.: 2019-098

Set Public Hearing Date for Impassable Road Petition

Whereas, on May 3rd, 2019 the Wabasha County Attorney’s Office received a written complaint pursuant to Minnesota Statute 163.16 which was signed by more than five land owners within Lake Township; and

Whereas, the written complaint has been forwarded on to the Wabasha County Board of Commissioners; and

Whereas, the written complaint alleges that town road 700th Street to 264th Ave to 706th Street to 705th Street has not been constructed or is not properly maintained, and because of such neglect is not reasonably passable; and

Whereas, the by statute County Board is required to fix a time and place for hearing the complaint;

Now Therefore Be It Resolved, that the Wabasha County Board of Commissioners sets the Hearing for said complaint as 9:15 am, Tuesday, June 25th, 2019. At the designated time and place the county board shall consider the complaint and hear and consider such testimony as may be offered by the officers of the town and the complainants relative to the matters set forth in the complaint.

The chair of the county board, or the presiding officer thereof, may administer oaths to witnesses and require them to testify under oath.

Be It Further Resolved, that county auditor shall mail a copy of the complaint, together with notice of the time and place of hearing on the complaint, to the town clerk of Lake Township, town clerk of Pepin,  as well as all persons who signed the complaint.

Finance: Quarterly Reports

Resolution No.: 2019-099

Whereas, the County Board  has authorized Denise Anderson, Auditor/Treasurer or Debbie Koenig, Finance Director to make investments of funds under sections 118A.01 to 118A.06 of Minnesota Statutes or other applicable law; and

Whereas, the Denise Anderson has resigned her position with Wabasha County and is no longer authorized to invest funds for the County.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,  the following appointments and actions are hereby directed and approved:

  1. That the Wabasha County Board of Commissioners hereby grants to Debbie Koenig, Finance Director, the authority to designate depositories for the County of Wabasha as provided for in Minnesota Statute 118A.02 subd. 1.

That the Wabasha County Board of Commissioners hereby authorizes Debbie Koenig, Finance Director or Gwen Resech to make investments of funds under sections 118A.01 to 118A.06 of Minnesota Statutes or other applicable law.

Resolution No.:  2019-100

Delegation of Authority for Paying Claims 

Whereas, Minnesota Statute 375.18 Subd. 1a and Subd. authorizes the County to delegate authority to pay certain claims made against the County to a County Administrative Official, and

Whereas, the County Finance Director is a County Administrative Official, and

Whereas, the County of Wabasha desires the County Administrative official to pay all claims per the current established standards and procedures as approved by the County Board, and

Whereas, all vendor warrant/checks drawn for payment of claims are to be signed by the Finance Director and the Board Chair, and

Whereas, all payroll warrant/checks are to be signed by the Finance Director.

Now, therefore, be it resolved by the Wabasha County Board of Commissioners that, the Wabasha County Finance Director is authorized to pay claims presented that meet the standards and procedures established by the County Board.

Resolution No.:  2019-101

Deposit account authority for WNB Financial, N.A.

Whereas, the County of Wabasha has designated WNB Financial, N.A. as a depository of its public funds pursuant to Minnesota Statues, Chapter 118A, and

Whereas, it is necessary to update authorizations at WNB Financial N.A. due to the resignation of Denise Anderson, Auditor Treasurer.

Now, therefore, be it resolved by the Wabasha County Board of Commissioners that, the following changes are approved to be made to the WNB Financial, N.A. County authorizations:

  1. Denise Anderson is to be removed as an authorized signer on the County accounts at WNB Financial, N.A. effective May 27, 2019.
  2. Gwen Resech is to be added as authorized signers on the accounts as listed on the attachment.

Be it further resolved by the Wabasha County Board of Commissioners that, the following employees and Board Chair are given specific authority at WNB Financial, N.A. per the attached.  (See attachment)

Resolution No.: 2019-102
Appointment of County Auditor/Treasurer

Whereas, each county in the state is required to have a county auditor/treasurer who is appointed by the county board of commissioners based on his or her knowledge and training in the field of property assessment and taxation; and

Whereas, Minnesota Statute 273.061 declares that the term of office for a County Auditor/Treasurer shall begin on January 1 and a completed appointment form must be completed and returned to the Department of Revenue on or before May 28, 2019 for the position to be reappointed and approved by the Commissioner of Revenue; and

Whereas, on May 21, 2019  Brian E. Buhmann was appointed as interim Auditor/Treasurer to fill the term of the prior Wabasha County Auditor/Treasurer.  The term is scheduled to end on December 31, 2022;

Whereas; Pursuant to Minnesota Statutes if a county does not intend to reappoint an Auditor/Treasurer it must provide 90 days notice. and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that they appoint Brian E. Buhmann as Interim  Auditor/Treasurer as of May 28, 2019.
